Căn cứ Nghị định số 117/2007/NĐ-CP ngày 11 tháng 7 năm 2007 của Chính phủ về sản xuất, cung cấp và tiêu thụ nước sạch; Nghị định số 124/2011/NĐ-CP ngày 28 tháng 12 năm 2011 của Chính phủ về việc sửa đổi, bổ sung một số điều Nghị định số 117/2007/NĐ-CP ngày 11 tháng 7 năm 2007 của Chính phủ về sản xuất, cung cấp và tiêu thụ nước sạch;
Căn cứ Nghị định số 75/2017/NĐ-CP ngày 20 tháng 6 năm 2017 quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;
Xét đề nghị của Cục trưởng Cục Quản lý môi trường y tế;
Bộ trưởng Bộ Y tế ban hành Thông tư ban hành Quy chuẩn kỹ thuật quốc gia và quy định kiểm tra, giám sát chất lượng nước sạch sử dụng cho mục đích sinh hoạt.
Ban hành kèm theo Thông tư này Quy chuẩn kỹ thuật quốc gia về chất lượng nước sạch sử dụng cho mục đích sinh hoạt.
Điều 2. Quy định về kiểm tra, giám sát chất lượng nước sạch sử dụng cho mục đích sinh hoạt
1. Kết quả thử nghiệm các thông số chất lượng nước sạch quy định tại Khoản 2 và 3 Điều 5 của Quy chuẩn ban hành kèm theo Thông tư này phải được đơn vị cấp nước công khai trong thời hạn 3 ngày kể từ ngày có kết quả trên trang thông tin điện tử của đơn vị cấp nước (trường hợp không có trang thông tin điện tử, đơn vị cấp nước phải dán thông báo trước cổng trụ sở) các nội dung sau:
a) Tổng số mẫu nước thử nghiệm và các vị trí lấy mẫu.
b) Các thông số và kết quả thử nghiệm cụ thể của từng mẫu nước.
c) Biện pháp và thời gian khắc phục các thông số không đạt Quy chuẩn.
2. Cơ quan nhà nước có thẩm quyền phải kiểm tra (ngoại kiểm) việc thực hiện các quy định về đảm bảo chất lượng nước sạch của đơn vị cấp nước như sau:
a) Kiểm tra việc thực hiện thử nghiệm các thông số chất lượng nước sạch của đơn vị cấp nước quy định tại Khoản 2 và 3 Điều 5 của Quy chuẩn ban hành kèm theo Thông tư này; hồ sơ theo dõi, quản lý chất lượng nước sạch; công khai thông tin chất lượng nước sạch quy định tại Khoản 1 Điều 2 Thông tư này.
b) Lấy mẫu và thử nghiệm các thông số chất lượng nước sạch quy định tại Khoản 2 và 3 Điều 5 của Quy chuẩn ban hành kèm theo Thông tư này.
c) Trong thời hạn 5 ngày kể từ ngày có kết quả ngoại kiểm chất lượng nước sạch, cơ quan thực hiện ngoại kiểm thông báo bằng văn bản cho đơn vị cấp nước được ngoại kiểm; công khai trên trang thông tin điện tử của cơ quan thực hiện ngoại kiểm; thông báo cho đơn vị có thẩm quyền lựa chọn đơn vị cấp nước và cơ quan chủ quản đơn vị cấp nước đã được ngoại kiểm (nếu có) về kết quả ngoại kiểm gồm các thông tin sau đây:
- Tên đơn vị được kiểm tra.
- Kết quả kiểm tra các nội dung quy định tại Khoản 1 Điều 2 của Thông tư này.
3. Tần suất thực hiện ngoại kiểm chất lượng nước sạch
a) Mỗi đơn vị cấp nước phải được ngoại kiểm định kỳ 01 lần/01 năm.
b) Ngoại kiểm đột xuất được thực hiện trong các trường hợp sau:
- Khi có nghi ngờ về chất lượng nước thành phẩm qua theo dõi báo cáo tình hình chất lượng nước định kỳ, đột xuất của đơn vị cấp nước.
