Công văn 1023/TCHQ-GSQL năm 2022 về sử dụng seal định vị điện tử để niêm phong, giám sát hải quan đối với hàng hóa vận chuyển chịu sự giám sát hải quan do Tổng cục Hải quan ban hành

To: Customs Departments of provinces and cities.

Pursuant to Decision No. 1175/QD-TCHQ dated April 27, 2021 of General Director of General Department of Customs approving the procurement of 5.000 electronic navigational seals; Contract No. 22112021/HDKT/CNTT-ETC-ICT dated November 25, 2021 between General Department of Customs and joint contractors of Technology Systems Join Stock Company ETC and National ICT Service Joint Stock Company for performance of the contract package of procurement of 5.000 electronic navigational seals, General Department of Customs shall cooperate with the contractors in transferring electronic navigational seals to allow the use thereof (number of electronic navigational seals distributed is specified under the Appendix attached hereto). In order to ensure timely implementation, the General Department of Customs hereby requests Departments of Customs of provinces and cities to:

1. Provide operational instructions and direct affiliated Customs Sub-departments to use the transferred electronic navigational seals after receiving in order to supervise goods transported under customs supervision, including:

a) Transit goods; goods stored in bonded warehouses; goods temporarily imported - re-exported (including temporarily imported - re-exported and sent to bonded warehouses) and transported from checkpoints of import to storage location or checkpoints of export must be sealed by electronic navigational seals for supervision. Other customs seals shall be utilized as per the law only when electronic navigational seals are depleted.

b) If electronic navigational seals are not depleted after all goods under Point a have been sealed, they shall be utilized for tracking goods that require customs seal in accordance with Article 50 of Circular No. 38/2015/TT-BTC dated March 25, 2015 amended by Circular No. 39/2018/TT-BTC dated April 20, 2018 of Ministry of Finance.

2. Direct affiliated Customs Sub-departments to strictly implement customs management and supervision for goods transported under customs supervision by utilizing electronic navigational seals in accordance with procedures attached to Decision No. 138/QD-TCHQ dated January 21, 2020 of the General Director of General Department of Customs and relevant guiding documents of General Department of Customs.

3. Direct affiliated Customs Sub-departments to utilize tracking seals in order to seal and supervise shipments transported to customs entities that own and/or manage electronic navigational seals in accordance with Point g Clause 3 Article 7 of Decision No. 138/QD-TCHQ dated January 21, 2020 of General Director of General Department of Customs. If no goods are required to be transported under customs supervision to customs entities that own and manage electronic navigational seals within 3 working days after receiving electronic navigational seals, electronic navigational seals must be returned via courier service.

4. Assign Department of Information Technology and Customs Statistics to take charge and cooperate with Department of Customs Supervision and Management and contractors in:

b) provide training and guidelines on using electronic navigational seal systems and equipment in accordance with Decision No. 138/QD-TCHQ dated January 21, 2020 of the General Department of Customs, acknowledge and record propositions of Customs Departments of provinces and cities in order to develop and complete Decision on amendments to Decision No. 138/QD-TCHQ in a manner that adheres to practical situations and regulations and law.

Difficulties that arise during implementation must be immediately reported to General Department of Customs (via Department of Customs Supervision and Management).
