DECISION
APPROVING SCHEME FOR PILOT AUTONOMY IN BACH MAI HOSPITAL FOR 2020 - 2021
THE PRIME MINISTER
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to the Law on Medical Examination and Treatment dated November 23, 2009;
Pursuant to the Government’s Resolution No. 33/NQ-CP dated May 19, 2019 on pilot autonomy in 04 hospitals affiliated to the Ministry of Health;
Pursuant to the Government’s Resolution No. 117/NQ-CP dated December 09, 2019 on Government’s regular meeting of November 2019;
At the request of the Minister of Health and Bach Mai Hospital,
HEREBY DECIDES:
Article 1.The scheme for pilot autonomy in Bach Mai Hospital for 2020 - 2021, with the following contents, is approved:
I. OBJECTIVES
1. Achieve the objectives set in the Government’s Resolution No. 33/NQ-CP dated May 19, 2019 on pilot autonomy in 04 hospitals affiliated to the Ministry of Health (hereinafter referred to as “Resolution No. 33”); especially minimizing unnecessary services, drugs and tests; lowering number of beds for request-based treatment; and reducing payments made by health insurance and patients.
2. Efficiently manage and use capital and property of Bach Mai Hospital, avoiding loss and wastefulness. Develop a high-quality workforce.
3. Improve medical examination and treatment quality, provide comprehensive care and address overload. Gradually build a modern hospital of equal standing to reputable hospitals in the region and around the world, and properly perform the duties of a tertiary hospital.
4. Manage Bach Mai Hospital in a modern and transparent manner with enhanced accountability. Apply information technology in management of all hospital operations, meeting requirements of state agencies and Vietnam Social Security.
II. AUTONOMY IN PERFORMANCE OF PROFESSIONAL DUTIES
Autonomy in performance of professional duties shall be carried out in accordance with regulations in Resolution No. 33 and regulations of law.
III. AUTONOMY IN TERMS OF ORGANIZATIONAL STRUCTURE AND PERSONNEL
1. Autonomy in terms of organizational structure and personnel shall be carried out in accordance with regulations in Resolution No. 33 and regulations of law.
2. The management council of Bach Mai Hospital (hereinafter referred to as “management council”) shall comprise 11 members.
The Minister of Health shall appoint members and head of the management council. The management council shall be the most superior supervisory body of Bach Mai Hospital until the Minister of Health approves of its members according to regulations in Point 3 Section III Article 1 of this Decision.
3. Within 6 months, the management council shall agree on and propose the operating regulation of the management council, members of the management council, and director and deputy directors of Bach Mai Hospital to the Minister of Health for approval.
4. Functions and duties of the management council are provided for in Resolution No. 33 and its operating regulation.
5. Regulations on the Control Board:
a) The Control Board shall consist of 07 members.
b) Standards for, composition of and procedures for election of and approval for the head and members of the Control Board; operating method of the Control Board; and approval for the operating regulation of the Control Board shall be carried out in compliance with regulations in Resolution No. 33.
c) Rights and obligations of the Control Board are provided for in the 2014 Law on Enterprises, operating regulation of Bach Mai Hospital and operating regulation of the Control Board.
6. Organization and leaders of Bach Mai Hospital:
a) Bach Mai Hospital may have member hospitals in accordance with regulations in Resolution No. 33, namely Bach Mai Hospital in Hanoi and Bach Mai Hospital in Phu Ly City, Ha Nam Province.
b) Member hospitals shall be ranked as prescribed by law.
c) Leaders of Bach Mai Hospital include the management council and Board of Directors.
d) Board of Directors of Bach Mai Hospital consists of the director and deputy directors of the hospital.
IV. AUTONOMY IN PROPERTY INVESTMENT, PROCUREMENT, MANAGEMENT AND USE
Property investment, procurement, management and use shall be carried out in compliance with regulations of law on investment (including public investment) in and management and use of public property and Resolution No. 33.
V. AUTONOMY IN TERMS OF FINANCE, WAGES AND MEDICAL SERVICE PRICES
1. Bach Mai Hospital shall exercise the financial autonomy mechanism applicable to public service providers according to regulations of law on public service providers and Resolution No. 33.
2. Distribute income generated within the year in a transparent manner, and increase contributions to the fund for development of professional operations and fund for patient assistance.
3. Bach Mai Hospital may continue to receiving state funding to complete public investment projects of the mid-term public investment plan for 2016 - 2020.
Article 2. Implementation
1. The Minister of Health shall:
a) Perform tasks assigned in the Government’s Resolution No. 33 and Resolution No. 117/NQ-CP dated December 09, 2019 on Government’s regular meeting of November 2019;
b) Promptly resolve issues arising within their competence to ensure proper implementation of Resolution No. 33 and this Decision; and report issues beyond their competence to the Prime Minister.
2. Relevant ministries, central authorities and local governments shall support Bach Mai Hospital in implementing this Decision intra vires.
3. Bach Mai Hospital shall organize the implementation of this Decision; and submit preliminary reports to the Ministry of Health on a biannual basis.
Article 3.This Decision takes effect from the date on which it is signed.
Article 4.Minister of Health, Ministers, heads of ministerial-level agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, heads of relevant bodies and head of the management council of Bach Mai Hospital shall implement this Decision.