- Khi xảy ra sự cố môi trường có thể ảnh hưởng đến chất lượng nguồn nước.
- Khi kết quả kiểm tra chất lượng nước hoặc điều tra dịch tễ cho thấy nguồn nước có nguy cơ bị ô nhiễm.
- Khi có các phản ánh của cơ quan, tổ chức, cá nhân về chất lượng nước.
- Khi có các yêu cầu đặc biệt khác của cơ quan có thẩm quyền.
1. Thông tư này có hiệu lực từ ngày 15/6/2019.
2. Thông tư số 50/2015/TT-BYT ngày 11/12/2015 của Bộ trưởng Bộ Y tế quy định việc kiểm tra vệ sinh, chất lượng nước ăn uống, nước sinh hoạt hết hiệu lực kể từ ngày Thông tư này có hiệu lực.
3. Thông tư số 04/2009/TT-BYT ngày 17/6/2009 của Bộ trưởng Bộ Y tế về việc ban hành Quy chuẩn kỹ thuật quốc gia về chất lượng nước ăn uống (QCVN 01:2009/BYT); Thông tư số 05/2009/TT-BYT ngày 17/6/2009 của Bộ trưởng Bộ Y tế về việc ban hành Quy chuẩn kỹ thuật quốc gia về chất lượng nước sinh hoạt (QCVN 02:2009/BYT) tiếp tục có hiệu lực để áp dụng cho các đối tượng quy định tại Khoản 2 Điều 4 Thông tư này đến hết ngày 30/6/2021 khi Quy chuẩn kỹ thuật địa phương về chất lượng nước sạch sử dụng cho mục đích sinh hoạt được ban hành và có hiệu lực.
Điều 4. Điều khoản chuyển tiếp
Đối với các tỉnh, thành phố trực thuộc Trung ương chưa ban hành Quy chuẩn kỹ thuật địa phương về chất lượng nước sạch sử dụng cho mục đích sinh hoạt trong thời hạn quy định tại Khoản 3 Điều 3 Thông tư này, đơn vị cấp nước có thể áp dụng một trong hai trường hợp sau:
1. Áp dụng Quy chuẩn kỹ thuật quốc gia về chất lượng nước sạch sử dụng cho mục đích sinh hoạt ban hành kèm theo Thông tư này nhưng phải thử nghiệm toàn bộ các thông số chất lượng nước sạch trong danh mục quy định tại Điều 4 của Quy chuẩn.
2. Tiếp tục áp dụng Quy chuẩn kỹ thuật quốc gia về chất lượng nước ăn uống (QCVN 01:2009/BYT), Quy chuẩn kỹ thuật quốc gia về chất lượng nước sinh hoạt (QCVN 02:2009/BYT) cho đến hết ngày 30/6/2021.
1. Cục Quản lý môi trường y tế - Bộ Y tế có trách nhiệm phổ biến, hướng dẫn, kiểm tra việc thực hiện Thông tư này trên phạm vi toàn quốc.
2. Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương có trách nhiệm:
a) Tổ chức và kiểm tra việc thực hiện Thông tư này tại địa phương.
c) Bố trí ngân sách và chỉ đạo công tác kiểm tra, giám sát chất lượng nước sạch đột xuất hoặc định kỳ hằng năm; đầu tư nâng cấp trang thiết bị phòng thử nghiệm cho Trung tâm Y tế dự phòng/Trung tâm Kiểm soát bệnh tật tỉnh (Trung tâm kiểm soát bệnh tật tỉnh) để có đủ khả năng thực hiện thử nghiệm các thông số chất lượng nước sạch theo quy định của Thông tư này.
