CIRCULAR

ON LIST OF ORPHAN DRUGS

Pursuant to the Law on Pharmacy No. 105/2016/QH13 dated April 06, 2016;

Pursuant to the Government’s Decree No.75/2017/ND-CP dated June 20, 2017 on functions, duties, powers and organizational structure of the Ministry of Health;

At the request of the Head of the Drug Administration of Vietnam,

The Minister of Health hereby promulgates a Circular on list of orphan drugs.

Article 1. Scope

This Circular provides for list of orphan drugs, purposes of promulgation and rules of compilation of list of orphan drugs, and criteria for orphan drug designation.

Article 2. List of orphan drugs

The list of orphan drugs promulgated together with this Circular consists of:

1. List of drugs intended for prevention, diagnosis and treatment of rare diseases.

2. List of drugs not readily available.

Article 3. Purposes of promulgation of list of orphan drugs

1. List of drugs intended for prevention, diagnosis and treatment of rare diseases shall provide the basis for the following tasks:

a) Regulatory bodies shall consider excluding certain medical data and/or one or more than one clinical trial phase carried out before the marketing authorization is issued to a new drug according to regulations in Clause 3 Article 18 of the Circular No. 32/2018/TT-BYT dated November 12, 2018 by the Minister of Health on marketing authorization of drugs and medicinal ingredients (hereinafter referred to as “Circular No. 32/2018/TT-BYT”);

b) Regulatory bodies shall review drug stability studies according to regulations in Point a Clause 2 Article 25 of the Circular No. 32/2018/TT-BYT;

c) Regulatory bodies shall prioritize the drugs included in this list when processing applications for the marketing authorization according to regulations in Clause 1 Article 34 of the Circular No. 32/2018/TT-BYT;

d) Regulatory bodies shall issue the license to import drugs as per the law;

dd) Loss of drugs shall be reimbursed according to regulations on drug loss rate and reimbursement for loss of drugs in healthcare establishments.

2. List of drugs not readily available shall provide the basis for relevant regulatory bodies and organizations to comply with the regulations in Points c, d and dd Clause 1 of this Article.

Article 4. Rules of compilation of list of orphan drugs

List of orphan drugs is compiled based on the following:

1. Diagnosis and treatment guidelines and technical procedures promulgated by the Ministry of Health, World Health Organization (WHO), reference management regulatory bodies (including European Medicines Agency (EMA) and reference management regulatory bodies of the United States, Japan, United Kingdom, Switzerland and Australia) or reputable domestic, regional or international medical associations (including Vietnam National Heart Association; Asian-Pacific Hepato-Pancreato-Biliary Association and/of European-African Hepato-Pancreato-Biliary Association; American College of Rheumatology and European League Against Rheumatism; European Society of Cardiology; American Heart Association; American Diabetes Association; Endocrine Society and other reputable medical associations).

2. Lists of orphan drugs previously promulgated according to regulations from the Minister of Health.

3. Regulations on classification of rare diseases and orphan drugs and lists of orphan drugs from World Health Organization, reference management regulatory bodies and other relevant managing regulatory bodies.

Article 5. Criteria for orphan drug designation

1. A drug may be added to the list of drugs intended for prevention, diagnosis and treatment of rare diseases when it meets either of the following criteria:

a) The drug is intended for prevention, diagnosis and/or treatment of a rare disease according to regulations from the Minister of Health;

b) The drug is classified as an orphan drug and granted the marketing authorization for orphan drugs by a reference management regulatory body.

