CIRCULAR

ON APPLICATION OF TARIFF QUOTA ON TOBACCO AND BIRDS’ EGGS ORIGINATING IN THE MEMBER STATES OF THE EURASIAN ECONOMIC UNION IN 2020, 2021, 2022

Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017 on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 on elaboration of the Law on Foreign Trade Management;

Implementing the Free Trade Agreement between the Vietnam and the Eurasian Economic Union ratified by the State President of the Socialist Republic of Vietnam;

At the request of Director of Department of Export and Import,

The Minister of Industry and Trade promulgates a Circular on application of tariff quota on tobacco and birds’ eggs originating in the Member States of the Eurasian Economic Union in 2020, 2021, 2022.

Article 1. Scope

Application of tariff quota on tobacco and birds’ eggs originating in the Member States of the Eurasian Economic Union under the Free Trade Agreement between the Vietnam and the Eurasian Economic Union.

Article 2. Regulated entities

This Circular applies to importers of tobacco and birds’ eggs originating in the Member States of the Eurasian Economic Union and relevant entities under tariff quota scheme.

Article 3. Goods and tariff quotas

1. HS codes and tariff quotas in 2020, 2021 and 2022 of commodity groups subject to tariff quotas mentioned in Article 1 of this Circular are specified in Appendix hereto appended.

2. Imported goods must obtain the Certificate of Origin issued by the regulatory body of the Member States of the Eurasian Economic Union (abbreviated as C/O form EAV) in accordance with applicable regulations and laws.

Article 4. Eligible entities and method of allocation of tariff quota

1. Tariff quota on tobacco will be allocated to importers that obtain licenses to produce cigarettes issued by The Ministry of Industry and Trade and wish to use imported tobacco in production of cigarettes.

2. Tariff quota on birds’ eggs will be allocated to importers that wish to import birds’ eggs.

3. Method of allocation of tariff quotas on tobacco and birds’ eggs is specified in Circular No. 12/2018/TT-BCT dated June 15, 2018 of the Minister of Industry and Trade on elaboration of the Law on Foreign Trade Management and the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government on elaboration of the Law on Foreign Trade Management.

4. The quantity of imported tobacco and birds’ eggs shall be subtracted from the tariff quota issued by the Ministry of Industry and Trade.

Article 5. Tariff rate

In-quota tariff rate and out-of-quota tariff rate on tobacco and birds’ eggs originating in the Member States of the Eurasian Economic Union shall comply with regulations of the Government.

Article 6. Entry in force

This Circular comes into force as of October 15, 2020 to December 31, 2022 inclusive./.