3. Các Viện chuyên ngành thuộc Bộ Y tế có trách nhiệm:
a) Tổng hợp, phân tích và báo cáo tình hình chất lượng nước sạch của các tỉnh trong địa bàn phụ trách và có kế hoạch đào tạo tập huấn, hỗ trợ về chuyên môn, kỹ thuật cho các địa phương trong việc thực hiện Quy chuẩn;
b) Thực hiện ngoại kiểm chất lượng nước sạch khi có yêu cầu của Bộ Y tế; báo cáo kết quả ngoại kiểm theo Mẫu số 01 của phụ lục ban hành kèm theo Thông tư này;
c) Hỗ trợ kỹ thuật cho các tỉnh, thành phố trong địa bàn phụ trách xây dựng Quy chuẩn kỹ thuật địa phương về chất lượng nước sạch;
d) Báo cáo bằng văn bản định kỳ 6 tháng, hằng năm cho Cục Quản lý môi trường y tế trong thời hạn 15 ngày kể từ ngày cuối cùng của tháng 6 và tháng 12; báo cáo theo Mẫu số 02 của phụ lục ban hành kèm theo Thông tư này.
4. Sở Y tế tỉnh, thành phố trực thuộc Trung ương có trách nhiệm:
a) Chủ trì, phối hợp với các đơn vị liên quan triển khai việc thực hiện Thông tư này trên địa bàn phụ trách;
b) Chỉ đạo các đơn vị trực thuộc thực hiện việc phổ biến, hướng dẫn, kiểm tra, giám sát chất lượng nước sạch sử dụng cho mục đích sinh hoạt theo Thông tư này trên địa bàn phụ trách;
c) Tiếp nhận bản công bố hợp quy của đơn vị cấp nước trên địa bàn phụ trách;
d) Xây dựng kế hoạch, bảo đảm nhân lực, trang thiết bị và bố trí kinh phí (trong ngân sách hằng năm) cho việc thực hiện kiểm tra, giám sát chất lượng nước sạch trên địa bàn tỉnh, thành phố; kiểm tra, giám sát chất lượng nước do hộ gia đình tự khai thác ở vùng có nguy cơ ô nhiễm nguồn nước để có biện pháp đảm bảo sức khỏe người dân.
5. Trung tâm Kiểm soát bệnh tật tỉnh có trách nhiệm:
a) Thực hiện ngoại kiểm định kỳ, đột xuất chất lượng nước sạch của tất cả các đơn vị cấp nước có quy mô từ 500 hộ gia đình trở lên (hoặc công suất thiết kế từ 1.000m3/ngày đêm trở lên trong trường hợp không xác định được số hộ gia đình); báo cáo kết quả ngoại kiểm theo Mẫu số 01 của phụ lục ban hành kèm theo Thông tư này;
b) Phối hợp với các Trung tâm Y tế huyện thực hiện ngoại kiểm định kỳ, đột xuất chất lượng nước của các đơn vị cấp nước có quy mô dưới 500 hộ gia đình (hoặc công suất thiết kế dưới 1.000m3/ngày đêm trong trường hợp không xác định được số hộ gia đình);
c) Xây dựng kế hoạch, dự toán kinh phí hằng năm cho việc tổ chức thực hiện hoạt động kiểm tra chất lượng nước sạch;
d) Báo cáo bằng văn bản định kỳ 6 tháng, hằng năm cho Sở Y tế tỉnh, thành phố trực thuộc Trung ương, Viện chuyên ngành thuộc Bộ Y tế và Cục Quản lý môi trường y tế - Bộ Y tế trong thời hạn 10 ngày kể từ ngày cuối cùng của tháng 6 và tháng 12; báo cáo theo Mẫu số 03 của phụ lục ban hành kèm theo Thông tư này.
6. Trung tâm Y tế huyện có trách nhiệm:
a) Thực hiện ngoại kiểm định kỳ, đột xuất chất lượng nước sạch của tất cả các đơn vị cấp nước có quy mô dưới 500 hộ gia đình (hoặc công suất thiết kế dưới 1.000m3/ngày đêm trong trường hợp không xác định được số hộ gia đình). Báo cáo kết quả ngoại kiểm theo Mẫu số 01 của phụ lục ban hành kèm theo Thông tư này;
b) Xây dựng kế hoạch, dự toán kinh phí hằng năm cho việc tổ chức thực hiện các hoạt động kiểm tra chất lượng nước sạch trình cấp có thẩm quyền phê duyệt;
c) Báo cáo bằng văn bản định kỳ hằng quý, 6 tháng và hằng năm cho Trung tâm Kiểm soát bệnh tật tỉnh trong thời hạn 5 ngày kể từ ngày cuối cùng của tháng 3, tháng 6, tháng 9 và tháng 12. Nội dung báo cáo theo Mẫu số 04 của phụ lục ban hành kèm theo Thông tư này.