2. A drug to be added to the list of drugs not readily available shall be a drug the alternative of which is not readily available in Vietnam or which is proven significantly more beneficial in terms of quality, safety and/or efficiency than other alternatives available domestically and internationally. It must also satisfy one of the following requirements:

a) The drug is intended for the prevention, diagnosis and/or treatment of a disease which affects less than 0.05% of the general population and falls into one of the following categories: genetic diseases; congenital diseases; cancer; autoimmune diseases; infectious diseases; tropical infectious diseases and other diseases decided by the Minister of Health based on advice from an advisory council formed by the Minister of Health;

b) The drug is a vaccine, diagnostic drug or prophylactic drug that is estimated to be administered less than 8,000 times a year in Vietnam;

c) The drug is a radiopharmaceutical or tracer;

d) Profit generated from the drug cannot cover the costs of investment in and marketing of the drug to the Vietnamese market.

Article 6. Effect

1. This Circular takes effect from October 15, 2019.

2. Decision No. 37/2008/QD-BYT dated November 20, 2008 promulgating list of orphan drugs available on request (hereinafter referred to as “Decision No. 37/2008/QD-BYT”) is annulled from the date on which this Circular comes into force.

Article 7. Transitional clause

Reimbursement for drugs sustaining loss and included in the list of orphan drugs enclosed with the Decision No. 37/2008/QD-BYT but not in the list of orphan drugs enclosed with this Circular shall continue to be offered to healthcare establishments according to regulations on orphan drugs given that such drugs are procured before the effective date of this Circular.

Article 8. Terms of reference

In case the legislative documents and regulations referred to herein are amended or superseded, the new documents shall apply.

Article 9. Implementation

1. Based on rules of compilation of list of orphan drugs, criteria for orphan drug designation, and requests from the units mentioned in Clause 2 Article 10 of this Circular and other relevant organizations and individuals or conclusions from the advisory council for issuance of the marketing authorization for drugs and medicinal ingredients, the Drug Administration of Vietnam shall propose list of orphan drugs to be supplied or removed as appropriate to the realities, gather opinions from relevant regulatory bodies, organizations and units, healthcare establishments and enterprises, and request the Department of Legal Affairs to appraise the list before it is proposed to the Minister of Health, who will promulgate a decision amending the list of orphan drugs.

2. In case the Ministry of Health promulgates a decision amending the list of orphan drugs as prescribed in Clause 1 herein, reimbursement for loss of drugs no longer included in the amended list of orphan drugs shall continue to be offered to healthcare establishments according to regulations on orphan drugs given that such drugs are procured before the effective date of the decision amending the list of orphan drugs.

Article 10. Implementing responsibilities

1. Drug Administration of Vietnam shall take charge and cooperate with competent authorities in implementing this Circular and update the decision amending the list of orphan drugs on the websites of the Ministry of Health and Drug Administration of Vietnam no later than 03 days from the date on which the Minister of Health signs the decision.

2. Pharmaceutical establishments and healthcare establishments shall:

a) Comply with the regulations in this Circular;

b) Propose amendment to the list of orphan drugs as appropriate to the realities to ensure timely drug provision for disease prevention and treatment.

3. Head of Office of the Ministry of Health, Chief Inspector of the Ministry of Health, heads of affiliates of the Ministry of Health, heads of Departments of Health, heads of healthcare units of other Ministries and regulatory bodies, and relevant organizations and individuals shall implement this Circular.

During the implementation of this Circular, any difficulty arising should be promptly reported to the Drug Administration of Vietnam for consideration and/or resolution./.

QUY ĐỊNH VỀ DANH MỤC THUỐC HIẾM

Căn cứ Luật dược số 105/2016/QH13 ngày 06 tháng 4 năm 2016;

Căn cứ Nghị định số 75/2017/NĐ-CP ngày 20 tháng 6 năm 2017 của Chính phủ quy định chức năng nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Theo đề nghị của Cục trưởng Cục Quản lý Dược,

Bộ trưởng Bộ Y tế ban hành Thông tư quy định về Danh mục thuốc hiếm.

Điều 1. Phạm vi điều chỉnh

Thông tư này ban hành Danh mục thuốc hiếm, quy định mục đích ban hành, nguyên tắc xây dựng và tiêu chí lựa chọn thuốc vào Danh mục thuốc hiếm.

