Circular 06/2019/TT-BCT stipulating the import border gate of passenger cars with under 16 seats issued by the Minister of Industry and Trade

CIRCULAR

ON BORDER CHECKPOINTS OF IMPORT OF MOTOR VEHICLES FOR THE TRANSPORT OF FEWER THAN 16 PEOPLE

Pursuant to the Law on Commercial Management dated June 12, 2017;

Pursuant to Decree No.98/2017/ND-CP dated August 18, 2017 of the Government on functions, duties, rights and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No.116/2017/ND-CP dated October 17, 2017 of the Government on conditions for production, assembling, import of motor vehicles; provision of services of warranty and maintenance of motor vehicles; 

At the request of the Director of Department of Import and Export,

The Minister of Industry and Trade promulgates a Circular on border checkpoints of import of motor vehicles for the transport of fewer than 16 people

Article 1. Scope

1. This Circular provides for border checkpoints for import of motor vehicles for the transport of fewer than 16 people.

2. This Circular shall not apply to:

a) Import, temporary import for re-export by entities eligible for incentives or immunities specified by the Government, Prime Minister;

b) Vehicles serving national defense and security according to the plan approved by the Prime Minister;

c) Vehicles serving special purposes decided by the Prime Minister;

d) Vehicles transited through bordering countries and vehicles which are transited without going through any border checkpoint of Vietnam.

Article 2, Regulated entities

This Circular applies to importers of motor vehicles for the transport of fewer than 16 people and relevant organizations and individuals.

Article 3. Regulations on border checkpoints for import

1. Motor vehicles for the transport of fewer than 16 people shall be only imported to Vietnam through the following border checkpoints of port:  Quang Ninh (Cai Lan), Hai Phong, Da Nang, Ho Chi Minh City, Ba Ria – Vung Tau.

2. The import procedure shall comply with relevant law provisions.

Article 4. Entry into force

1. This Circular comes into force from May 08, 2019.

2. This Circular annuls the following regulations:

- Article 1 of Joint Circular No.25/2010/TTLT-BCT-BGTVT-BTC dated June 14, 2010 of the Ministry of Industry and Trade, Ministry of Transport and Ministry of Finance on import of new motor vehicles for the transport of fewer than 16 people;

- Clause1 Section I, Clause 2 Section III of Joint Circular No.03/2006/TTLT- BTM-BGTVT-BTC-BCA dated March 31, 2006 of the Ministry of Commerce, Ministry of Transport, Ministry of Finance and Ministry of Public Security providing guidelines for import of used motor vehicles for the transport of fewer than 16 people according to Government’s Decree No.12/2006/ND-CP dated January 23, 2006.

- Circular No.19/2009/TT-BCT dated July 07, 2009 of the Ministry of Industry and Trade on amendments to Joint Circular No.03/2006/TTLT-BTM-BGTVT-BTC-BCA.