7. Đơn vị cấp nước có trách nhiệm:
a) Thực hiện các quy định của Thông tư này.
b) Chịu trách nhiệm trước pháp luật về chất lượng nước sạch do đơn vị cung cấp.
c) Lưu trữ và quản lý hồ sơ theo dõi về chất lượng nước sạch:
- Quy chuẩn kỹ thuật địa phương về chất lượng nước sạch sử dụng cho mục đích sinh hoạt do Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương ban hành.
- Các kết quả thử nghiệm chất lượng nước nguyên liệu định kỳ, đột xuất.
- Các kết quả thử nghiệm thông số chất lượng nước sạch định kỳ, đột xuất.
- Các hồ sơ về hóa chất sử dụng trong quá trình sản xuất nước sạch.
- Sổ theo dõi việc lưu mẫu nước (mỗi lần lấy mẫu ghi cụ thể số lượng mẫu lưu; vị trí lấy mẫu; thể tích mẫu; phương pháp bảo quản mẫu; thời gian lấy và lưu mẫu; người lấy mẫu lưu).
- Báo cáo biện pháp khắc phục các sự cố liên quan đến chất lượng nước sạch.
- Công khai thông tin về chất lượng nước sạch.
- Các tài liệu chứng minh việc thực hiện kế hoạch cấp nước an toàn theo quy định.
d) Chịu sự thanh tra, kiểm tra, giám sát của các cơ quan nhà nước có thẩm quyền;
đ) Đề xuất các thông số chất lượng nước sạch để xây dựng Quy chuẩn kỹ thuật địa phương về chất lượng nước sạch sử dụng cho mục đích sinh hoạt;
e) Báo cáo kết quả thử nghiệm chất lượng nước sạch hằng quý cho Trung tâm y tế huyện, Trung tâm Kiểm soát bệnh tật tỉnh theo Mẫu số 05, Mẫu số 06 của phụ lục ban hành kèm theo Thông tư này.
8. Các ông bà Chánh Văn phòng Bộ, Cục trưởng Cục Khoa học Công nghệ và Đào tạo, Cục trưởng Cục Quản lý môi trường y tế, Vụ trưởng Vụ Pháp chế, các Vụ, Cục có liên quan, Thủ trưởng các đơn vị trực thuộc Bộ Y tế, Giám đốc Sở Y tế các tỉnh, thành phố trực thuộc Trung ương và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.
Trong quá trình thực hiện nếu có khó khăn, vướng mắc đề nghị các cơ quan, tổ chức, cá nhân phản ánh về Bộ Y tế để xem xét, giải quyết./.

Quy chuẩn kỹ thuật quốc gia về chất lượng nước sạch sử dụng cho mục đích sinh hoạt QCVN 01-1:2018/BYT do Cục Quản lý môi trường y tế biên soạn, Vụ Pháp chế trình duyệt, Bộ Khoa học và Công nghệ thẩm định, Bộ Y tế ban hành kèm theo Thông tư số 41/2018/TT-BYT ngày 14 tháng 12 năm 2018.
Quy chuẩn kỹ thuật quốc gia QCVN 01-1:2018/BYT thay thế Quy chuẩn kỹ thuật quốc gia về chất lượng nước ăn uống QCVN 01:2009/BYT và Quy chuẩn kỹ thuật quốc gia về chất lượng nước sinh hoạt QCVN 02:2009/BYT được ban hành lần lượt theo Thông tư số 04/2009/TT-BYT và Thông tư số 05/2009/TT-BYT ngày 17/6/2009 của Bộ trưởng Bộ Y tế.
QUY CHUẨN KỸ THUẬT QUỐC GIA
VỀ CHẤT LƯỢNG NƯỚC SẠCH SỬ DỤNG CHO MỤC ĐÍCH SINH HOẠT
Quy chuẩn này quy định mức giới hạn các thông số chất lượng đối với nước sạch sử dụng cho mục đích sinh hoạt.