Điều 2. Danh mục thuốc hiếm

Danh mục thuốc hiếm được ban hành tại Phụ lục kèm theo Thông tư này bao gồm:

1. Danh mục thuốc để phòng, chẩn đoán, điều trị bệnh hiếm gặp.

2. Danh mục thuốc không sẵn có.

Điều 3. Mục đích ban hành Danh mục thuốc hiếm

1. Danh mục thuốc để phòng, chẩn đoán, điều trị bệnh hiếm gặp là cơ sở để:

a) Cơ quan nhà nước có thẩm quyền xem xét miễn, giảm dữ liệu lâm sàng, miễn một hoặc một số giai đoạn thử thuốc trên lâm sàng trước khi cấp phép lưu hành đối với thuốc theo quy định tại Khoản 3 Điều 18 Thông tư số 32/2018/TT-BYT ngày 12 tháng 11 năm 2018 của Bộ trưởng Bộ Y tế quy định việc đăng ký thuốc, nguyên liệu làm thuốc (sau đây gọi tắt là Thông tư số 32/2018/TT-BYT);

b) Cơ quan nhà nước có thẩm quyền xem xét dữ liệu nghiên cứu độ ổn định đối với thuốc theo quy định tại điểm a Khoản 2 Điều 25 Thông tư số 32/2018/TT-BYT ;

c) Cơ quan quản lý nhà nước ưu tiên trong trình tự, thủ tục trong đăng ký lưu hành thuốc theo quy định tại khoản 1 Điều 34 Thông tư số 32/2018/TT-BYT ;

d) Cơ quan quản lý nhà nước cấp phép nhập khẩu thuốc theo quy định của pháp luật;

đ) Thực hiện việc thanh toán chi phí hao hụt thuốc theo quy định về tỉ lệ hao hụt thuốc và việc thanh toán chi phí hao hụt thuốc tại cơ sở khám bệnh, chữa bệnh.

2. Danh mục thuốc không sẵn có là cơ sở để cơ quan, tổ chức có liên quan thực hiện quy định tại các điểm c, d và đ Khoản 1 Điều này.

Điều 4. Nguyên tắc xây dựng Danh mục thuốc hiếm

Danh mục thuốc hiếm được xây dựng dựa trên các nguyên tắc sau đây:

1. Căn cứ vào các hướng dẫn chẩn đoán và điều trị, các quy trình chuyên môn kỹ thuật do Bộ Y tế, Tổ chức Y tế thế giới (WHO), cơ quan quản lý tham chiếu (bao gồm: Cơ quan quản lý Dược phẩm Châu Âu (EMA), Mỹ, Nhật Bản, Anh, Thụy Sỹ, Úc) hoặc các Hiệp hội y khoa có uy tín trong nước, khu vực hoặc trên thế giới (bao gồm: Hội Tim mạch Việt Nam; Hiệp hội gan mật Châu Á, châu Âu; Hội Thấp khớp học Hoa Kỳ và Liên đoàn chống Thấp khớp Châu Âu; Hiệp hội Tim mạch Châu Âu; Hiệp hội Tim mạch Hoa Kỳ; Hiệp hội nội tiết, đái tháo đường Hoa Kỳ và các Hiệp hội y khoa uy tín khác) ban hành.

2. Rà soát, kế thừa danh mục thuốc hiếm đã được ban hành trước đây theo quy định của Bộ trưởng Bộ Y tế.

3. Tham khảo quy định về phân loại bệnh hiếm gặp, phân loại và danh mục thuốc hiếm của Tổ chức Y tế thế giới, cơ quan quản lý tham chiếu và các cơ quan quản lý khác có liên quan.

