DECISION
ON PARTICULAR ASSOCIATIONS
THE PRIME MINISTER
Pursuant to the December 25, 2001 Law on Organization of the Government;
Pursuant to Article 33 of the Government's Decree No. 45/2010/ND-CP of April 21, 2010, on the organization, operation and management of associations:
At the proposal of the Minister of Home Affairs,
DECIDES:
Article 1. Bases for defining particular associations
1. For associations being socio-political organizations or socio-political-professional organizations:
a/ To be recognized by a competent party agency to be a socio-political organization or socio-political-professional organization;
b/ To be assigned a payroll by and receive financial and operational supports from the State before the effective date of the Government's Decree No. 45/2010/ND-CP of April 21, 2010, on the organization, operation and management of associations.
2. For associations being socio-professional organizations or economic organizations:
a/ To play an important role in national socio-economic development:
b/ To meet difficulties in raising funds for operation:
c/ To be assigned a payroll by and receive financial and operational supports from the State before the effective date of the Government's Decree No. 45/2010/ND-CP of April 21, 2010. on the organization, operation and management of associations.
3. For associations being social organizations:
a/ To operate for social and humanitarian purposes;
b/ To be an association of those with difficulties and disadvantages who need social and state attention and assistance for operation;
c/ To receive financial and operational supports from the State before the effective date of the Government's Decree No. 45/2010/ND-CP of April 21, 2010, on the organization, operation and management of associations.
Article 2. National particular associations
Pursuant to Article 1 of this Decision, national particular associations are specified in the Appendix to this Decision.
Article 3. Local particular associations
Pursuant to Article 1 of this Decision and based on local budget capacity, chairpersons of provincial-level People's Committees shall make lists of local particular associations.
Article 4. Effect
This Decision takes effect on December 20, 2010.
Article 5. Implementation responsibilities Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of provincial-level People's Committees and concerned organizations and individuals shall implement this Decision.