1. Quy chuẩn này áp dụng đối với tổ chức, cá nhân thực hiện một phần hoặc tất cả các hoạt động khai thác, sản xuất, truyền dẫn, bán buôn, bán lẻ nước sạch theo hệ thống cấp nước tập trung hoàn chỉnh (sau đây gọi tắt là đơn vị cấp nước); các cơ quan quản lý nhà nước về thanh tra, kiểm tra, giám sát chất lượng nước sạch; các phòng thử nghiệm và tổ chức chứng nhận các thông số chất lượng nước.
2. Quy chuẩn này không áp dụng đối với nước uống trực tiếp tại vòi, nước đóng bình, đóng chai, nước khoáng thiên nhiên đóng bình, đóng chai, nước sản xuất ra từ các bình lọc nước, hệ thống lọc nước và các loại nước không dùng cho mục đích sinh hoạt.
Trong quy chuẩn này, các từ ngữ dưới đây được hiểu như sau:
1. Nước sạch sử dụng cho mục đích sinh hoạt là nước đã qua xử lý có chất lượng bảo đảm, đáp ứng yêu cầu sử dụng cho mục đích ăn uống, vệ sinh của con người (viết tắt là nước sạch).
2. Thông số cảm quan là những yếu tố về màu sắc, mùi vị có thể cảm nhận được bằng các giác quan của con người.
3. AOAC là chữ viết tắt của cụm từ tiếng Anh “Association of Official Analytical Chemists” có nghĩa là Hiệp hội các nhà hóa phân tích chính thống.
4. CFU là chữ viết tắt của cụm từ tiếng Anh “Colony Forming Unit” có nghĩa là đơn vị hình thành khuẩn lạc.
5. FCR là chữ viết tắt của cụm từ tiếng Anh “Free Chlorine Residual” có nghĩa là clo dư tự do.
6. NTU là chữ viết tắt của cụm từ tiếng Anh “Nephelometric Turbidity Unit” có nghĩa là đơn vị đo độ đục.
7. SMEWW là chữ viết tắt của cụm từ tiếng Anh “Standard Methods for the Examination of Water and Waste Water” có nghĩa là các phương pháp chuẩn thử nghiệm nước và nước thải.
8. TCU là chữ viết tắt của cụm từ tiếng Anh “True Color Unit” có nghĩa là đơn vị đo màu sắc.

CIRCULAR
PROMULGATING NATIONAL TECHNICAL REGULATION AND REGULATIONS ON INSPECTION AND MONITORING OF DOMESTIC WATER QUALITY
Pursuant to the Government’s Decree No. 117/2007/ND-CP dated July 11, 2007 on clean water production, supply and consumption; Government's Decree No. 124/2011/ND-CP dated December 28, 2011 on amendments to some Articles of the Government’s Decree No. 117/2007/ND-CP dated July 11, 2007 on clean water production, supply and consumption;
Pursuant to the Decree No. 75/2017/ND-CP dated June 20, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Health;
At the request of the Director of the Health Environment Management Agency;
The Minister of Health hereby promulgates a Circular on national technical regulation and regulations on inspection and monitoring of domestic water quality.
Article 1. Promulgation of Regulation
The National technical regulation on domestic water quality is promulgated together with this Circular;
Article 2. Regulations on inspection and monitoring of domestic water quality
1. The results of testing of domestic water quality parameters specified Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular shall be made publicly available by the water supplier within 3 days from the date on which results are available on its website (if a website is not available, the water supplier shall be posted at its office. To be specific:
a) Total number of water samples and sampling locations.
b) Parameters and results of testing of each water sample.
c) Remedial measures taken if any parameter fails the Regulation, and time limit for implementation thereof.
