CIRCULAR

Amendments to some articles of Circular No. 52/2017/TT-BYT dated December 29, 2017 and Circular No. 18/2018/TT-BYT dated August 22, 2018 of the Minister of Health of Vietnam which amends some articles of Circular No. 52/2017/TT-BYT on prescription of modern drugs and biologicals in outpatient treatment and Circular No. 27/2021/TT-BYT dated December 20, 2021 of the Minister of Health of Vietnam on electronic prescription

Pursuant to the Law on Pharmacy No. 105/2016/QH13 dated April 06, 2016;

Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government on function, tasks, powers and organizational structures of the Ministry of Health of Vietnam;

At the request of the Director General of Department of Medical Service Administration and Director General of Electronic Health Administration;

The Minister of Health of Vietnam promulgates a Circular amending some articles of Circular No. 52/2017/TT-BYT dated December 29, 2017 and Circular No. 18/2018/TT-BYT dated August 22, 2018 of the Minister of Health of Vietnam which amends some articles of Circular No. 52/2017/TT-BYT on prescription of modern drugs and biologicals in outpatient treatment and Circular No. 27/2021/TT-BYT dated December 20, 2021 of the Minister of Health of Vietnam on electronic prescription.

Article 1. Amendments to some articles of Circular No. 52/2017/TT-BYT dated December 29, 2017 and Circular No. 18/2018/TT-BYT dated August 22, 2018 of the Minister of Health of Vietnam which amends some articles of Circular No. 52/2017/TT-BYT on prescription of modern drugs and biologicals in outpatient treatment (hereinafter referred to as “Circular No. 52/2017/TT-BYT and Circular No. 18/2018/TT-BYT) and Circular No. 27/2021/TT-BYT dated December 20, 2021 of the Minister of Health of Vietnam on electronic prescription (hereinafter referred to as “Circular No. 27/2021/TT-BYT):

1. Amendments to Article 10 of Circular No. 52/2017/TT-BYT:

Health facilities shall carry out electronic prescription according to regulations in Circular No. 27/2021/TT-BYT dated December 20, 2021 of the Minister of Health of Vietnam on electronic prescription.”

2. Replacement of prescription forms prescribed in Appendix II and Appendix III issued together with Circular No. 52/2017/TT-BYT and prescription form issued together with Circular No. 18/2018/TT-BYT by prescription forms specified in Appendices issued herewith.

3. Amendments to Article 6 of Circular No. 27/2021/TT-BYT:

“Article 6. Roadmap for implementation

Health facilities must implement electronic prescription as prescribed in this Circular according to the following specific roadmap:

1. For class-3 hospitals or higher: complete before December 31, 2022.

2. For other health facilities: complete before June 30, 2023.”

Article 2. Entry into force

This Circular comes into force from September 15, 2022.

In case health facilities prescribed in clause 2 Article 6 of Circular No. 27/2021/TT-BYT are using physical prescriptions under the prescription form prescribed in Circular No. 52/2017/TT-BYT and Circular No. 18/2018/TT-BYT, they are allowed to continue to use such printed physical prescriptions according to the roadmap prescribed in clause 3 Article 1 hereof.

Article 4. Responsibility for implementation

Director General of Department of Medical Service Administration, Electronic Health Administration, Chief of the Ministry Office, Chief Inspector of the Ministry, Director Generals of Departments and General Departments of the Ministry of Health of Vietnam, Heads of units affiliated to the Ministry of Health of Vietnam, relevant organizations and individuals are responsible for the implementation of this Circular./.
