DECISION
PROMULGATING PRICE OF TAP WATER IN HANOI
PEOPLE’S COMMITTEE OF HANOI CITY
Pursuant to the Law on the Organization of the People’s Councils and the People’s Committees dated 26/11/2003;
Pursuant to the Law on Prices 2012;
Pursuant to the Decree No. 117/2007/NĐ-CP dated 11/7/2007 by the Government on clean water production, supply and consumption;
Pursuant to the Decree No. 124/2011/NĐ-CP dated 28/12/2011 by the Government providing amendments to a number of articles of the Decree No. 117/2007/NĐ-CP;
Pursuant to the Joint Circular No. 75/2012/TTLT/BTC-BXD-BNN dated 15/5/2012 by the Ministries: the Ministry of Finance, the Ministry of Construction and the Ministry of Agriculture and Rural Development providing guidance on principles, methods for determination and authority to decide clean water sale price in urban areas, industrial zones and rural areas;

At the request of interdisciplinary: the Service of Finance, the Service of Construction, the Service of Labor, War Invalids and Social Affairs, Provincial Department of Taxation and Hanoi Water limited company in the Statement No. 4879/TTrLN: TC-XD-LĐTB&XH-CT-NSHN dated 13/9/2013 applying for approval of the project on adjustment of clean water price in Hanoi City and the written appraisal No. 2314/STP-VBPQ dated 19/9/2013 by the Service of Justice,

a) Any households in residential areas and apartment buildings using water for daily life. Each household may register to use tap water by signing a water use contract;
b) Foreigner owning a private house or a household who signs or authorizes a legal representative to sign a water-use contract with the Water company;
c) Students and employees renting houses in at least 12 months according to the temporary residence registration and the renting contract certified by a competent agency (every 04 people is considered as a household). Tap water price is applicable to these users.
d) Regarding the supply of clean water other than the completed and concentrated water supply system in Hanoi City, the People’s Committee of Hanoi will approve the clean water unit price for each specific project.
Article 3. Organization of implementation
1. Clean water producers and suppliers shall:
a) Collect the environmental protection charge applicable to sewage in Hanoi according to current regulations;
b) Develop and innovate the water supply network; raise the quality of water and water supply service; regularly monitor and inspect the usage of clean water, avoiding local water loss; collect water supply payment at the right price from the right payers; promptly impose remedial measures for the loss of water and revenue from water charge; recover and repay the loans according to the regulations.
2. The Service of Finance shall preside over and cooperate with the Service of Construction and relevant regulatory bodies in taking responsibilities for:

b) Appraise the projects on clean water price established by the water supplying units outside the concentrated water supply system of Hanoi and submit them to the People’s Committee of Hanoi for consideration and approval.
3. The Service of Construction shall preside over and cooperate with the relevant regulatory bodies in taking responsibilities for: supervising and inspecting water supply enterprises in terms of water quality, service quality and rate of loss of clean water and revenue from clean water charge.
Article 4. This Decision comes into effect after 10 days from the day on which it is signed. The water price specified in Article 1 of this Decision is applicable from 01/10/2013, the price applicable to the years 2014 and 2015 specified in Article 1 of this Decision is adjusted annually on every October 10th.
Article 5. The Chief officer of the People’s Committee of Hanoi, Director of the Services: Service of Finance, Service of Construction, Service of Planning and Investment, Service of Labor, War Invalids and Social Affairs; Provincial Department of Taxation; Director of State Treasuries of Hanoi; President of the People’s Committees of districts; clean water producing and trading units in Hanoi; Head of relevant agencies and units and individuals/households are responsible for implementing this Decision./.
