CIRCULAR
ON VIETNAM ENVIRONMENTAL AWARD
Pursuant to the Law on Environmental Protection No. 55/2014/QH13 dated June 23, 2014;
Pursuant to the Law on Emulation and Commendation No. 15/2003/QH11 dated November 26, 2003; the Law on the amendments to the Law on Emulation and Commendation No. 47/2005/QH11 dated June 14, 2005; the Law on the amendments to the Law on Emulation and Commendation No. 39/2013/QH13 dated November 16, 2013;
Pursuant to the Decree No. 42/2010/ND-CP dated April 15, 2010 on guidelines for the Law on Emulation and Commendation and the Law on the amendments to the Law on Emulation and Commendation; the Government's Decree No. 39/2012/ND-CP dated April 27, 2012 on amendments to Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government;
Pursuant to the Government's Decree No. 65/2014/ND-CP dated July 1, 2014 on guidelines for the Law on the amendments to the Law on Emulation and Commendation 2013;
Pursuant to the Government's Decree No. 19/2015/ND-CP dated February 14, 2015 on guidelines for the Law on Environment Protection;
Pursuant to the Government's Decree No. 21/2013/ND-CP dated March 14, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Natural Resources and Environment;
At the request of Director General of Vietnam Environment Administration, Director of Department of Emulation, Commendation and Propagation and Director of the Legal Department;
The Minister of Natural Resources and Environment promulgates a Circular on Vietnam Environmental Award,
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular sets forth principles, criteria, scoring system, conditions, procedures for evaluation and giving of Vietnam Environmental Award (hereinafter referred to as Award).
Article 2. Regulated entities
This Circular applies to Vietnamese and foreign organizations, individuals and communities that have remarkable achievements in the cause of environment protection in Vietnam.
Article 3. Interpretation of terms
For the purpose of this Circular, the following term shall be construed as follows:
1. Organizations include state administrative agencies, public sector entities, enterprises, political organizations, socio-political organizations, domestic socio-professional organizations and organizations of foreigners which have legal status and have legally operated in Vietnam’s territory.
2. Individuals include Vietnamese people and foreigners who have civil legal capacity and have not being undergone judgment/verdict enforcement as per the law.
3. Communities include groups of inhabitants living in the Vietnam’s territory.
Article 4. Principles of evaluation
1. The evaluation must be carried out with eligible entities, following the conditions and procedures prescribed in this Circular, and in an accurate, open and impartial manner.
2. The Award is given to recognize and honor organizations, individuals and communities who make notable contributions to the cause of environmental protection.
3. A winner of the Award shall not be eligible for evaluation of the subsequent Award.
4. In an Award evaluation process, each candidate may be only given 01 Award (regardless of collective or individual candidate).
Article 5. Form, number and classification of awards
1. Vietnam Environmental Award is a single award of the Ministry of Natural Resources and Environment, intended for honoring organizations, individuals, and communities who gain outstanding achievements in the cause of environmental protection in Vietnam and are eligible for award evaluation as prescribed in Article 6 of this Circular.
2. The Award shall be evaluated biennially.
3. The following 6 groups of sectors shall be considered for the Award:
a) State management of environment protection;
b) Education and training, communications; consultation, counseling, criticism, and supervision of policies and law on environmental protection;
c) Research and application of advanced science and technology in environment protection;
d) Preventing and diminishing negative impact on environment, handle incidents, deal with pollution, rehabilitation and improvement of environment;
dd) Protecting and reasonably using natural resources, conserve biodiversity and biological safety;
e) Implementing green growth strategy, responding to climate change.
4. Number and structure of awards:
a) Number of awards: up to 50 awards, classified into 3 categories: organizations, individuals and communities in the sectors eligible for evaluation are classified into 6 groups prescribed in Clause 3 of this Article;
c) Structure of awards: 3 categories and 6 groups of entities proposed by the organizing board shall be subject to decision of the Minister in every award evaluation period.
