Decision No. 643/QD-TLD dated May 22, 2020 on regarding financial support to unionists and employees impacted by COVID-19

DECISION

REGARDING FINANCIAL SUPPORT FOR UNIONISTS AND EMPLOYEES IMPACTED BY COVID-19

PRESIDIUM OF VIETNAM GENERAL FEDERATION OF LABOUR

- Pursuant to the 2012 Law on Trade Unions;

- Pursuant to the 2015 Law on State Budget;

- Pursuant to the 2018 Regulations of Vietnam Trade Union;

- Pursuant to the Decision No. 1610/QD-TLD dated October 22, 2019 of the Presidium of the General Confederation regarding Regulations on principles of making and allocating costs included in the 2020 trade union financial estimate;

- Pursuant to the Decision No. 180/QD-TLD dated February 5, 2020 of the Presidium of the General Confederation regarding approval of the 2020 trade union financial estimate;

- Pursuant to the Notice No. 68/TB-TLD dated May 7, 2020 of the Vietnam General Federation of Labour regarding conclusions drawn in the regular meeting of the standing Presidium of the Vietnam General Confederation of Labour held on May 5, 2020;

- In the light of the request from the Finance Department or the Labor Relation Department of the Vietnam General Federation of Labour.

HEREBY DECIDES

Article 1. To offer financial support to unionists and employees impacted by COVID-19.

1. Funding resources: Financial support is funded by the accumulated financial sources of the Confederations of Labor of provinces and cities; central sectoral and equivalent-level Trade Unions; Trade Unions of Corporations or General Companies directly controlled by Vietnam General Confederation of Labor and grassroots-level directly superior trade unions. Total maximum funding for financial support shall not exceed 50% of provisional or contingency budget according to the decision on allocation of costs included in the 2020 financial estimate of the Presidium of the Vietnam General Confederation of Labor.

2. Beneficiaries:

2.1. Unionists and employees suffering loss or lack of employment due to the COVID-19 pandemic resulting in the situation that their income is lost, is equal or less than the base pay level prescribed in currently applicable regulations (VND 1,490,000/month), or facing difficulties at the time of consideration of support, but not qualify for the aid package under the Government’s Resolution No. 42/NQ-CP dated April 9, 2020 regarding measures to support people in hardship due to the COVID-19 pandemic (Resolution No. 42/NQ-CP).

2.2. Unionists and employees already entitled to support under the Government's Resolution No. 42/NQ-CP, but in extreme hardship, especially the following target beneficiaries:

a. Female employees who are pregnant from the 7^th month or more, or who are currently raising children under 6 months old.

c. Handicapped or occupationally injured unionists who have not yet received any benefit.

d. Those facing other hardship situations directly impacting their labor capacity, health and life, etc.

3. Each beneficiary shall be entitled to the one-off payment of VND 500,000.

4. Accepted impact period shall range from March 1, 2020 to May 31, 2020.

5. Financial support program shall be executed by July 30, 2020 at the latest.

Article 2. Implementation provisions

1. The Standing Committee of the Labor Confederations of provinces and cities; central sectoral and equivalent-level Trade Unions; Trade Unions of Corporations or General Companies directly controlled by the General Confederation:

- By taking into consideration the funding sources, unionists and employees, providing written guides to implementation of this support program, which specifies the eligibility conditions, application procedures and processes for entitlement to the aid package, and ensuring that these conditions, procedures and processes must be strict and consistent as well as enable correct choice of beneficiaries in really difficult situation.

- Carrying out this support program to ensure publicity, transparency, timeliness and right beneficiaries; bearing responsibility to the Vietnam General Confederation of Labor for any issue or violation arising under the jurisdiction and within the ambit of Corporations or General Companies.

2. The Finance Department shall cooperate with the Labor Relations Department of the Vietnam General Confederation of Labor in urging and guiding the provincial Confederations of Labor; central sectoral and equivalent-level Trade Unions; Trade Unions of Corporations or General Companies directly controlled by the General Confederation, in implementing this Decision.

3. The Inspectorate of the Vietnam General Confederation of Labor shall guide the Inspectorates at all levels to inspect and supervise the implementation of this Decision; directly inspect and superintend the implementation thereof at a number of units.

4. Organizations and individuals shall be strictly forbidden from committing acts of abusing support prescribed herein to seek personal benefits. In case where there is any violation, based on the nature and extent of violation, violating entities and persons shall be disciplined or subject to administrative penalties or criminal prosecution under law.

Article 3. This Decision shall enter into force from the signature date.

The Finance Department, Labor Relations Department, Inspectorate and Office of the General Confederation; Confederations of Labor in cities and provinces; central sectoral and equivalent-level Trade Unions; Trade Unions of Corporations or General Companies directly controlled by the General Confederation, shall be responsible for implementing this Decision./.
