DECISION
ON RESPONSIBILITY FOR COMPLETION OF PROCEDURES FOR DEPARTURE, ARRIVAL AND TRANSIT OF AIRCRAFT THROUGH NATIONAL SINGLE-WINDOW SYSTEM
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Customs dated June 23, 2014;
Pursuant to the Law on Vietnam Civil Aviation dated June 29, 2006 and the Law on amendments to some articles of the Law on Vietnam Civil Aviation dated November 21, 2014;
Pursuant to the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam dated June 16, 2014;
Pursuant to the Law on E-transactions dated November 29, 2005;
Pursuant to the Government’s Decree No. 08/2015/ND-CP dated January 21, 2015 elaborating and implementing the Law on Customs on customs procedure, customs inspection, supervision and control;
Pursuant to the Government's Decree No. 27/2011/ND-CP dated April 09, 2011 on provision, operation, processing and utilization of information about passengers before entering Vietnam by air;
Pursuant to the Government’s Decree No. 102/2015/ND-CP dated October 20, 2015 on management and operation of airports and airfields;
Pursuant to the Government’s Decree No. 103/2010/ND-CP dated January 21, 2015 providing guidelines for some articles of the Law on prevention and control of infectious diseases concerning border health quarantine;
Pursuant to the Government’s Decree No. 136/2007/ND-CP dated August 17, 2007 on exit and entry of Vietnamese citizens;
Pursuant to the Government’s Decree No. 94/2015/ND-CP dated October 16, 2015 on amendments to some articles of the Government’s Decree dated August 17, 2007 on exit and entry of Vietnamese citizens;
In order to implement the Agreement and Protocol on the construction and implementation of ASEAN single-window system;
At the request of the Minister of Finance;
The Prime Minister hereby adopts a Decision on responsibility for completion of procedures for departure, arrival and transit of aircraft through national single-window system.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
1. This Decision deals with responsibility for completion of procedures, and procedures for departure, arrival and transit of aircraft at international airports through the national single-window system.
2. This Decision shall not apply to: foreign special flights carrying diplomatic guests of the Communist Party and the State; flights of Vietnamese special aircrafts; foreign or Vietnamese escort or scouting flights serving the abovementioned flights; flights of Vietnam's army, police or customs forces, flights serving official purposes and rescue flights.
Article 2. Regulated entities
1. Organizations and individuals related to the procedures for departure, arrival and transit of aircraft at international airports through the national single-window system.
2. Regulatory authorities at the airports.
Article 3. Definitions
For the purposes of this Decision, the terms below shall be construed as follows:
1. “national single-window system” means a system that allows a declarant to submit electronic information and documents to follow regulatory administrative procedures for departure, arrival and transit of aircraft through the national single-window portal. Regulatory authorities shall make decisions through the national single-window portal.
2. “national single-window portal” means a central integrated information system serving e-procedures for departure, arrival and transit of aircraft and completion of procedures at airports. The national single-window portal is https://www.vnsw.gov.vn.
3. “regulatory authorities at airports” include border checkpoint customs authority, airport authority, border checkpoint public security, quarantine authorities, border checkpoint quarantine station.
4. “professional information system belonging to regulatory authorities” (hereinafter referred to as “professional information system”) has the functions that are connected to the national single-window portal and subsystems that process information and documents submitted by the applicant through the national single-window system.
5. “procedures for departure, arrival and transit of aircraft through the national single-window portal” mean the processing of electronic transactions from the time when the declarant follows e-procedures through the national single-window portal until he/she receives the decision on completion of the procedures issued by relevant regulatory authorities.
6. “electronic documents” mean the electronic information including content of forms, documents to be submitted by the declarant as prescribed; notifications, confirmations of tasks performed through the national single-window portal between regulatory authorities at airports and the declarant.
7. “declarants” include the pilot in command or legal representative of the carrier (airline or airline’s agent), organizations and individuals authorized to follow procedures as prescribed in this Decision. In case the airline or airline's agent does not have sufficient detailed information about the house airway bill of lading, the person who issues such bill of lading shall create and upload electronic information about this house airway bill of lading on the national single-window portal.
8. “user” is the person who accesses and processes information and uses the functions available on the national single-window portal.
Chapter II
SPECIFIC PROVISIONS
Article 4. Responsibilities for completion of procedures for departure of aircraft
1. The declarant shall submit the following electronic information and documents through the national single-window portal:
a) An export declaration and master bill if the aircraft that carries exports;
b) Passenger list if the aircraft carries passengers;
c) Flight crew list;
d) Passenger’s checked luggage manifest if the aircraft carries passenger’s checked luggage. This information shall be provided independently or included in the Passenger list, Flight crew list and Passenger name record (PNR);
dd) Flight information (flight routes, flight data, name of the airline, border checkpoint, number of passengers, flight crew and departure time);
e) Passenger name record.
