PROMULGATING PLAN FOR STRENGTHENING DIRECTIVE NO. 19-CT/TU DATED OCTOBER 19, 2018 OF THE STANDING BOARD OF PARTY COMMITTEE ON CONDUCTING THE CAMPAIGN “HO CHI MINH CITY RESIDENTS DO NOT LITTER IN ROADS AND CANALS FOR A CLEAN CITY AND FLOOD REDUCTION”

THE PEOPLE’S COMMITTEE OF HO CHI MINH CITY

Pursuant to the Law on Organization of Local Governments dated June 19, 2015;

Pursuant to the Law on Environment Protection dated June 23, 2014;

Pursuant to Director No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”;

Pursuant to the Conclusion No. 484-KL/TU dated July 17, 2019 of the Standing Board of Party Committee strengthening Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”;

At the request of the Director of the Department of Natural Resources and Environment in Official Dispatch No. 6483/STNMT-CTR dated August 5, 2019 on plan for strengthening Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”,

HEREBY DECIDES:

Article 1. Issue together with this DecisionthePlan for strengthening Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”.

Article 2.Assign the Department of Natural Resources and Environment to act as a designated contact point to urge Departments, agencies and the People’s Committees of districts to perform the tasks mentioned in this Plan; and send quarterly reports to the People’s Committee of Ho Chi Minh City.

Article 3.This Decision comes into force as of from the date of signing.

Article 4.The Chief officers of the People’s Committee of Ho Chi Minh City, Director of the Department of Natural Resources and Environment, Heads of Departments and agencies, Presidents of the People’s Committees of districts shall implement this Decision./.

PLAN

STRENGTHENING DIRECTIVE NO. 19-CT/TU DATED OCTOBER 19, 2018 OF THE STANDING BOARD OF PARTY COMMITTEE ON CONDUCTING THE CAMPAIGN “HO CHI MINH CITY RESIDENTS DO NOT LITTER IN ROADS AND CANALS FOR A CLEAN CITY AND FLOOD REDUCTION”
(Issued herewith Decision No. 3283/QD-UBND dated August 6, 2019 of the People’s Committee of Ho Chi Minh City)

Pursuant to Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”(hereinafter referred to as Directive No. 19);

Pursuant to Decision No. 787/QD-UBND dated March 4, 2019 of the People’s Committee of Ho Chi Minh City promulgating Plan to implement Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction” (hereinafter referred to as Decision No. 787);

Pursuant to the Conclusion No. 484-KL/TU dated July 17, 2019 of the Standing Board of Party Committee strengthening Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”;

The People’s Committee of Ho Chi Minh City promulgates the Plan for strengthening implementation of Directive No. 19 by 2020 as follows:

I. OBJECTIVES - REQUIREMENTS

1. Objectives:

1.1. Strengthening propagation and effective implementation of Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”.

1.2. Eliminate limitations arising in 6 months of implementation of Directive No. 19, formulate and propose solutions to be adopted by 2020.

2. Requirements:

2.1. Departments, agencies, the People’s Committees of 24 districts shall take initiative in cooperating with Vietnamese Fatherland Front, socio-political organizations in further mobilizing and motivating organizations, individuals, households to participate in the Campaign.

2.2. Combine the Campaign and Program to reduce environmental pollution for the period of 2016 - 2020 and Resolution No. 03/NQ-HDND dated June 11, 2017 of People's Council of Ho Chi Minh City on environment protection of urban areas, residential areas and waste management in the city.

II. IMPLEMENTATION

1. Combine the Campaign and the appeal of the Prime Minister Nguyen Xuan Phuc in the Open Letter No. 161/LDCP dated April 25, 2019 on joining hands with the community to tackle plastic waste issue; Program to reduce environment pollution for the period of 2016-2020 and Resolution No. 03/NQ-HDND dated June 11, 2017 of People's Council of Ho Chi Minh City on environment protection of urban areas, residential areas and waste management in the city.

2. Raising environmental awareness among the residents and motivate them to participate in the Campaign.

3. Deal with all matters concerning waste pollution in residential areas and public areas.

4. Deal with all matters concerning encroachments upon canals, drainage gates, manholes and littering on canals.

5. Initiate and maintain the system to receive environment-related reports; build database to manage, inspect and deal with violations related to environment hygiene.

6. Intensify inspection and actions against violations related to environment hygiene in public areas, vendors’ encroaching pavements and roads, encroachment upon drainage gates and manholes, manhole blockage and encroachment of facilities upon canals.

7. Initiate solutions to reduce the use of disposable plastic bags and plastic products in the city.

8. Review, formulate and promulgate criteria and procedures for awarding titles in connection with the Campaign and civilized titles to motivate all walks of life to conduct the Campaign in an effective manner.