Điều 5. Tiêu chí lựa chọn thuốc vào Danh mục thuốc hiếm

1. Một thuốc được xem xét để lựa chọn vào Danh mục thuốc để phòng, chẩn đoán, điều trị bệnh hiếm gặp khi đáp ứng một trong các tiêu chí sau đây:

a) Thuốc để phòng, chẩn đoán, điều trị bệnh hiếm gặp theo quy định của Bộ trưởng Bộ Y tế;

b) Thuốc có chỉ định được phân loại và cấp phép lưu hành là thuốc hiếm bởi một trong các cơ quan quản lý tham chiếu.

2. Một thuốc được xem xét để lựa chọn vào Danh mục thuốc không sẵn có là thuốc mà trên thị trường Việt Nam chưa có sẵn các thuốc khác có khả năng thay thế hoặc thuốc có tài liệu chứng minh mang lại lợi ích đáng kể về mặt chất lượng, an toàn, hiệu quả so với các thuốc khác có khả năng thay thế trên thị trường trong nước và quốc tế và thuộc một trong các trường hợp sau đây:

a) Thuốc để phòng, chẩn đoán, điều trị các bệnh có tỷ lệ ca bệnh hiện lưu hành trong một quần thể ngay tại một thời điểm thấp không quá 0,05% dân số (Prevalence rate - tỷ lệ lưu hành) và thuộc một trong các trường hợp sau đây: Bệnh thuộc về gen; bệnh bẩm sinh; ung thư; tự miễn; truyền nhiễm; bệnh nhiễm trùng nhiệt đới và bệnh khác do Bộ trưởng Bộ Y tế quyết định theo tư vấn của Hội đồng chuyên môn do Bộ trưởng Bộ Y tế thành lập;

b) Vắc xin, thuốc chẩn đoán hoặc thuốc phòng bệnh có tỷ lệ sử dụng ước tính không quá 8.000 trường hợp mỗi năm tại Việt Nam;

c) Thuốc phóng xạ, chất đánh dấu;

d) Việc kinh doanh thuốc không tạo ra lợi nhuận đủ lớn để bù đắp chi phí đầu tư, tiếp thị thuốc tại thị trường Việt Nam.

Điều 6. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày 15 tháng 10 năm 2019.

2. Quyết định số 37/2008/QĐ-BYT ngày 20 tháng 11 năm 2008 về việc ban hành Danh mục thuốc hiếm theo yêu cầu điều trị (sau đây gọi tắt là Quyết định số 37/2008/QĐ-BYT) hết hiệu lực thi hành kể từ ngày Thông tư này có hiệu lực.

Điều 7. Điều khoản chuyển tiếp

Việc thanh toán chi phí hao hụt tại cơ sở khám bệnh, chữa bệnh đối với thuốc thuộc Danh mục thuốc hiếm ban hành theo Quyết định số 37/2008/QĐ-BYT nhưng không thuộc Danh mục thuốc hiếm ban hành kèm theo Thông tư này được tiếp tục áp dụng theo quy định đối với thuốc hiếm trong trường hợp thuốc đó đã được cơ sở khám bệnh, chữa bệnh nhập trước thời điểm Thông tư này có hiệu lực.

Điều 8. Điều Khoản tham chiếu

Trong trường hợp các văn bản quy phạm pháp luật và các quy định được viện dẫn trong Thông tư này có sự thay đổi, bổ sung hoặc được thay thế thì áp dụng theo văn bản quy phạm pháp luật mới.

Điều 9. Tổ chức thực hiện

1. Căn cứ nguyên tắc xây dựng, tiêu chí lựa chọn thuốc hiếm và trên cơ sở đề xuất của các đơn vị quy định tại Khoản 2 Điều 10 Thông tư này, của các tổ chức, cá nhân khác có liên quan hoặc trên cơ sở kết luận của Hội đồng tư vấn cấp giấy đăng ký lưu hành thuốc, nguyên liệu làm thuốc, Cục Quản lý Dược đề xuất danh mục các thuốc hiếm cần cập nhật bổ sung hoặc loại bỏ cho phù hợp tình hình thực tế, xin ý kiến rộng rãi các cơ quan, tổ chức, đơn vị liên quan, cơ sở khám bệnh, chữa bệnh, doanh nghiệp và đề nghị Vụ Pháp chế tổ chức thẩm định trước khi trình Bộ trưởng Bộ Y tế ban hành Quyết định sửa đổi, bổ sung Danh mục thuốc hiếm.

