CIRCULAR
REGULATING LIST OF WASTES SUBJECT TO TEMPORARY SUSPENSION FROM TEMPORARY IMPORT, RE-EXPORT OR MERCHANTING BUSINESS
Pursuant to the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017, defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Government's Decree No.69/2018/ND-CP dated May 15, 2018 elaborating on certain articles of the Law on Foreign Trade Management;
Upon the request of the Director of the Import and Export Department,
The Minister of Industry and Trade hereby promulgates the Circular prescribing the list of wastes subject to temporary suspension from temporary import, re-export or merchanting trade business.
Article 1. Scope
This Circular regulates the list of wastes subject to temporary suspension from temporary import, re-export or merchanting business.
Article 2. Subjects of application
1. Businesspersons participating in temporary import, re-export and merchanting trades in commodities.
2. Entities and organizations taking charge of temporary import, re-export and merchanting trades in commodities.
3. Entities, organizations and persons involved in temporary import, re-export and merchanting trades in commodities.
Article 3. Publication of the List of wastes subject to temporary suspension from temporary import, re-export or merchanting business
1. The List of wastes subject to temporary suspension from temporary import, re-export or merchanting business shall be annexed as an Appendix hereto.
2. This List annexed hereto shall not apply to merchanting trades performed in the form of transporting commodities directly from exporting countries to importing countries without going through bordergates of Vietnam.
Article 4. Entry into force
1. This Circular shall take effect from January 1, 2020 to end of December 31, 2020, replacing the Circular No. 41/2018/TT-BCT dated November 6, 2018 of the Ministry of Industry and Trade on the list of wastes subject to temporary suspension from temporary import, re-export and merchanting business.
2. In the course of implementation of this Circular, if any difficulty or issue arises, businesspersons, entities and persons involved may send written feedbacks to the Ministry of Industry and Trade to seek its decision./.

APPENDIX
LIST OF WASTES SUBJECT TO TEMPORARY SUSPENSION FROM TEMPORARY IMPORT, RE-EXPORT OR MERCHANTING BUSINESS

This List is compiled on the basis of the list of exported and imported goods of Vietnam annexed to the Circular No. 65/2017/TT-BTC dated June 27, 2017. This List is used according to the following rules:
1. If a Chapter includes goods with 2-digit codes only, all goods with 8-digit codes in this Chapter will be covered.
2. If a Chapter includes goods with 4-digit codes only, all goods with 8-digit codes in this Chapter will be covered.
3. If goods carry codes 3919, 3920, 3921, 3923.21 and 3923.29 in the List, only used ones will be covered.
