CIRCULAR

NATIONAL TECHNICAL REGULATION ON ENVIRONMENTAL TREATING PRODUCTS IN AQUACULTURE

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Quality of Products and Goods dated November 21, 2007;

Pursuant to the Law on Fisheries dated November 21, 2017;

Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 127/2007/CP-ND dated August 01, 2017 on elaboration of the Law on Standards and Technical Regulations;

Pursuant to the Government’s Decree No. 132/2008/CP-ND dated December 31, 2008 on elaboration of the Law on Quality of Products and Goods;

Pursuant to the Government’s Decree No. 74/2018/CP-ND dated May 15, 2018 on amendments to the Government’s Decree No. 132/2008/CP-ND dated December 31, 2008 on elaboration of the Law on Quality of Products and Goods;

Pursuant to the Government’s Decree No. 26/2019/ND-CP dated March 08, 2019 on guidelines for implementation of the Law on Fisheries;

At the request of the Director of the Department of Science, Technology and Environment and the Director General of the Directorate of Fisheries;

The Minister of Agriculture and Rural Development hereby promulgates the National technical regulation on environmental treating products in aquaculture.

Article 1. Promulgated together with this Circular is the National technical regulation on environmental treating products in aquaculture.

Part 2: Mineral mixture, vitamin mixture.

Article 2. Effect

1. This Circular comes into force from July 01, 2020.

2. Domestic manufacturers of mineral mixture, vitamin mixture and mineral – vitamin mixture used for environmental treatment in aquaculture specified in this Regulation shall follow procedures for conformity declaration as of January 01, 2021.

Article 3. The Chief of the Office of the Ministry of Agriculture and Rural Development; the Director of the Department of Science, Technology and Environment; the Director General of the Directorate of Fisheries; Heads of relevant units affiliated to the Ministry of Agriculture and Rural Development; Directors of Departments of Agriculture and Rural Development of provinces and central-affiliated cities, and relevant organizations and individuals are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for consideration./.

Foreword

QCVN 02-32-2:2020/BNNPTNT is prepared by the Research Institute for Aquaculture No. 1, submitted by the Directorate of Fisheries and promulgated by the Ministry of Agriculture and Rural Development together with the Circular No. 03/2020/TT-BNNPTNT dated March 02, 2020.

NATIONAL TECHNICAL REGULATION ON ENVIRONMENTAL TREATING PRODUCTS IN AQUACULTURE.

PART 2: MINERAL MIXTURE, VITAMIN MIXTURE

1. GENERAL

1.1. Scope

This Regulation provides for safety criteria and permissible limits for mineral mixture, vitamin mixture and mineral – vitamin mixture used for environmental treatment in aquaculture (HS code 2842.90.90).

1.2. Regulated entities

This Regulation applies to organizations and individuals involved in manufacturing and import of mineral mixture, vitamin mixture and mineral – vitamin mixture used for environmental treatment in aquaculture in Vietnam.

1.3. Normative references

EN 16277:2012. Animal feeding stuffs - Determination of mercury by cold-vapour atomic absorption spectrometry (CVAAS) after microwave pressure digestion (extraction with 65 % nitric acid and 30 % hydrogen peroxide)

TCVN 7924 - 2: 2008. Microbiology of food and animal feeding stuffs - Horizontal method for the enumeration of β-glucuronidase-positive Escherichia coli - Part 2: Colony-count technique at 44°C using 5-bromo-4-chloro-3-indolyl β-D-glucuronide.

TCVN 8126:2009. Foods - Determination of lead, cadmium, zinc, copper, and iron - Atomic absorption spectrophotometry after microwave digestion.

TCVN 9588:2013 (ISO 27085:2009). Animal feeding stuffs - Determination of calcium, sodium, phosphorus, magnesium, potassium, iron, zinc, copper, manganese, cobalt, molybdenum, arsenic, lead and cadmium by ICP-AES.

TCVN 10643:2014 (AOAC 999.11). Foodstuffs - Determination of lead, cadmium, copper, iron, and zinc - Atomic absorption spectrophotometric method after dry ashing.

TCVN 10780-1:2017 (ISO 6579-1:2017). Microbiology of the food chain - Horizontal method for the detection, enumeration and serotyping of Salmonella - Part 1: Detection of Salmonella spp.

1.4. Definitions

For the purposes of this Regulation, the terms below shall be construed as follows:

1.4.1. “mineral mixture” means a mixture of single minerals and carriers.

1.4.2. “vitamin mixture” means a mixture of single vitamins and carriers.

1.4.3. “mineral - vitamin mixture” means a mixture of single minerals, single vitamins and carriers.

2. TECHNICAL REQUIREMENTS

2.1. Mineral mixture

3. TEST METHODS

3.1. Sampling

Samples shall be collected for testing purpose in accordance with regulations laid down by the Ministry of Agriculture and Rural Development or National technical regulation or National standard on sampling of environmental treating products in aquaculture.

3.2. Preparation of samples

According to TCVN 6952: 2001 (ISO 9498:1998). Animal feeding stuffs – Preparation of test samples.

3.3. Test methods

(1)Test methods that have been amended or replaced or other test methods that are pre-determined in accordance with law are acceptable.

4. REGULATORY REQUIREMENTS

4.1. Declaration of conformity

4.1.1. Conformity declaration methods

Organizations and individuals shall declare conformity of mineral mixture, vitamin mixture and mineral - vitamin mixture used for environmental treatment in aquaculture as follows:

4.1.1.1. Regarding domestically manufactured products, the certification result given by the certification body registered or accredited as prescribed by law shall be sent.

4.1.1.2. Regarding imported products, the certification or assessment result given by the certification body or the conformity assessment body registered or accredited as prescribed by law shall be sent.

4.1.2. Conformity declaration procedures

Conformity declaration procedures and documents submitted for declaration of conformity are set out in Clauses 3 and 4 Article 1 of the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Ministry of Science and Technology.

Departments of Agriculture and Rural Development of provinces and central-affiliated cities shall receive documents submitted for declaration of conformity by organizations and individuals registering their manufacturing and trading within provinces and cities.

4.2. Conformity assessment

4.2.1. Conformity assessment methods

Organizations and individuals shall assess conformity of mineral mixture, vitamin mixture and mineral - vitamin mixture used for environmental treatment in aquaculture as follows:

4.2.1.1. Regarding domestically manufactured products, Method 5 (Testing a representative sample and assessment of the manufacturing process; carrying out supervision by testing samples collected from the place of manufacturing or on the market in association with assessment of the manufacturing process) shall be adopted.

The manufacturer that has been issued with the certificate of eligibility to manufacture environmental treating products in aquaculture that remains effective is not required to undergo assessment of the manufacturing process.

4.2.1.2. Regarding imported products, Method 7 (Testing and assessment of a shipment of products/goods) shall be adopted.

4.2.2. Conformity assessment procedures

Contents, sequence and principles of using conformity assessment methods are specified in the Appendix II attached to the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

Organizations and individuals mentioned in Section 1.2 shall comply with regulations of the present document.

6. IMPLEMENTATION

6.1. The Directorate of Fisheries and Departments of Agriculture and Rural Development of provinces and cities shall inspect the implementation of this Regulation as assigned by the Ministry of Agriculture and Rural Development.

6.2. The Directorate of Fisheries shall disseminate and provide guidance on the implementation of this Regulation.

6.3. In the cases where any of the regulations referred to in this document is amended or replaced, the newest one shall apply.