The information to be provided in the abovementioned electronic documents submitted through the national single-window portal is specified in the Appendix enclosed herewith.
2. The documents to be submitted or presented:
The declarant must submit the following physical documents (originals) to regulatory authorities at the airports:
a) A General Declaration (including Declaration of Health) submitted to the border checkpoint quarantine station;
b) A declaration of health of corpse, bones, body, body ash (if any) submitted to the border checkpoint quarantine station;
c) A declaration of health of microorganism sample, biological products, tissues, human body organs (if any) submitted to the border checkpoint quarantine station.
The declarant must submit the following physical documents (originals) to regulatory authorities at the airports:
d) Passport or international laissez-passer and visa of passengers; passport or international laissez-passer and visa of flight crew presented to border checkpoint public security;
dd) Crew and passenger’s International Certificate of Vaccination (for people who depart from or transit through an area affected by an epidemic, are suspected of having an infection or carries a pathogen) presented to the border checkpoint quarantine station
3. Time limit for providing information and documents:
a) The information to be provided in the documents specified in Points a, b, c and d, Clause 1 of this Article shall be provided immediately after the carrier completes procedures for exports and outbound passengers.
b) The information to be provided in the document specified in Point dd, Clause 1 of this Article shall be provided immediately after the completion of the procedures for exports and outbound passengers.
c) The information to be provided in the document specified in Point e, Clause 1 of this Article shall be provided within 24 hours before the aircraft departs. In case of change of the passenger name record, the information shall be updated within 08 hours before the aircraft departs.
d) The documents specified in Points a, b and c, Clause 2 of this Article shall be submitted immediately before the time aircraft is expected to depart from the airport. The documents specified in Points d and dd, Clause 2 of this Article shall be presented when the procedures are followed at regulatory authorities.
4. Responsibilities of the regulatory authorities at the airports
Within their power, the regulatory authorities shall receive electronic information and/or documents and give confirmations, and receive or inspect physical documents; and confirm the completion of the procedures for aircraft departure. The receipt of documents, confirmation of document receipt completed and completion procedures completed by declarants and relevant parties shall be carried out automatically through the national single-window portal.
a) Time limit for carrying out procedures
- Regarding the documents specified in Clause 1 of this Article: within 01 hour since the declarant provides sufficient and valid information, and submits electronic information and documents to the system;
- Regarding the documents specified in Clause 2 of this Article: immediately after the declarant submits or presents all valid documents as prescribed.
b) Responsibilities for completion of procedures
- The airport authority shall receive the documents specified in Point dd, Clause 1 of this Article and give confirmations;
- The border checkpoint public security shall receive the documents specified in Points dd and e, Clause 1 of this Article and give confirmations, and inspect the documents specified in Point d, Clause 2 of this Article;
- The border checkpoint quarantine station shall inspect the documents specified in Points a, b, c and dd, Clause 2 of this Article;
- The customs authority shall receive the documents specified in Point a, b, c, d, dd and e, Clause 1 of this Article and give confirmations, and confirm the completion of the procedures for aircraft departure.
5. Revision of information in the documents submitted through the national single-window portal
a) The declarant may make a request for revision of information to be provided in the documents submitted through the national single-window portal before or after the aircraft departs.
b) Regulatory authorities shall receive the revised information to carry out procedures for aircraft departure.
Article 5. Responsibilities for completion of procedures for arrival of aircraft
1. The declarant shall submit the following electronic information and documents through the national single-window portal:
a) An import declaration and master bill if the aircraft carries imports;
b) Information about the house airway bill of lading if the aircraft carries imports;
c) Passenger list if the aircraft carries passengers;
d) Flight crew list;
dd) Passenger’s checked luggage manifest if the aircraft carries passenger’s checked luggage. This information shall be provided independently or included in the Passenger list, Flight crew list and Passenger name record (PNR);
e) Flight information (flight routes, flight data, name of the airline, border checkpoint, number of passengers, flight crew and entry time);
g) Passenger name record.
The information to be provided in the abovementioned electronic documents submitted through the national single-window portal is specified in the Appendix enclosed herewith.