2. The competent authority shall carry out an external inspection of implementation of regulations on assurance of domestic water quality by every water supplier as follows:
a) Inspect the testing of domestic water quality parameters specified Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular; documents about monitoring and management of domestic water quality; publishing of information about domestic water quality according to Clause 1 Article 2 of this Circular;
b) Collect samples and test domestic quality parameters specified in Clauses 2 and 3 Article 5 of the Regulation promulgated together with this Circular.
c) Within 5 days from the date on which results of external inspection of domestic water quality are obtained, the external inspecting authority shall notify the inspected water supplier in writing thereof; publish the results on its website; notify the following information to the unit selecting the water supplier and supervisory authority of the inspected water supplier (if any):
- Name of the inspected water supplier.
- Results of inspection of contents specified in Clause 1 Article 2 of this Circular.
3. External inspection frequency:
a) Each water supplier shall undergo an external inspection once a year.
b) An unscheduled external inspection shall be conducted when:
- the water supplier’s periodic and ad hoc reports on water quality give rise to suspicions about finished water quality.
- there is an environmental emergency that may affect water quality.
- results of the water quality inspection or epidemiological investigation show that the water source is potentially polluted.
- any organization or individual complains about water quality.
- it is requested by a competent authority.
Article 3. Effect
1. This Circular comes into force from June 15, 2019.
2. The Circular No. 50/2015/TT-BYT dated December 11, 2015 of the Minister of Health is null and void from the effective date of this Circular.
3. The Circular No. 04/2009/TT-BYT and Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health shall remain effective to apply to the entities specified in Clause 2 Article 4 of this Circular until June 30, 2021 when a local technical regulation on domestic water quality is promulgated and comes into force.
Article 4. Transitional clauses
Regarding provinces and central-affiliated cities that have not yet promulgated a local technical regulation on domestic water quality within the time limit specified in Clause 3 Article 3 of this Circular, every water supplier may:
1. apply National technical regulation on domestic water quality promulgated together with this Circular but is required to test all domestic water quality parameters on the list specified in Article 4 of the Regulation; or
2. Continue to apply the National technical regulation on drinking water quality (QCVN 01:2009/BYT) and National technical regulation on domestic water quality (QCVN 02:2009/BYT) until June 30, 2021.
Article 5. Responsibility for implementation
1. The Health Environment Management Agency affiliated to the Ministry of Health shall disseminate, provide guidance and inspect the implementation of this Circular nationwide.
2. People’s Committees of provinces and central-affiliated cities shall:
a) organize and inspect the implementation of this Circular within provinces and cities.
b) promulgate a local technical regulation on domestic water quality, which comes into force before July 01, 2021.
c) allocate budget for and direct the unscheduled or periodic inspection and monitoring of domestic water quality; investment in and upgrading of laboratory equipment in relevant preventive health centers/ centers for disease control of provinces (Centers for disease control of provinces) to enable them to test domestic water quality parameters in accordance with regulations of this Circular.
3. Specialized institutes affiliated to the Ministry of Health shall:
a) carry out reviews, analyze and report domestic water quality within provinces under their management and formulate a plan to provide training and technical and professional assistance to local authorities in the implementation of the Regulation.
b) conduct external inspections of domestic water quality at the request of the Ministry of Health; prepare external inspection reports using the Form No. 01 in the Appendix hereof.
c) provide technical assistance to provinces and cities under their management for the purpose of making local technical regulation on domestic water quality.
d) submit mid-year and annual reports to the Health Environment Management Agency within 15 days from the ending dates of June and December; prepare reports using the Form No. 02 in the Appendix hereof.
4. Departments of Health of provinces and central-affiliated cities shall:
a) take charge and cooperate with relevant units in implementing this Circular within provinces and cities.
b) direct their affiliates to disseminate and provide guidance for implementation of this Circular, inspect and monitor domestic water quality as prescribed in this Circular within provinces and cities.
c) receive declarations of conformity submitted by water suppliers within provinces and cities.
d) prepare a plan and provide human resources, equipment and funding (provided by annual budget) for inspection and monitoring of domestic water quality within provinces and cities; inspect and monitor quality of water extracted by households themselves in areas prone to water pollution so as to take measures to ensure people’s health.