9. Praise, raise public awareness and expand models, solutions to initiate the Campaign in an effective manner.

III. TASK ASSIGNMENT

1. Combine the Campaign and the appeal of the Prime Minister Nguyen Xuan Phuc in the Open Letter No. 161/LDCP dated April 25, 2019 on joining hands with the community to tackle plastic waste issue; Program to reduce environment pollution 2016-2020 and Resolution No. 03/NQ-HDND dated June 11, 2017 of People's Council of Ho Chi Minh City on environment protection of urban areas, residential areas and waste management in the city:

Departments, agencies and the People’s Committees of 24 districts continue to perform the tasks assigned by the People’s Committee of Ho Chi Minh City as specified in the following documents:

- The Decision No. 5927/QD-UBND dated November 11, 2016 of the People’s Committee of Ho Chi Minh City promulgating Plan to implement Resolution of 10th Party Congress of City on Program to reduce environmental pollution for the period of 2016-2020;

- The Decision No. 5560/QD-UBND dated December 4, 2018 of the People’s Committee of Ho Chi Minh City promulgating Plan to implement Resolution of 10th Party Congress of City on Program to reduce environmental pollution for the period of 2018-2020;

- The Decision No. 5297/QD-UBND dated October 9, 2017 of the People’s Committee of Ho Chi Minh City promulgating Plan to implement Resolution No. 03/NQ-HDND dated June 11, 2017 of the People's Council of Ho Chi Minh City on environment protection of urban areas, residential areas and waste management in the city.

- The Decision No. 787/QD-UBND dated March 4, 2019 of the People’s Committee of Ho Chi Minh City promulgating Plan to implement Directive No. 19-CT/TU dated October 19, 2018 of the Standing Board of Party Committee on conducting the campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction”.

- The Plan No. 3098/KH-UBND dated July 29, 2019 of the People’s Committee of Ho Chi Minh City on conducting Campaign “Anti-plastic waste” in Ho Chi Minh City for the period of 2019-2021.

2. Raising environmental awareness among the residents and motivate them to participate in the Campaign:

2.1. Department of Natural Resources and Environment shall assume the prime responsibility for formulating sets of booklets to propagate the Campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction” and distribute them to Departments, agencies, the People’s Committees of 24 districts, Fatherland Front and socio-political organizations for consistent propagation in the city.

2.2. The Department of Information and Communications shall plan to guide news agencies to accelerate the advocacy messages of the Campaign in the city. Furthermore, deal with surrounding rumors, negative and inaccurate information causing confusion in public, strictly deal with groups and individuals giving false statement against the Campaign in fact.

2.3. The Department of Education and Training shall study and advise the People’s Committee of Ho Chi Minh City to transfer the Campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction” to the curriculum and extra curriculum to students of all levels in the city.

2.4. The People’s Committees of 24 districts:

a) Make a detailed plan to spread advocacy messages and mobilize the residents to participate in the Campaign “Ho Chi Minh City residents do not litter in roads and canals for a clean city and flood reduction” in districts. Formulate plentiful and diversified propagation programs and columns, news, articles and radio broadcasting reports; and include advocacy messages in activities in districts to ensure that by December 2019, all residents in districts will know thoroughly and in company with the local governments in environment protection activities.

b) Direct the People’s Committees of wards, communes, towns under management to hold open dialogues with the residents about environment hygiene to spread advocacy messages and motivate the residents to follow policies of the city; ensure that by September 2019, all wards, communes, towns must hold open dialogues with the residents.

2.5. Departments, agencies shall take initiative in formulating propagation booklets to mobilize officials and public employees, workers and subordinates to respond favorably to and conduct the Campaign in an effective manner.

2.6. Departments, agencies, the People’s Committees of 24 districts and affiliated entities of the city shall study and formulate advocacy messages according to particular characteristics of every branch, and then post them on their websites no later than October 2019; and update monthly reports on their websites.

3. Dealing with all matters concerning waste pollution in residential areas and public areas:

3.1. The Department of Natural Resources and Environment:

a) Advise the People’s Committee of Ho Chi Minh City to seek approval from the competent authority for Planning Project for Solid Waste Treatment in Ho Chi Minh City by 2025, with a vision to 2050.

b) Plan and supervise environment hygiene quality in the city: Undertake biannual inspection and surprise inspection visits to garbage collection spots, intermediate stations, and check hygiene quality of streets and canals, inspect the actions against garbage hot spots, management of public garbage containers and public toilets in districts.

c) Instruct and expedite The People’s Committees of 24 districts to classify municipal solid waste at source (under the Decision No. 44/2018/QD-UBND dated November 14, 2018 of the People’s Committee of Ho Chi Minh City); change vehicles used for collection and transportation of waste; rearrange private garbage collection units and mobilize them to change into businesses or cooperatives with legal status.