2. Trường hợp Bộ Y tế ban hành Quyết định sửa đổi, bổ sung Danh mục thuốc hiếm theo quy định tại Khoản 1 Điều này, việc thanh toán chi phí hao hụt tại cơ sở khám bệnh, chữa bệnh đối với thuốc thuộc Danh mục thuốc hiếm được ban hành liền kề trước đó nhưng không thuộc Danh mục thuốc hiếm sửa đổi, bổ sung được thực hiện theo quy định đối với thuốc hiếm trong trường hợp thuốc đó đã được cơ sở khám bệnh, chữa bệnh nhập trước thời điểm Quyết định sửa đổi, bổ sung Danh mục thuốc hiếm có hiệu lực.

Điều 10. Trách nhiệm thi hành

1. Cục Quản lý Dược có trách nhiệm chủ trì, phối hợp với các cơ quan chức năng thực hiện Thông tư này và cập nhật Quyết định sửa đổi, bổ sung Danh mục thuốc hiếm trên Cổng thông tin điện tử của Bộ Y tế và Trang thông tin điện tử của Cục Quản lý Dược trong thời hạn 03 ngày kể từ ngày Bộ trưởng Bộ Y tế ký quyết định.

2. Cơ sở dược, cơ sở khám bệnh, chữa bệnh có trách nhiệm:

a) Thực hiện các quy định tại Thông tư này;

b) Đề xuất sửa đổi, bổ sung Danh mục thuốc hiếm cho phù hợp tình hình thực tế, bảo đảm đáp ứng kịp thời thuốc phục vụ cho công tác phòng bệnh, chữa bệnh.

3. Chánh văn phòng Bộ, Chánh thanh tra Bộ, Vụ trưởng, Cục trưởng, Tổng cục trưởng thuộc Bộ Y tế, Thủ trưởng các cơ quan, đơn vị trực thuộc Bộ, Giám đốc Sở Y tế các tỉnh, thành phố trực thuộc Trung ương, Thủ trưởng cơ quan y tế các Bộ, ngành và các tổ chức, cá nhân liên quan chịu trách nhiệm thi hành Thông tư này.

Trong quá trình thực hiện nếu có vấn đề vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Cục Quản lý Dược để xem xét, giải quyết./.

Ghi chú:

1. Tên hoạt chất ghi trong các Bảng này: cùng một hoạt chất có thể có nhiều cách viết khác nhau (tên gốc, tên khoa học, tên chung quốc tế (INN)...). Các tên này có thể được dùng thay thế cho nhau.

2. Dạng tiêm ghi trong các Bảng này: bao gồm cả dạng truyền (nếu có).

3. Đối với thuốc thuộc Danh mục thuốc để phòng, chuẩn đoán, điều trị bệnh hiếm gặp: Chỉ định được phê duyệt khi đăng ký lưu hành hoặc cấp phép nhập khẩu thuốc chưa có giấy đăng ký lưu hành có thể là chỉ định được ghi cụ thể hơn hoặc giới hạn lại hơn so với cách ghi chỉ định trong cột “Chỉ định phòng, chẩn đoán, điều trị bệnh hiếm gặp” trong Bảng tại Mục I Phụ lục này.

4. Danh mục này bao gồm cả:

a) Các muối của các chất ghi trong các Bảng này, khi các muối đó có thể hình thành và tồn tại;

b) Các thuốc phóng xạ là đồng vị phóng xạ nêu trong Bảng này đươc gắn kết với các chất đánh dấu khác nhau./.
