DECISION
GUIDANCE ON APPLICATION FOR REGISTRATION OF MANUFACTURER IDENTIFICATION CODES (MID) FOR TEXTILE AND GARMENT EXPORTS TO THE UNITED STATES OF AMERICA
Pursuant to regulations of the U.S. Customs and Border Protection (CBP) pertaining to declaration of MIDs of textile and garment exports to the U.S., after agreeing with the General Department of Customs, the Ministry of Trade herein provides traders manufacturing garment and textile products for export to the US with the following instructions:
1.Subjects of application: All of the manufacturers of categories of garment and textile exports to the US (even including those with or without quotas) are required to register MIDs with Export and Import Management Offices directly subordinate to the Ministry of Trade.
1.1 . If any trader manufacturing categories of garment and textile products subject to quotas for export to the US since 2003 has already obtained an MID which is made up in breach of the principles referred to in the Appendix to the Notice hereunder, they are requested to re-apply to regional Export and Import Management Offices when carrying out customs procedures for textile and garment exports to the US.
1.2 . Traders manufacturing categories of garment and textile products not subject to quotas for export, or exporting textile and garment products for the first time, to the US can apply for MID registrations to regional Export and Import Management Offices directly subordinate to the Ministry of Trade by using the application form No. 1 attached to the Notice hereunder.
1.3 . Pure-play traders not directly involved in manufacturing of textile and garment exports have no MID. When acting as exporters, they must enter MIDs of traders manufacturing export shipments on export documents.
2.Identifying MIDs: Manufacturers and exporters of garment and textile exports to the US may collaborate with importers or customs brokers in determining MIDs according to regulations.
2.1. For the purpose of completing the export procedures, traders must enter MIDs which are the ones registered with the regional Export and Import Management Offices directly subordinate to the Ministry of Trade into cell 1 on the export declaration form provided by the Customs Checkpoint (following the exporter’s name and address) and cell 23 on the commercial invoice (following the manufacturer’s name and address), and bear responsibility for accuracy of these MIDs.
2.2. Traders complete export declaration forms that Customs Checkpoints specially design for specific manufacturers.
2.3. MIDs with the incorrect manufacturing countries of pure-play traders would be deemed invalid to the extent that the U.S. Customs can reject entry.
3.Searching for information: Detailed instructions on how to invent an MID code are given in Appendix 2 hereto. For more queries about how to create an MID code and complete the procedures for MID registration, traders can send emails to the address [email protected] of the Textile and Garment Quota Authority of the Ministry of Trade or the regional Export and Import Management Offices to get replies.
4. The Ministry of Trade is requesting traders without MIDs to apply for registration of MIDs to the regional Export and Import Management Offices at their earliest convenience in order to avoid the situation in which customs clearance of exports to the US is rejected.
5. In order to prevent any act of fraud and illegal transshipment, trade, industry, customs authorities and Vietnam Textile and Apparel Association shall collaborate in carrying out the inspection of export shipments involved in any suspicious violation. Where any fraudulent act committed when providing the manufacturer’s information is discovered, they shall impose sanctions as per regulations on textile and garment export, import or refer such offence to the appropriate jurisdictional agency for legal actions to be taken.
The Ministry of Trade is notifying this Decision to the regional Export and Import Management Offices and traders for implementation purposes. In the course of implementation hereof, should there be any difficulty that arises, they can consult the Ministry of Trade on possible solutions./.

Appendix: RULES FOR CREATING MIDS FOR TEXTILE AND GARMENT EXPORTS TO THE UNITED STATES OF AMERICA
(To the Notice No. 1059 /TM-DM dated November 25, 2005)
I. Principles for creating an MID
An MID can contain 15 characters (without space).

Detailed instructions on how to identify MID characters as follows:
1. Manufacturing country: Use the ISO code indicating the real country of origin of the export.
For Vietnam, enter VN. Canada is an exception because CA is not its country code. There is a list of characters indicating codes of Canada’s provinces.
2. Manufacturer’s name: If the manufacturer’s name contains more than one character set, combine the first three characters of the first and the second set together. If the company’s name contains one character set, only the first three characters of that set are used.
Example:
Amalgamated Plastics Corp. is encoded into “AMAPLA;”
Bergstrom is encoded into “BER.”
If the company’s name is an abbreviation containing at least two letters, all of these letters can be combined to become a character set.
Example:
A B C Company is encoded into “ABCCOM.”
O.A.S.I.S. Corp. is encoded into “OASCOR.”
If the manufacturer’s English name contains a, an, and, of and the, they can be omitted.
Example: “The Embassy of Spain” is encoded into “EMBSPA.”
Parts of the company’s name that are linked by a dash mark are considered as a character set.
Example: “Rawles – Aden Corp.” is encoded into “RAWCOR.”
Several names may contain numbers. Example:
“20th Century Fox” is encoded into “20TCEN”
“Concept 2000” is encoded into “CON200.”
If several words forming the manufacturer’s name are common nouns or indicate the manufacturer’s function or quality, they are not used for inventing an MID.
For example, most of the textile factories’ names in Macau begin with “Fabrica de Artigos de Vestuario” which means “Factory of Clothing.” If a factory is named “Fabrica de Artigos de Vestuario JUMP HIGH Ltd,”, the words “JUMP HIGH” are used for inventing an MID.
In Vietnam, if a company is named “Công ty trách nhiệm hữu hạn may mặc Trường Minh” (Truong Minh Textile Co. Ltd.), the words “Truong Minh” are used for inventing an MID and thus the company’s name is encoded into “TRUMIN”.
3. Manufacturer’s address: Find the greatest numeral in the address line and use the first four digits.
Example: In the address “11455 Main Street Suite 9999”, the digits “1145” are used.
The suite or PO Box number is if it has the greatest value
Example: In the address “232 Main Street, Suite 1234”, the digits “1234” are used.
None of the numerals indicating the address that are written in words, like “One Thousand Century Plaza”, is used for inventing an MID.
However, if the address is “One Thousand Century Plaza Suite 345”, the digits “345” are used.
If there are commas or dashes between digits, these marks can be omitted and then the digits are used. Example: In the addresses like “12,34,56 Alaska Road” and “12-34-56 Alaska Road”, the digits “1234” are used.
If there are spaces between digits, a space is deemed as a separator between numeric sets and then the numeric set that has the greater value is used. Example: In the address “Apt. 509 2727 Cleveland St.”, the digits “2727” are used.
4. City's name: Use the first 3 alphabetic characters forming the city’s name.
Example:
“Tokyo” is encoded into “TOK”
“St. Michel” is encoded into “STM”
“18-Mile High” is encoded into “MIL”
“The Hague” is encoded into “HAG”
Noting that all of the digits in the city’s name must be omitted.
If a country is also a city, the first three letters forming the country’s name are used. For example, Hong Kong is encoded into “HON”; Singapore into “SIN”; and Macau into “MAC”.
5. Other general principles:
Ignore all sentence separators, such as comma, horn and other symbols (e.g. "&")
Ignore all of the abbreviations, for example, the letter “S” in “Thomas S. Delvaux Company”.
Ignore all of the indicators standing in front of any name or address.
Below are several examples of manufacturer’s names, addresses and respective MID codes.

II. Application of MIDS to all manufacturers of textile and garment exports to the U.S.:
Manufacturer’s MIDs help identify the product origin. Therefore, in order to ensure that MIDs are granted to all of the manufacturers of textile and garment exports to the U.S. (even including non-quota ones), verifying that factories of these manufacturers exist is a must.