3.2. The Department of Culture, Sports and Tourism, Departments, agencies, the People’s Committees of 24 districts shall spread advocacy messages, motivate and require the residents who join events and festivals to clean up waste thereafter, in specific:

a) The Department of Culture, Sports and Tourism shall plan how to raise the inhabitants’ awareness and not litter during the events and festivals and require them to clean up waste thereafter; in the beginning, it is advisable to set up a group of pioneers to clean up and then raise the inhabitants’ awareness to join hands in cleaning up. Advise the People’s Committee of Ho Chi Minh City to promulgate regulations and provide consistent guidance for Departments, agencies, the People’s Committees of 24 districts.

b) Depending on branches and management levels, Departments, agencies, the People’s Committees of 24 districts shall spread advocacy messages, motivate and require the residents who join events and festivals to clean up waste thereafter.

3.3. The Department of Agriculture and Rural Development:

a) Cooperate with the People’s Committees of districts in instructing collection, transportation, and treatment of plant protection product packages after use; raise the inhabitants’ awareness to limit the uncontrolled waste disposal at fields and canals causing environmental pollution. Include environmental protection activities in the action month to respond favorably to the National Week of Clean Water and Environment Hygiene.

b) Cooperate with the Plant Protection Department in initiating the Plan to protect environment with farmers in districts engaging in agriculture, and raising inhabitants’ awareness in agricultural production towards reducing the use of chemical plant protection products, building ecosystem “planting flowers on the edge of the paddy field” and reducing environmental pollution.

c) Combine and guide details to collect and treat animal feed packages, wastewater treatment substances and discharges in aquaculture and guide details to inspect, evaluate, classify conditions for quality assurance of establishments which manufacture and trade aquaculture feed, environmental remediation products used in aquaculture, aquatic breeds and aquaculture establishments in the city.

d) Collect and treat animals not meeting veterinary hygiene requirements, destroy pathogens, prevent the spread of pathogens to the environment, contribute to environmental protection in agricultural production.

3.4. The People’s Committees of 24 districts:

a) Rearrange the private garbage collection units and change the vehicles used for collection and transportation of municipal solid waste; ensure that by 2020 the conversion from private garbage collection units into businesses or cooperatives with legal status will be completed.

b) Arrange a consistent garbage collection time between the residents, garbage collectors and garbage trucks; guide and require households which live and do business on the street sides, households leasing out premises on the street sides, vendors on the pavements to have their own rubbish containers or areas, and not litter on streets and in front of the manholes; keep street shoulders and pavements clean and preserve urban aesthetics; require households who lease out boarding houses and accommodation to commit to keep surrounding environment clean, store and put out garbage to the garbage collector as prescribed. By December 2019, households which live and do business on the street sides must take responsibility for hygiene on surrounding pavements and street sides, the People’s Committees of districts shall undertake inspection visits on a regular basis and take actions against violations, send reports on environmental hygiene before and after this task to the People’s Committee of Ho Chi Minh City in preliminary and summing-up sessions regarding implementation of Directive No. 19.

c) Review and release statistics on current conditions and locations of public toilets, public garbage containers in the districts to call on private sector involvement in accordance with guidelines of the Department of Natural Resources and Environment.

d) Review and completely deal with garbage hotspots in the districts before November 30, 2019, send detailed reports (list of garbage hotspots, pictures taken before and after remediation, etc.) to the Department of Natural Resources and Environment for consolidation; and the People’s Committees of districts must maintain environmental hygiene at the areas concerned after pollution remediation. Depending upon actual circumstances and the need of local governments, garbage hotspots may be renovated into community areas.

4. Dealing with all matters concerning encroachments upon canals, drainage gates, manholes and littering on canals:

4.1. The Department of Construction:

a) Take charge and cooperate with the People’s Committees of districts and relevant units in dealing with partial inundation points in a timely manner and prevent new inundation points; accelerate progress of anti-flooding projects in the city.

b) Closely cooperate with the People’s Committees of districts in inspecting and taking actions against buildings and houses encroaching drainage gates, manholes and the system of rivers, canals in the city; report the performance results of districts from 2017 until now to the People’s Committee of Ho Chi Minh City to assign inspection delegations to conduct secondary check in August 2019.

c) Make a final report on current conditions of 5 main systems of drainage canals for urban areas and propose the People’s Committee of Ho Chi Minh City to assign tasks to competent units in management and supervision of garbage dumping on these canals, ensure the natural drainage and contribute to the flood reduction in the city.

d) Take charge and cooperate with the Department of Transport, the Department of Agriculture and Rural Development in planning canal dredging until 2020 and conduct the dredging and maintenance of canal and drainage system, and then hand over them to districts, wards, communes, and town for further management.