Chapter II
AWARD-GIVING CONDITIONS AND EVALUATION PROCESS
Article 6. Award-giving conditions
Organizations, individuals and communities submitting applications for award must meet the following conditions:
1. Regarding organizations
a) They have been operating and running business in Vietnam and have not violated any regulation of the Law on Environment protection and other regulations of law of Vietnam for at least 4 (four) years until the date of submission of award application;
b) They submit applications on a voluntary basis or they are introduced by an agency, union, socio-political organization, or socio-professional organization to engage in award evaluation process;
c) They have outstanding achievements which have been socially recognized and achieve success in at least a particular environmental issue or make progress in environment protection in one of the sectors eligible for award evaluation as prescribed in Clause 3 Article 5 of this Circular;
2. Regard individuals and communities
a) They have not violated regulations of the Law on Environment protection and other regulations of law of Vietnam for at least 3 (three) years until the date of submission of award application;
b) They submit applications on a voluntary basis or they are introduced by an agency, union, socio-political organization, or socio-professional organization to engage in award evaluation process;
c) They gain outstanding achievements and play a typical example for the people to follow in one of the sectors eligible for award evaluation as prescribed in Clause 3 Article 5 of this Circular;
Article 7. Criteria and scoring system
Organizations, individuals and communities shall be evaluated for awards according to the following criteria and scoring system:
1. Regarding organizations
a) Contribution to the cause of environmental protection: up to 40 points;
b) Socio-economic effectiveness: up to 30 points;
c) Impact scope: up to 15 points;
d) Continuity and impact duration: up to 10 points;
dd) Gaining achievements in environment protection in remote and isolated areas: 5 points.
2. Regard individuals and communities
a) Contribution to the cause of environmental protection: up to 40 points;
b) Socio-economic effectiveness: up to 30 points;
c) Typical example and impact upon community: up to 15 points;
d) Creativity: up to 10 points;
dd) Gaining achievements in environment protection in remote and isolated areas, disabled people, ethnics: 5 points.
Article 8. Applications for awards
1. An application form for award using the form in Appendix 1a (in case of organizations) or 1b (in case of individuals) or 1c (in case of communities) enclosed herewith.
2. An achievement report according to evaluation criteria for award prescribed in Article 7 of this Circular shall be established using the form in Appendix 2a (in case of organizations) or 2b (in case of individuals) or 2c (in case of communities) enclosed herewith. The achievement report must bear the certification of superior ministry, agency, central union or certificate of Department of Natural Resources and Environment of province and central-affiliated city where the organization, individual and community having outstanding achievements in the cause of environment protection.
3. Documents proving the achievements, application in reality in the sectors eligible for award evaluation prescribed in Clause 3 Article 5 of this Circular enclosed with the following documents (if any): certificates of merit, certificates of achievements, initiative, creativeness in environment sector, images, discs justifying remarkable achievements of organizations, individuals and communities in environment protection, and documents proving their observance to Vietnam’s regulations on environment protection.
4. Two (2) photos, 4x6 size of the individual, symbol of the organization, or photo of the agency’s staff.
Article 9. Award evaluation process and award decision
1. 2 sets of application shall be made and sent to the standing board of award (Vietnam Environment Administration) before March 30 of the year of award.
2. Vietnam Environment Administration shall receive submission and verify eligibility of the application; if the application is ineligible, Vietnam Environment Administration shall require the applicant to complete the application within 15 working days from the date of submission.
3. Vietnam Environment Administration shall classify the applications by each sector eligible for award and transfer them to the Award Committee at least 10 working days before the first meeting of the Committee.
4. The award evaluation shall be organized two rounds:
First round: The Committee is composed of sub-committees by groups of sectors for award evaluation; the Chairperson shall decide the establishment of sub-committees and classify applications for sub-committees. Members of sub-committees shall receive applications, evaluate, discuss and grade each application according to the criteria prescribed in Article 9 of this Circular. After considering, evaluating and calculating average score of each application, sub-committees shall consolidate and prepare a list of candidates with average score of at least 70 points to be further considered in the second round.
Second round: The Committee shall work as a group to consider every application getting at least 70 points, which is consolidated and submitted to the Committee by the Secretary Board. Members of Committee shall receive applications, evaluate, discuss and grade each application according to the criteria prescribed in Article 7 of this Circular.
The difference of score graded by members of the Committee of the same application may not exceed 20 points; if the difference of score for the same application exceeds 20 points, the Committee shall discuss and pass the plan for calculating the average score by voting. After considering, evaluating and calculating the average score of each application, the Committee shall make a list of eligible candidates to give awards by order from highest score to lowest score.
5. According to the list proposed by the Committee, the standing board of award affiliated to Vietnam Environment Administration shall cooperate with the standing board of Council of Emulation and Commendation affiliated to the Ministry of Natural Resources and Environment in verifying, assessing and completing applications and submitting applications to the Minister of Natural Resources and Environment for consideration of awards to the candidates.