5. Centers for disease control of provinces shall:
a) conduct periodic and unscheduled external inspections of quality of water from all water suppliers that serve 500 households or more (or have a design capacity of at least 1,000 m3/ 24 hours in case of failure to determine the number of households); prepare external inspection reports using the Form No. 01 in the Appendix hereof.
b) cooperate with health centers of districts in conducting periodic and unscheduled external inspections of quality of water from all water suppliers that serve fewer than 500 households (or have a design capacity of less than 1,000 m3/ 24 hours in case of failure to determine the number of households);
c) make an annual plan and estimate of funding for organizing inspections of domestic water quality.
d) submit mid-year and annual reports to the Departments of Health of provinces and central-affiliated cities, specialized institutes affiliated to the Ministry of Health and Health Environment Management Agency affiliated to the Ministry of Health within 10 days from the ending dates of June and December; prepare reports using the Form No. 03 in the Appendix hereof.
6. Health centers for districts shall:
a) conduct periodic and unscheduled external inspections of quality of water from all water suppliers that serve fewer than 500 households (or have a design capacity of 1,000 m3/ 24 hours in case of failure to determine the number of households); prepare external inspection reports using the Form No. 01 in the Appendix hereof.
b) make an annual plan and estimate of funding for organizing inspections of domestic water quality, and submit them to a competent authority for approval.
c) submit quarterly, mid-year and annual reports to the Health Environment Management Agency within 5 days from the ending dates of March, June, September and December; prepare reports using the Form No. 04 in the Appendix hereof.
7. Water suppliers shall:
a) implement regulations of this Circular.
b) be responsible to the law for quality of domestic water they provide.
c) archive and manage domestic water quality monitoring documentation:
- Local technical regulations on domestic water quality, which are promulgated by People’s Committees of provinces and central-affiliated cities.
- Results of periodic and unscheduled testing of raw water quality.
- Results of periodic and unscheduled testing of domestic water quality parameters.
- Records on chemicals used during the process of producing domestic water.
- Water sampling logbooks (upon each sampling, specify the number of samples; sampling location; volume of samples; method for storing samples; time of sample collection and storage; sample collector).
- Report on remedial measures against emergencies related to domestic water quality.
- Information about domestic water quality.
- Documentary evidences for implementation of the water safety plan.
d) be subject to inspections and supervision by competent authorities.
dd) propose domestic water parameters in order to make local technical regulations on domestic water quality.
e) submit quarterly domestic water testing reports to health centers of districts and centers for disease control of provinces according to the Forms No. 05 and 06 in the Appendix hereof.
8. The Chief of the Ministry Office, Director of Administration of Science Technology and Training, Director of Health Environment Management Agency, Director of Department of Legal Affairs, relevant departments, heads of affiliates of the Ministry of Health, Directors of Departments of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health for consideration./.

Foreword
The National technical regulation on domestic water quality QCVN 01-1:2018/BYT is prepared by the Health Environment Management Agency, presented by the Department of Legal Affairs, appraised by the Ministry of Science and Technology and promulgated together with the Circular No. 41/2018/TT-BYT dated December 14, 2018 by the Ministry of Health.
The National technical regulation on drinking water quality QCVN 01-1:2018/BYT supersedes the National technical regulation on drinking water quality QCVN 01-1:2009/BYT and National technical regulation on domestic water quality QCVN 02:20Q9/BYT which are promulgated together with the Circular No. 04/2009/TT-BYT and Circular No. 05/2009/TT-BYT dated June 17, 2009 of the Minister of Health respectively.
NATIONAL TECHNICAL REGULATION
ON DOMESTIC WATER QUALITY
Chapter I
GENERAL
Article 1. Scope
This Regulation provides for permissible limits of domestic water quality parameters.
Article 2. Regulated entities
1. This Regulation applies to organizations and individuals partially or totally involved in extraction, production, transmission, wholesale and retail of domestic water according to a complete centralized system (hereinafter referred to as “water suppliers”); domestic water quality inspecting and monitoring authorities; testing laboratories and bodies certifying domestic water quality parameters.
2. This Regulation does not apply to tap water, bottled drinking water, bottled natural mineral water, water produced by water purifiers, water purification system and non-domestic water.