4.2. The People’s Committees of 24 districts:

a) Cooperate with relevant units and adopt remedial measures against frequently flooded areas due to rain and high tide in the district.

b) Review and release statistics on locations encroaching drainage gates, manholes and systems of canals in the district; make detailed plan for inspecting and taking actions against buildings and houses encroaching drainage gates, manholes and systems of canals in the district; adopt solutions to prevent discharging waste into the canals and re-encroachments and pollution upon corridors of rivers and canals in the city.

5. Initiating and maintaining the system to receive environment-related reports; build database to manage, inspect and deal with violations related to environment hygiene:

5.1. The Department of Information and Communications supporting and guiding the People’s Committees of districts, wards, communes and towns to initiate and maintain the system to receive environment-related reports and build software to manage database in the city.

5.2. The People’s Committees of districts:

a) Set up hotlines for the People’s Committees of districts to answer and deal with reports of the citizens about environmental hygiene; assign specific tasks to relevant units to deal with these reports on a timely basis.

b) Initiate and maintain the system to receive environment-related reports in the district; build database to manage, inspect and deal with violations related to environment hygiene.

6. Intensifying inspection and actions against violations related to environment hygiene in public areas, vendors’ encroaching pavements and roads, encroachments upon drainage gates and manholes, manhole blockage and encroachments of facilities upon canals:

6.1. The Department of Justice shall take charge and cooperate with the Department of Natural Resources and Environment and relevant units in studying the legality of proposed solutions and present the People’s Committee of Ho Chi Minh City satisfactory solutions to reinforce actions against violations of environmental hygiene in public areas; study the proposed solution in form of community service against violations regulations on public hygiene.

6.2. The Department of Home Affairs shall take charge and cooperate with relevant departments in reviewing organizational structure and operation of urban order management teams and construction inspection teams; request the People’s Committee of Ho Chi Minh City to assign it functions and tasks related to environment protection as mentioned in the Official Dispatch No. 1478/UBND-DT dated April 19, 2019.

6.3. The People’s Committees of 24 districts:

a) Assign tasks to the urban order management teams and construction inspection teams to inspect and take administrative offense reports in public areas, undertake regular and surprise visits to garbage dumps at residential areas to ensure environmental hygiene under direction of the People’s Committee of Ho Chi Minh City mentioned in the Official Dispatch No. 1478/UBND-DT dated April 19, 2019.

b) Review the use of GPS on means of transportation and surveillance cameras at intermediate stations of municipal solid waste of the district to manage the service provision effectiveness. Use traffic cameras and security cameras to supervise environmental hygiene on streets.

c) Undertake periodic and surprise inspection visits and strictly take actions against administrative violations related to environmental hygiene in public areas of the district.

7. Initiating solutions to reduce the use of disposable plastic bags and plastic products in the city:

7.1. Departments, agencies, the People’s Committees of districts and relevant units shall implement the Plan No. 3098/KH-UBND dated July 29, 2019 of the People’s Committee of Ho Chi Minh City on conducting Campaign “Anti-plastic waste” in Ho Chi Minh City for the period of 2019-2021 in an effective manner.

7.2. The Department of Natural Resources and Environment:

a) Compile and develop communications materials (taglines, advocacy messages) and send them to Departments, agencies, local governments for printing; initiate the signing with Departments, agencies, and organizations to conduct the Campaign “Anti-plastic waste” in the city.

b) Include the advocacy messages about negative impact of plastic waste, non-biodegradable plastic bags into annual communication program of environment protection and response to climate change.

c) Monitor and expedite Departments, agencies, the People’s Committees of districts to initiate the Plan No. 3098/KH-UBND dated July 29, 2019 of the People’s Committee of Ho Chi Minh City in an effective manner.

7.3. The Department of Industry and Trade

a) Spread advocacy messages to companies in the distribution system (markets, supermarkets, shopping malls); recommend the use of biodegradable and eco-friendly bags and plastic bags.

b) Adopt solutions to achieve the objective that by October 2020 and no later than December 31, 2020, 100% of supermarkets, shopping malls, convenience stores, bookstores, etc. must use eco-friendly bags in substitution of non-biodegradable plastic bags; sellers at traditional markets must reduce 50% of non-biodegradable plastic bags to pack goods and articles for customers. Send progress reports and performance results regarding implementation of Directive No. 19 to the People’s Committee of Ho Chi Minh City in preliminary and summing-up sessions.

