CIRCULAR
ON GUIDELINES FOR PILOT AUCTION OF TARIFF-RATE QUOTA FOR SUGAR IN 2020
Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 on functions, duties, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on guidelines for a number of Articles of the Law on Foreign Trade Management;
Pursuant to the Government's Decree No. 62/2017/ND-CP dated May 16, 2017 on guidelines for the Law on Property Auction;
Pursuant to the Government’s Decree No. 151/2017/ND-CP dated December 26, 2017 on guidelines for a number of Articles of the Law on Management and Use of Public Property;
At the request of the Director General of the Agency of Foreign Trade;
The Minister of Industry and Trade hereby promulgates a Circular on guidelines for pilot auction of tariff-rate quota for sugar in 2020.
Article 1. Scope
This Circular provides for the tariff-rate quota for sugar (HS code 1701) and rules for the pilot auction of tariff-rate quota for sugar in 2020.
Article 2. Regulated entities
1. Traders directly using sugar as an ingredient for production and traders using raw sugar to produce refined sugar.
2. Individuals and organizations involved in import of sugar according to the 2020 tariff-rate quota.
Article 3. Auctioned tariff-rate quota for sugar in 2020
Auctioned tariff-rate quota for sugar in 2020 is 103.000 tonnes, including:
1. 72.000 tonnes of raw sugar.
2. 31.000 tonnes of refined sugar.
Article 4. Auction rules
1. Rules and procedures for property auction shall be carried out in accordance with regulations of law on property auction and characteristics of the auctioned property.
2. The Ministry of Industry and Trade shall establish a council for pilot auction of tariff-rate quota for sugar in 2020 to hold the auction.
3. The head of the auction council shall promulgate the regulations on pilot auction of tariff-rate quota for sugar in 2020.
Article 5. Notification of grant of the right to use tariff-rate quota
1. After receipt of the report on auction results from the auction council, the Ministry of Industry and Trade shall issue a written notification on grant of the right to use the tariff-rate quota for sugar to the successful bidder(s).
2. The notification on grant of the right to use the tariff-rate quota for sugar to the successful bidder(s) shall be used for customs procedures according to customs regulations.
Article 6. Effect
This Circular takes effect from November 13, 2020 to December 31, 2020.
