Decision No. 35/2018/QD-UBND dated September 21, 2018 on maximum prices of parking services invested by non-state capital in Ho Chi Minh City

DECISION

ON MAXIMUM PRICES OF PARKING SERVICES INVESTED BY NON-STATE CAPITAL IN HO CHI MINH CITY

PEOPLE'S COMMITTEE OF HO CHI MINH CITY

Pursuant to the Law on organization of local government authorities dated June 16, 2015;

Pursuant to the Law on promulgation of legislative documents dated June 22, 2015;

Pursuant to the Law on Prices dated June 20. 2012;

Pursuant to Decree No.177/2013/ND-CP dated November 14, 2013 of the Government on elaboration and enforcement of a number articles of the Law on Prices;

Pursuant to Decree No.149/2016/ND-CP dated November 11, 2016 of the Government on amendments to number of articles of Decree No.177/2013/ND-CP; 

Pursuant to Circular No.56/2014/TT-BTC dated April 28, 2014 of the Ministry of Finance on guidelines for implementation of Decree No.177/2013/ND-CP;

Pursuant to Circular No.233/2016/TT-BTC dated November 11, 2016 of the Ministry of Finance on amendments to a number of articles of Circular No.56/2014/TT-BTC;

Pursuant to Circular No.25/2014/TT-BTC dated February 17, 2014 of the Ministry of Finance on common price determination applied to goods and services.

At the request of the Department of Finance, Department of Transport and Voluntary Youth Public Benefit Service Company Limited provided in Report No.5214/TTr-STC-SGTVT-DVCI dated August 03,, 2018 on prices of parking services invested by non-state capital in Ho Chi Minh City and assessment of the Department of Justice provided in Official Dispatch No.8432/STP-VB dated September 04, 2018.

HEREBY DECIDES:

Article 1. Scope

1. This Decision provides for maximum prices of parking services invested by non-state capital in Ho Chi Minh City.

2. This Decision shall not apply to the following services:

a) Parking services at state administrative agencies;

b) Parking at dedicated parking spots invested by non-state capital as approved by the competent authority. The maximum prices of the aforesaid services shall be variable and shall be decided by the People's Committee of the city.

Article 2. Regulated entities

Providers and users of parking services invested by non-state capital in Ho Chi Minh City

Article 3. Maximum parking prices

The parking prices shall be determined based upon parking period, parking location and type of vehicles. To be specific:

1. Regulations on time:

a) Night time is the period of time from 06:00 pm to 6:00 am.

b) If the parking service is provided in two period of time – before and after 06:00 pm, the parking prices shall be calculated as follows:

- If the parking period is shorter than 12 hours, daytime or night time price will apply (daytime price if the parking period before 06:00 pm is greater than that after 06:00 pm and vice versa);

- If total parking period is 12 hours and above, the service user must pay both day and night prices.

2. Maximum prices applied to parking services in district 1, 3 and 5:

a) For bicycles (including electric bicycles):

b) For motorbikes (including electric motorbikes):

- Group 1: Parking in schools, hospitals, gas stations, markets, supermarkets, recreational places, community events, cultural houses, children's houses, youth centers, parks under management of state management agencies, political – socio organizations in provinces and districts:

- Group 2: Other locations not specified in group 1:

 (Note: the parking time in excess of 4 hours will be charged as a full period.)

c) For motor vehicles:

- As for motor vehicles having up to 9 seats with load capacity ≤ 1.5 tonnes:

- As for motor vehicles having more than 9 seats with load capacity ≤ 1.5 tonnes:

 (Note: the parking time in excess of 4 hours will be charged as a full period.)

3. Maximum parking prices in other districts: 

a) For bicycles (including electric bicycles):

b) For motorbikes (including electric motorbikes):

- Group 1: Parking in schools, hospitals, gas stations, markets, supermarkets, recreational places, community events, cultural houses, children's houses, youth centers, parks under management of state management agencies, political – socio organizations in provinces and districts:

- Group 2: Other locations not specified in group 1:

- As for motor vehicles having up to 9 seats with load capacity ≤ 1.5 tonnes:

- As for motor vehicles having more than 9 seats with load capacity > 1.5 tonnes:

 (Note: the parking time in excess of 4 hours will be charged as a full period.)

4. Parking prices specified herein already include the VAT.

Article 4.  According to parking prices stipulated in Article 3 herein, organizations or individuals licensed by competentregulatory agencies to provide parking services invested by non-state capital in Ho Chi Minh City shall decide the parking price but must not exceed the maximum price specified in Article 3 herein. And such organizations and individuals must publish the parking prices at the parking locations and make collection according to the quoted prices.

Article 5. Effect

1. This Decision comes into force from October 01, 2018.

2. This Decision will replace Decision No.6888/QD-UBND dated December 30, 2016 of People’s Committee of the city on the prices of parking services invested by non-state capital in Ho Chi Minh City.

Article 6. Chief Office of People's Committee of the city, Directors of the Department of Finance, Department of Transport and relevant departments, Chairpersons of People's Committees of districts and relevant organizations and individuals shall take responsibility to implement this Decision./.