7.4. The Department of Science and Technology shall apply science and technology to increase output, improve quality and design, and reduce production costs of eco-friendly bags.

7.5. The Department of Taxation of Ho Chi Minh City shall reinforce the inspection, control, and formulation of mechanism to take actions against violations committed by establishments which produce and trade plastic bags under regulations of the Law on Environment Protection Tax.

7.6. The People’s Committees of districts:

a) Keep implementing direction of the People’s Committee of Ho Chi Minh City in the Official Dispatch No. 2061/UBND-DT dated May 11, 2018 on reduction in use of non-biodegradable plastic bags in the city: Make a plan for investigation and survey of facilities which buy, recycle and treat plastic bags in the district under guidance of the Department of Natural Resources and Environment; evaluate the plastic bag recycling technology, control the pollution levels of these facilities to produce solutions to closely manage the system of existing facilities buying and recycling scrap and waste in the city.

b) Regularly inspect and supervise organizations and household businesses engaging in production and import of non-biodegradable plastic bags; enterprises which produce biodegradable plastic bags and eco-friendly bags in the district, and make certain that they comply with the Law on Environment Protection and its guiding documents.

8. Reviewing, formulating and promulgating criteria and procedures for awarding civilized titles in connection with the Campaign and civilized titles to motivate all walks of life to conduct the Campaign in an effective manner:

The Department of Culture, Sports and Tourism shall take charge and cooperate with Departments, agencies, the People’s Committees in advising the People’s Committee of Ho Chi Minh City in promulgating and initiating the following matters:

- Promulgate criteria and procedures for recognizing qualified neighborhoods and awarding the title “Clean neighborhoods do not litter on streets and canals”; recognizing qualified wards, communes, and towns and awarding the title "Wards, communes, towns do not litter on streets and canals”, recognize and publish a list of qualified units in October 2019, April 2020 and September 2020.

- Promulgate civilized criteria in combination with implementation of Directive No. 19 and initiate the supervision, evaluation and recognition of civilized titles.

9. Praising, raising public awareness and expanding models, solutions to initiate the Campaign in an effective manner:

9.1. The Department of Natural Resources and Environment:

a) Cooperate with the Department of Home Affairs in proposing suitable commendation given to individuals and groups which implement Directive No. 19 effectively.

b) Advise the People’s Committee of Ho Chi Minh City to recognize and give commendation to key projects in implementation of Directive No. 19 achieving good performance on the occasion of major holidays (such as: 45th anniversary of the Liberation of South Vietnam and national reunification; celebration of 11th City Party Congress, etc.)

9.2. The Department of Home Affairs shall combine the Campaign to criteria and standards for annual emulation movement and commendation of units.

9.3. The People’s Committees of 24 districts:

a) Maintain and expand good models and practices in favor of the Campaign to motivate the inhabitants in residential areas to carry out a thorough cleaning on routes and valleys in the district.

b) Mobilize households, agencies and units to join in “Green Sunday”, “Voluntary Saturday”, “15 minutes for a civilized, clean, beautiful city” on a weekly basis to clean and collect garbage and maintain hygiene in these places.

c) Commend typical model individuals and groups that have achieved good performance in this Campaign in the district.

10. Funding:

The Department of Finance shall take charge and cooperate with Departments, agencies, the People’s Committees in advising the People’s Committee of Ho Chi Minh City to make budget estimates for the tasks assigned to implement Directive No. 19.

IV. IMPLEMENTATION

1. Request the Heads of Departments, agencies, the People’s Committees of 24 districts to keep performing the tasks assigned in the Plan issued together with the Decision No. 787 and this Plan to implement Directive No. 19 effectively.

2. Reporting:

2.1. Period: every 6 months, reporting year. In specific:

a) October 2019: preliminary report of 1 year of implementation.

b) April 2020: preliminary report of 1.5 year of implementation.

c) October 2020: final report of 2 years of implementation.

2.2. Content: performance results of the tasks assigned in the Plan issued together with the Decision No. 787 and this Plan.

2.3. Assign the Department of Natural Resources and Environment to act as a centralized unit, expedite Departments, agencies, the People’s Committees of 24 districts to perform the assigned tasks and send reports on performance results to the People’s Committee of Ho Chi Minh City within the required time.

3. The difficulties that arise during the implementation must be reported to the People’s Committee of Ho Chi Minh City for consideration./.
