DECISION
PROMULGATING “REGULATION ON 3-MCPD CONTENTS IN SOYBEAN SAUCE AND OYSTER SAUCE”
MINISTER OF HEALTH
Pursuant to the Government’s Decree No. 49/2003/ND-CP dated May 15, 2003 defining Functions, Tasks, Powers and Organizational Structure of Ministry of Health;
Pursuant to the Government’s Decree No.163/ND-CP dated September 07, 2004 elaborating certain articles of the Ordinance on Food Safety and Hygiene;
At the request of Directors of the Science and Education Department, and the Legal Department affiliated to Ministry of Health, and Director of Vietnam Food Administration,
HEREBY DECIDES:
Article 1. “Regulation on 3-MCPD contents in soybean sauce and oyster sauce” is enclosed with this Decision.
Article 2. This Decision shall take effect 15 days after its publication in the Official Gazette.
Article 3. Chief of the Ministry’s Office, Chief Inspector, Directors of the Legal Department, the Science and Education Department, and Vietnam Food Administration affiliated to Ministry of Health, Directors of Departments of Health of provinces or centrally-controlled cities, heads of affiliates of the Ministry of Health, and heads of health agencies affiliated to relevant ministries shall be responsible for implementation of this Decision.

REGULATION
ON 3-MCPD CONTENTS IN SOYBEAN SAUCE AND OYSTER SAUCE
(Enclosed with the Decision No. 11/2005/QD-BYT dated March 25, 2005 by Minister of Health)
Article 1. Scope
This Regulation stipulates the content of 3-MCPD (3-monoclo propan-1,2- diol) in soybean sauce and oyster sauce.
Article 2. Regulated entities
This Regulation applies to organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce in Vietnam.
Article 3. Maximum allowable content of 3-MCPD in soybean sauce and oyster sauce, and test method
1. Maximum allowable content of 3-MCPD is 1 mg/kg.
2. Test method: Determine 3-MCPD content according to 52 TCN – TQTP 0010: 2004 – Common technical regulation for determination of 3-Monoclo Propan 1,2-Diol (3-MCPD) in sauces of plant origin.
Article 4. Requirements to be satisfied by organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce
1. Organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce must comply with technical standards and regulations on food safety and hygiene, and regulation on 3-MCPD content levels herein.
2. In addition to the compliance with applicable regulations of Vietnam Law, importers of soybean sauce and oyster sauce must also present evidence (originated from export countries) that 3-MCPD content in imported products does not exceed the maximum allowable content prescribed in this Regulation. In case of unavailability of such evidence, regulatory authorities shall take samples to analyze and determine 3-MCPD content in imported products. If analytical result shows that the 3-MCPD content in imported products exceeds the prescribed maximum level, regulatory authorities shall refuse to give approval for such shipment.