Article 3. Definitions
For the purposes of this Regulation, the terms below shall be construed as follows:
1. “domestic water” refers to water that has undergone treatment and satisfies given requirements of quality to serve human consumption and sanitation purposes.
2. “organoleptic parameters” refer to factors, including color and taste that can be experienced via human senses.
3. “AOAC” stands for Association of Official Analytical Chemists.
4. “CFU” stands for Colony Forming Unit.
5. “FCR” stands for Free Chlorine Residual.
6. “NTU” stands for Nephelometric Turbidity Unit.
7. “SMEWW” stands for Standard Methods for the Examination of Water and Waste Water.
8. “TCU” stands for True Color Unit.
9. “US EPA” stands for United States Environmental Protection Agency.

- Both Nitrite and Nitrate can form methemoglobin. Therefore, if the two substances are present in domestic water, total concentration (C) of each substance compared to its maximum limit (ML) must not exceed 1 and be calculated according to the following formula:

Article 5. Testing of domestic water quality parameters
1. All domestic water quality parameters shall be tested at laboratories or certification bodies that have been accredited according to TCVN ISO/IEC 17025 and registered its their testing services as prescribed in the Government's Decree No. 107/2016/ND-CP dated July 01, 2016.
2. Group A parameters shall be tested by all water suppliers.
3. Group B parameters shall be tested in accordance with local technical regulations promulgated by People’s Committees of provinces and central-affiliated cities on the basis of parameters selected to suit local current conditions.
4. Water suppliers shall test all Group A and B parameters on the List of domestic water quality parameters specified in Article 4 of this Regulation in the following cases:
a) Before they are put into operation for the first time.
b) After they undergo a major upgrade or repair that affects the production system.
c) There is an environmental emergency that may affect water quality.
d) Risks incurred during production process may affect water quality or testing is requested by a competent authority.
dd) The testing is conducted every 03 years from the latest testing of all parameters.
5. Periodic testing:
a) Periodic testing of group A parameters shall be conducted at least once a month.
b) Periodic testing of group B parameters shall be conducted at least every 6 months.
c) Depending on local current conditions, People’s Committees of provinces and central-affiliated cities shall define a testing frequency that is higher than that specified in Points a and b of this Clause.
Article 6. Number of samples and sampling locations
1. The number of samples needed for each testing:
a) Regarding water suppliers that serve fewer than 100,000 people: take at least 03 domestic water samples.
b) Regarding water suppliers that serve at least 100,000 people: take at least 04 domestic water samples and one additional sample for every 100,000 people served.
2. Sampling locations: 01 sample taken from the water supplier’s tank containing water that has been treated before being put into a water distribution system, 01 sample taken from a random tap at the end of a water distribution system, the others taken from a random tap in a water distribution system (including water distribution vehicles, such as tankers or water-carrying boats).
3. Regarding authorities, units, apartments, collective living quarters, hospitals, schools, enterprises and areas that have shared water tanks: take at least 02 samples, one from the shared water tank and 01 from a random tap. If there are 02 shared water tanks or more, take at least 01 sample from each tank and 01 sample from a random tap.
4. In the event of any risk of water source pollution or diseases, increase the number of water samples taken at different sampling locations.

Chapter III
MANAGEMENT REGULATIONS
Article 8. Declaration of conformity
Every water producer shall assess its conformity itself as prescribed in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 and Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Minister of Science and Technology.
Every water producer shall assess its conformity according to the method set forth in Point a Clause 1 Article 5 of the Circular No. 28/2012/TT-BKHCN and submit the declaration of conformity to the Department of Health of the province or central-affiliated city where it is located according to the Form in the Appendix 02 hereof.
Chapter IV
IMPLEMENTATION
Article 9. Responsibility for implementation
The Health Environment Management Agency shall take charge and cooperate with relevant authorities in providing guidelines and organizing implementation of this Regulation and recommend the Ministry of Health to make amendments thereto in accordance with management regulations.
Article 10. Transitional clause
In the cases where any of the regulations on testing methods in the National regulation and legislative documents referred to in this Regulation is amended or replaced, the newest one shall apply.
