Resolution 20/NQ-CP in 2020 on the application of export licensing regime for medical masks in the period of COVID-19 prevention and control issued by the Government

RESOLUTION

LICENSING EXPORT OF MEDICAL FACEMASKS AMID EFFORT TO PREVENT AND CONTROL COVID-19 INFECTION

THE GOVERNMENT

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Law on Foreign Trade Management 2017;

Pursuant to the Government's Decree No. 138/2016/ND-CP dated October 01, 2016 on working regulations of the Government;

Pursuant to the Government's Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some Articles of the Law on Foreign Trade Management;

Pursuant to the Government's Decree No. 36/2016/ND-CP dated May 15, 2016 on medical device management; the Government's Decree No. 169/2018/ND-CP amending Decree No. 36/2016/ND-CP;

At the request of the Minister of Health,

RESOVLES:

1. During the effort to prevent and control COVID-19 infection the Ministry of Health will only license export of medical facemasks as international aid or assistance from the Government of Vietnam. Up to 25% of production may be exported; 75% of production shall be used for epidemic control within the country). This does not apply to export of export processing enterprises that have been granted the certificate of investment registration and enterprises processing medical facemasks under processing contracts with foreign traders concluded before March 01, 2020.

2. The Ministry of Health shall take charge and cooperate with the Ministry of Industry and Trade and the Ministry of Finance in specifying documentation and procedures for licensing export of medical facemasks amid effort to control COVID-19 infection as prescribed in Clause 1 of this Resolution, and provide guidelines for medical facemasks standards.

3. The General Department of Customs (the Ministry of Finance) shall cooperate in supervising export of medical facemasks.

4. Manufacturers shall submit reports on their production capacity at the request of the Ministry of Health./.
