CIRCULAR
PROMULGATION OF NATIONAL TECHNICAL REGULATION ON ENVIRONMENT
Pursuant to the Law on Technical Standards and Regulations dated June 29, 2006;
Pursuant to the Law on Environmental Protection dated June 23, 2014;
Pursuant to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 on elaboration of some Articles of the Law on Technical Standards and Regulations;
Pursuant to the Government’s Decree No. 21/2013/ND-CP dated March 04, 2013 defining functions, tasks, entitlements and organizational structure of the Ministry of Natural Resources and Environment;
At the request of Director General of Vietnam Environment Administration, Director of Department of Science and Technology, Director of Department of Legal Affairs;
The Minister of Natural Resources and Environment hereby promulgates a Circular on national technical regulation on environment.
Article 1. The national technical regulation on environment:QCVN 08-MT:2015/BTNMT - National technical regulation on surface water quality is promulgated together with this Circular.
Article 2. This Circular comes into force from March 01, 2016.
Article 3. Director General of Vietnam Environment Administration, heads of affiliates of the Ministry of Natural Resources and Environment, Directors of Departments of Natural Resources and Environment of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular./.

Foreword
QCVN 08-MT:2015/BTNMT is prepared by the Drafting Committee for national technical regulation on surface water quality,submitted by the Vietnam Environment Administration, Department of Science, Technology and Environment and Department of Legal Affairs to obtain approval from, and issued as an appendix to the Circular No. 65/2015/TT-BTNMT dated December 21, 2015 by, the Ministry of Natural Resources and Environment.
NATIONAL TECHNICAL REGULATION ON SURFACE WATER QUALITY
1. GENERAL PROVISIONS
1.1. Scope
1.1.1. This document provides for Maximum permissible limits of surface water quality parameters.
1.1.2. This document is applied to:
- assess and control the quality of surface water, which serves as the basis for protecting and using water in an appropriate manner.
- serve as a basis for formulating and approving the water use planning based on determined purposes.
- assess the conformity of surface water quality with the approved water use planning.
- serve as the basis for controlling sources discharged into receiving water to ensure that the surface water conforms to purposes.
- serve as the basis for adopting measures for improving and restoring water quality.
1.2. Definitions
“surface water” means water flowing through or stagnating on the ground, rivers, streams, canals, ditches, lakes, ponds, lagoons, etc.
2. SPECIFICATIONS
Maximum permissible limits of surface water quality parameters are provided in Table 1.

Note:
Surface water is classified into four categories: A1, A2, B1 and B2in order to assess and control water quality, thereby serving various water purposes. Those categories are sorted in descending order.
A1 - Used for supplying domestic water (after being commonly treated) or conserving aquatic animal and plants and other purposes included in Categories A2, B1 and B2.
A2- Used for supplying domestic water but the application of an appropriate treatment technology is required or other purposes included in Categories B1 and B2.
B1 - Used for irrigated agriculture or other purposes that require similar water quality or purposes included in Categories B2.
B2 - Used for waterway and other purposes that require low water quality.

3.2. It is allowed to use the analytical methods specified in other national and international standards that have the accuracy equivalent to or higher than those specified in the standards in Section 3.1.
4. IMPLEMENTATION
4.1. This document supersedes QCVN 08:2008/BTNMT - National technical regulation on surface water quality that is promulgated in the Decision No. 16/2008/QD-BTNMT dated December 31, 2008 of the Minister of Natural Resources and Environment.
4.2. QCVN 38:2011/BTNMT - National technical regulation on Surface Water Quality for protection of aquatic lifes and QCVN 39:2011/BTNMT - National technical regulation on Water Quality for irrigated agriculture that are promulgated in the Circular No. 43/2011/TT-BTNMT dated December 12, 2011 of the Minister of Natural Resources and Environment are null and void from the effective date of this document.
4.3. Environment authorities shall provide guidelines, inspect and supervise the implementation of this document.
4.4. In the cases where any of the standards referred to in Section 3.1 is amended or replaced, the newest one shall apply.
