CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATION ON THE SAFETY AND HYGIENE FOR GLASS, CERAMIC, PORCELAIN AND ENAMELED IMPLEMENTS, CONTAINERS AND PACKAGING IN DIRECT CONTACT WITH FOOD
Pursuant to the Law on Food Safety dated June 17, 2010 and Government’s Decree No. 38/2012/ND-CP dated April 25, 2012 elaborating some articles of the Law on Food Safety;
Pursuant to the Law on Technical Regulations and Standards on June 29, 2006 and Government’s Decree No. 127/2007/ND-CP dated August 01. 2007 elaborating some articles of the Law on Technical Regulations and Standards;
Pursuant to the Government’s Decree No. 63/2012/ND-CP dated August 31. 2012 defining functions, tasks, entitlements and organizational structure of the Ministry of Health;
At the request of Director General of Vietnam Food Administration;
The Minister of Health hereby promulgates a national technical regulation on the safety and hygiene for glass, ceramic, porcelain and enameled implements, containers and packaging in direct contact with food.
Article 1. QCVN 12-4:2015/BYT - National technical regulation on the safety and hygiene for glass, ceramic, porcelain and enameled implements, containers and packaging in direct contact with food is promulgated together with this Circular.
Sections 4.1 and 4.2 of Part 4 on safety and hygiene for food implements, containers and packaging containing food promulgated together with the Decision No. 46/2007/QD-BYT dated December 19, 2007 of the Minister of Health are annulled from the effective date of this Circular.
Article 2. This Circular comes into force from May 01. 2016.
Article 3. Director General of Vietnam Food Administration, heads of affiliates of the Ministry of Health, affiliates of the Ministry of Health, Directors of Departments of Health of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular./.

Foreword
QCVN 12-4:2015/BYT is drafted by the Drafting Committee for national technical regulation on the safety and hygiene for glass, ceramic, porcelain and enameled implements, containers and packaging in direct contact with food, submitted by the Vietnam Food Administration for approval and promulgated together with the Circular No. 35/2015/TT-BYT dated October 28, 2015 of the Minister of Health.

NATIONAL TECHNICAL REGULATION ON THE SAFETY AND HYGIENE GLASS, CERAMIC, PORCELAIN AND ENAMELED IMPLEMENTS, CONTAINERS AND PACKAGING IN DIRECT CONTACT WITH FOOD
I. GENERAL PROVISIONS
1. Scope
This document provides for specifications and requirements for management of the safety and hygiene for glass, ceramic, porcelain and enameled implements, containers and packaging in direct contact with food (hereinafter referred to as “implements, containers and packaging”).
2. Regulated entities
This document applies to:
2.1. Importers, producers and sellers of implements, containers and packaging in Vietnam.
2.2. Relevant regulatory authorities.
3. Definitions
For the purposes of this document, the terms below shall be construed as follows:
3.1. “flatware” means the implements, containers and packaging which have an internal depth not exceeding 25 mm, measured from the lowest point to the horizontal plane passing through the point of overflow.
3.2. “hollowware” means the implements, containers and packaging which have an internal depth greater than 25 mm, measured from the lowest point to the horizontal plane passing through the point of overflow.
3.3. “enameled ware” means the implements, containers and packaging made of glass, ceramic, glass ceramic, metallic articles coated with vitreous or porcelain enamel.
3.4. “drinking rim” means the 20 mm wide section of the external surface of a drinking vessel, measured downwards from the upper edge along the wall of the vessel.

2. Labeling requirements
Implements, containers and packaging shall be labeled in accordance with regulations of the Government’s Decree No. 89/2006/ND-CP dated August 30, 2006 and other relevant regulations of law.
III. TEST AND SAMPLING METHODS
1. Sampling methods
Sampling methods are specified in the Circular No. 26/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology and other relevant regulations of law.
2. Test methods
The specifications provided in this document are tested according to the methods mentioned in the Appendix 01 hereof. The test methods mentioned in the Appendix 01 are optional. Other test methods with equal accuracy may be used.
IV. MANAGEMENT REQUIREMENTS
1. Declaration of conformity
1.1. Declarations of conformity of imported and domestic implements, containers and packaging must be submitted as prescribed in this document.
1.2. Methods and procedures for submission of declarations of conformity are specified in Articles 6 and 7 of the Government’s Decree No. 38/2012/ND-CP dated April 25, 2012 and Articles 4, 5, 7 and 9 of the shall Circular No. 19/2012/TT-BYT dated November 09, 2012 of the Minister of Health and other relevant regulations of law.
2. Inspection and actions against violations
Competent authorities shall carry out inspection and take actions against importers, producers and sellers of implements, containers and packaging who violate regulations on specifications and management specified in this document and other relevant regulations of law.
V. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
1. Importers, producers and sellers of implements, containers and packaging must submit declarations of conformity according to this document.
2. Importers, producers and sellers shall be only allowed to import, produce and sell implements, containers and packaging after obtaining the Certificate of submission of Declaration of Conformity and complying with other relevant applicable regulations of law.
VI. IMPLEMENTATION
1. The Vietnam Food Administration shall take charge and cooperate with relevant authorities in providing guidance and organizing the implementation of this document.
2. According to the management requirements, the Vietnam Food Administration shall request the Ministry of Health to make amendments to this document.
3. In the cases where any of the standards and regulations referred to in this document is amended or replaced, the newest one shall apply.