2. The documents to be submitted or presented:
The declarant shall submit the following physical documents (originals) to regulatory authorities at the airports:
a) A General Declaration (including Declaration of Health) submitted to the border checkpoint quarantine station;
b) A declaration for plant quarantine (for the plants subject to plant quarantine) submitted to the plant quarantine authority;
c) A declaration for animal quarantine (for the animals subject to animal quarantine) submitted to the animal quarantine authority;
d) A declaration of health of corpse, bones, body, body ash (if any) submitted to the border checkpoint quarantine station;
dd) A declaration of health of microorganism sample, biological products, tissues, human body organs (if any) submitted to the border checkpoint quarantine station.
The declarant must submit the following physical documents (originals) to regulatory authorities at the airports:
e) Passport or international laissez-passer and visa of passengers; passport or international laissez-passer and visa of flight crew presented to the border checkpoint public security;
g) Passenger’s International Certificate of Vaccination (for people who depart from or transit through an area affected by an epidemic, are suspected of having an infection or carries a pathogen against which vaccination is required by the Ministry of Health) presented to the border checkpoint quarantine station;
h) A Declaration of Health (if required by the Ministry of Health) presented to the border checkpoint quarantine station.
3. Time limit for providing information and documents:
a) The information to be provided in the documents specified in Points a, b, c, d and dd, Clause 1 of this Article shall be provided within 03 hours before the aircraft arrives at the first airport in Vietnam, for the over 03-hour flight; within 30 minutes before the aircraft arrives at the first airport in Vietnam, for the under 03-hour flight.
b) The information to be provided in the document specified in Point e, Clause 1 of this Article shall be provided immediately after the completion of the procedures for passengers and flight crew that will arrive at an international airport in Vietnam.
c) The information to be provided in the document specified in Point g, Clause 1 of this Article shall be provided within 24 hours before the aircraft arrives. In case of change of the passenger name record, the information shall be updated within 08 hours before the aircraft arrives.
d) The documents specified in Points a, b, c, d and dd, Clause 2 of this Article shall be submitted within 02 hours before the aircraft arrives at the airport. The documents specified in Points e, g and h, Clause 2 of this Article shall be presented when the procedures are followed at regulatory authorities.
4. Responsibilities of the regulatory authorities at the airports
Within their power, the regulatory authorities shall receive electronic information and/or documents and give confirmations, and receive or inspect physical documents and confirm the completion of the procedures for aircraft arrival. The receipt of documents, confirmation of document receipt and confirmation of procedures completed by declarants and relevant parties shall be carried out automatically through the national single-window portal.
a) Time limit for completion of procedures:
- Regarding the documents specified in Clause 1 of this Article: within 01 hour since the declarant provides sufficient and valid information, and submits electronic information and documents to the system;
- Regarding the documents specified in Clause 2 of this Article: immediately after the declarant submits or presents all valid documents as prescribed.
b) Responsibilities for completion of procedures
- The airport authority shall receive the documents specified in Point e, Clause 1 of this Article and give confirmations;
- The border checkpoint public security shall receive the documents specified in Points e and g, Clause 1 of this Article and give confirmations, and inspect the documents specified in Point e, Clause 2 of this Article;
- The border checkpoint quarantine station shall inspect the documents specified in Points a, d, dd, g and h, Clause 2 of this Article;
- The plant quarantine authority shall receive the documents specified in Point b, Clause 2 of this Article;
- The animal quarantine authority shall receive the documents specified in Point c, Clause 2 of this Article;
- The customs authority shall receive the documents specified in Point a, b, c, d, dd, e and g, Clause 1 of this Article and give confirmations, and confirm the completion of the procedures for aircraft arrival.
5. Revision of information in the documents submitted through the national single-window portal
a) The declarant may make a request for revision of information included in the documents submitted through the national single-window portal before or after the aircraft arrives.
b) Regulatory authorities shall receive revised information in order to carry out the procedures for aircraft departure.
Article 6. Responsibilities for completion of procedures for transit of aircraft
If there is cargo handling or entry or exit of passengers during the stopover:
1. When the aircraft arrives, Article 5 of this Decision shall be complied with.
2. When the aircraft departs and if there is any change to the documents that were submitted when the aircraft arrives, the procedures specified in Article 4 of this Decision shall be followed.
Article 7. Responsibilities of airports enterprises
1. Within 24 hours (within 01 hour for irregular flights) before the aircraft arrives and the carrier completes procedures for outbound passengers and exports, the airports enterprises shall provide the following information for the Customs Sub-department at international airports:
a) Aircraft nationality;
b) Aircraft type;
c) Flight itinerary;
d) Date and time of arrival and departure;
dd) Location where aircrafts are parked;
e) Passenger entrance gates;
g) Duration of cargo handling.
2. The airports enterprise shall inform the customs authority of the changes to the information specified in Clause 1 of this Article within 01 hour before the aircraft departs or arrives.