Article 10. Award Committee
1. The Award Committee shall be established by the Minister of Natural Resources and Environment (hereinafter referred to as the Committee). The Committee is composed of at least 15 members. The Committee is tasked to help the Minister of Natural Resources and Environment to select candidates having outstanding achievements in the cause of environmental protection, and then request the Minister to consider granting the awards.
2. The Committee is composed of the Chairperson, Deputy Chairperson and members, in specific:
a) Chairperson: the head of the Ministry of Natural Resources and Environment;
b) Standing Deputy Chairperson: Director General of Vietnam Environment Administration:
a) Deputy Chairperson: Director of Department of Emulation, Commendation and Propagation:
d) Members of Committee include:
- Representative of the Ministry of Science and Technology, member;
- Representative of Vietnam Chamber of Commerce and Industry, member;
- Representative of news agencies, central presses, member;
- Representative of socio-political organizations, socio-professional organizations, member;
- Head of Inspectorate of the Ministry of Natural Resources and Environment, member;
- Other members of the Committee who are experts, managers, education scientists in the sectors eligible for award evaluation.
dd) Secretary Board shall be established by Director General of Vietnam Environment Administration.
3. Chairperson or Standing Deputy Chairperson shall preside over meetings of the Committee. The Committee shall work as a group. A meeting of the Committee must be attended by at least two third of participants. A decision of the Committee is only effective if it is passed by at least third fourth of the Committee’s members.
4. The Chairperson may authorize the Standing Deputy Chairperson to run the operation of the Committee; the Chairperson shall, on behalf of the Committee, report the Minister of Natural Resources and Environment on working result and proposals of the Committee concerning the award-giving.
Chapter III
AWARD CEREMONY AND FUNDING
Article 11. Award ceremony
1. The award ceremony shall be held on the World Environment Day (June 5) of the award-giving year.
2. The award ceremony shall be conducted in a formal manner and widespread on means of mass media to honor winners of the Award.
Article 12. Funding
1. Funding for the award ceremony shall be set aside from the environmental administrative budget and Vietnam Environment Protection Fund and received from sponsorships of other organizations and individuals for the following:
a) Activities of the Committee, the award standing board, and the Secretary Board;
b) Designing logo of the Award and printing certificates;
c) Holding the award ceremony;
d) Award amount enclosed with the Award.
2. The receipt, management and use of sources of funds shall be done in accordance with applicable provisions.
3. The applicants whose applications for award are submitted may not contribute funding to hold the award ceremony and relevant activities.
Article 13. Benefits of winners
1. The winner shall be given the Certificate of the Minister of Natural Resources and Environment and Logo of the Award.
2. The winner shall be given rewarded in cash or in kind in accordance with applicable regulations and laws.
3. The winner may have their winning product advertised on means of mass media.
4. The winner may utilize and use the Logo of Award since the award-giving date.
5. The winner may print publications to advertise their products in local and international markets.
Article 14. Cancellation of award decision and revocation of award in kind
1. Where a candidate is found untruthful in the application for award, their award decision shall be annulled, and their award in cash or in kind shall be revoked and such candidate may not enjoy benefits of the winner; and pay compensation for any damage caused (if any) as prescribed.
2. The award revocation shall be published on means of mass media.
3. The head of agency nominating the winner shall revoke the award in kind or in cash and transfer them to the award standing board.
Chapter IV
IMPLEMENTATION
Article 15. Entry in force
1. This Circular comes into force as of February 1, 2016.
2. This Circular supersedes Circular No 13/2010/TT-BTNMT dated July 28, 2010 of the Minister of Natural Resources and Environment on Vietnam Environmental Award
Article 16. Implementation
1. Vietnam Environment Administration shall act as the award standing board, take charge and cooperate with the Department of Emulation, Commendation and Propagation and units affiliated to the Ministry of Natural Resources and Environment in performing the following tasks:
a) Planning and raising public awareness of the Award;
b) Take charge and cooperate with Natural Resource and Environment Journal and Environment Magazine in promoting, guiding and directing organizations, individuals, and communities to participate in the Award evaluation as per the law.
c) Announce the Award evaluation criteria; receive applications for Award; request the Minister of Natural Resources and Environment to establish the Award Committee and submit the list of eligible candidates for the Award; hold the award ceremony and announce priority themes and sectors of the subsequent award.
2. The heads of affiliated entities of the Ministry of Natural Resources and Environment and Director of Department of Natural Resources and Environment of provinces and central-affiliated cities shall implement this Circular.
3. The difficulties that arise during the implementation must be reported to Vietnam Environment Administration affiliated to the Ministry of Natural Resources and Environment for consideration./.
