CIRCULAR
COLLECTION, PAYMENT, MANAGEMENT, ALLOCATION AND AMOUNT OF FEES FOR ACCESS TO HYDRO-METEOROLOGY, WATER AND AIR REFERENCE DOCUMENTS
Pursuant to the Government’s Decree No.57/2002/ND-CP dated June 02, 2002 detailing the Ordinance on Fees and Charges;
Pursuant to the Ordinance on Utilization and Protection of Hydro-Meteorological works dated December 02, 1994 by the Standing Committee of National Assembly;
Pursuant to the Government’s Decree No.24/2006/ND-CP dated March 06, 2006 on amendments to a number of articles of the Government’s Decree No.57/2002/ND-CP dated June 03, 2002 detailing the implementation of the Ordinance on Fees and Charges;
Pursuant to the Government’s Decree No. 118/2008/ND-CP dated November 27, 2008 defining functions, rights, responsibilities and organizational structure of the Ministry of Finance;
At request of the Ministry of Natural Resources and Environment in the Official Dispatch No.4248/BTNMT-TC dated October 25, 2008;
The Ministry of Finance hereby promulgates the amount, collection, payment, management and allocation of fees for access to hydro-meteorology, water and air reference documents (hereinafter referred to as “hydro-meteorological document”) as follows:
I.GENERAL DOCUMENTS
1. This Circular applies to collection, payment, management and allocation of fees for access to hydro-meteorological documents gathered from fixed meteorological monitoring stations and meteorological surveying points at the National Hydro-Meteorological Service of the Ministry of Natural Resources and Environment (hereinafter referred to as “National Hydro-Meteorological Service”).
2. Entities using hydro-meteorological documents of the National Hydro-Meteorological Service shall be charged for document access under this Circular.
3. The access to hydro-meteorological documents shall not be charged if it serves the following purposes:
a) Public interests; and/or
b) National defense and security; and/or
c) Information exchange with foreign countries or international organizations under international Agreements to which the Socialist Republic of Vietnam is a signatory or member.
II.SPECIFIC PROVISIONS
1. Fees for hydro-meteorological document access (hereinafter referred to as “document access fee”) shall be specified in the Annex hereof – The Schedule of fees for document access.
Document access fees belong to the state budget. Hydro-meteorological document providers shall collect access fees and shall be entitled to retain 70% of the total access fees to pay for:
a) Entities directly participating in document provision service and fee collection including salary, allowances and contributions under regulations of laws after deduction of salary for those receiving salary from the State budget;
b) Direct costs in relation to fee collection such as costs of office stationery, telephone bills, electricity and water bills, out-of-pocket expenses for business trips or official missions; costs for printing (purchasing) declarations and permits under the current quota and standards;
c) Expenses for procurement and regular maintenance and overhaul of machineries for access fee collection;
3. Fee collectors shall submit 30% of the collected fee to the State Budget according to the current State Budget Appendix.
III.IMPLEMENTATION ORGANIZATIONS
1. This Circular enters into forces after 45 days from the date on which it is signed.
2. Other aspects in relation to the payment, collection, management and use of receipt, mechanism for document access fee collection not prescribed in this Circular shall conform to guidance on the Circular No.63/2002/TT-BTC dated July 24, 2002; Circular No.45/2006/TT-BTC dated May 25, 2006 on amendments to the Circular No.63/2002/TT-BTC dated July 24, 2002 dated by the Ministry of Finance provision guidelines for the applications of regulations of laws on fees and charges, and the Circular No.60/2007/TT-BTC dated June 14, 2007 dated by the Ministry of Finance on guidelines for Tax Administration.,
3. Any issue arising in connection to the application if this Circular should be promptly reported to the Ministry of Finance. /.