Article 8. Receipt and processing of information and documents
1. Information and documents shall be received and processed through the national single-window portal. The declarant shall transfer electronic data to the national single-window portal as prescribed in this Decision in order for regulatory authorities to carry out the procedures for departure, arrival and transit of aircraft.
2. Physical documents shall be received and processed at the office of the airport authority.
Article 9. Management of users
1. Management of users of the national single-window portal
a) The General Department of Customs shall manage users of the national single-window portal; create accounts with various levels of privileges for officials to use the national single-window portal at the request of regulatory authorities at the airports.
b) Regulatory authorities at the airports shall provide the list of officials which specifies their entitlements to process information on the national single-window portal; promptly inform the General Department of Customs of the officials who are no longer competent to do so.
2. Management of users of the professional information system of regulatory authorities at the airports:
The regulatory authorities at the airports shall manage users of their professional information system.
Chapter III
IMPLEMENTATION
Article 10. Responsibilities of declarants
1. Make declarations and follow administrative procedures through the national single-window portal.
2. Make declarations and submit information and documents himself/herself as prescribed by law.
3. Pay tax, fees, charges and other expenses as prescribed by law.
4. Be responsible to law for the accuracy and truthfulness of the provided information and submitted and presented documents, and uniformity in information included in both physical and electronic documents.
5. Retain documents relating to the procedures followed at regulatory authorities through the national single-window portal.
6. In case the declarant cannot follow electronic procedures through the national single-window portal due to technical incidents or force majeure event, he/she may follow the procedures by submitting physical documents as prescribed or via the professional information system under the guidance of the regulatory authorities at airports.
Article 11. Responsibilities of Ministries
1. The Ministry of Finance shall take charge and cooperate with other Ministries in:
a) organizing the implementation of this Decision and submitting annual report on the development of the national single-window system to the Prime Minister.
b) forming legal basis and developing infrastructure serving payment and monitoring of fees and charges for completion of electronic procedures through the national single-window portal.
2. The Ministry of Public Security, the Ministry of Transport, the Ministry of Agriculture and Rural Development and the Ministry of Health shall, within their power:
a) develop and complete the professional processing system and develop infrastructure serving payment and monitoring of fees and charges for completion of electronic procedures through the national single-window portal;
b) organize the implementation of this Decision and submit their own annual report on the implementation to the Ministry of Finance, which will submit it to the Prime Minister.
c) ensure that their professional information system is operated 24 hours a day and 7 days a week, and is connected to and processes information through the national single-window portal under their management; cooperate with the General Department of Customs in handling incidents and difficulties that arise;
d) cooperate and ensure uniformity in and provide guidance on computerization of the physical documents to be submitted or presented as prescribed in Articles 4, 5 and 6 of this Decision.
3. The General Department of Customs shall:
a) provide technical and professional assistance for relevant entities;
b) establish a division responsible for receiving and providing guidance on solution to difficulties arising during the implementation of national single-window system;
c) ensure that the national single-window portal is operated 24 hours a day and 7 days a week; the information system of the General Department of Customs is connected to and processes information through the national single-window portal; set up a network connecting the national single-window portal and the professional information system of Ministries;
d) take charge, provide guidance and manage the procedures for registration and declaration completed by the declarants through the national single-window portal; manage officials that process data through the national single-window portal.
4. Responsibilities of Ministries and authorities for cooperation in receipt and handling of documents and difficulties, and operation of systems:
a) In the cases where an authority rejects documents or keeps addressing documents in reliance on physical documents, inform and cooperate with all relevant parties in taking remedial measures;
b) The declarants' difficulties shall be received and solved through reports or documents, authorities' emails or switchboards;
c) Daily transactions made through the national single-window portal and professional information system of regulatory authorities at airports shall be recorded in the form of files.
Article 12. Effect
This Decision comes into force from November 15, 2017.
Article 13. Responsibility for implementation
Ministries, heads of ministerial agencies, heads of Governmental agencies and Presidents of the People’s Committees of provinces and central-affiliated cities are responsible for the implementation of this Decision./.

6. The General Declaration (including the Declaration of Health) shall be made using the Form No. 2 provided in the Appendix 01 enclosed with the Government’s Decree No. 103/2010/ND-CP dated October 01, 2010.
7. The Declaration for Animal Quarantine shall be made using the Form No. 54 provided in the Appendix enclosed with the Government’s Decree No. 58/2017/ND-CP dated May 10, 2017.
8. The Declaration for Animal Quarantine shall be made in accordance with applicable regulations of the Ministry of Agriculture and Rural Development.
