AMENDMENTS TO THE CIRCULAR NO. 16/2010/TT-NHNN DATED JUNE 25, 2010 BY THE GOVERNOR OF THE STATE BANK OF VIETNAM PROVIDING GUIDELINES FOR IMPLEMENTATION OF THE GOVERNMENT’S DECREE NO. 10/2010/ND-CP DATED FEBRUARY 12, 2010 ON CREDIT INFORMATION-RELATED ACTIVITIES

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

Pursuant to the Law on credit institutions dated June 16, 2010 and the Law on amendments to the Law on credit institutions dated November 20, 2017;

Pursuant to the Law on enterprises dated November 26, 2014;

Pursuant to the Law on investment dated November 26, 2014;

Pursuant to the Government’s Decree No. 10/2010/ND-CP dated February 12, 2010 on credit information-related activities and the Government’s Decree No. 57/2016/ND-CP dated July 01, 2016 providing amendments to Article 7 of the Government’s Decree No. 10/2010/ND-CP dated February 12, 2010 on credit information-related activities;

The Government’s Decree 16/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam;

At the request of the Head of the Bank Supervision and Inspection Agency;

The Governor of the State Bank of Vietnam promulgates this Circular to provide amendments to the Circular No. 16/2010/TT-NHNN dated June 25, 2010 by the Governor of the State Bank of Vietnam providing guidelines for implementation of the Government’s Decree No. 10/2010/ND-CP dated February 12, 2010 on credit information-related activities (hereinafter referred to as the Circular No. 16/2010/TT-NHNN).

Article 1. Amendments to the Circular No. 16/2010/TT-NHNN

1. Point c(viii) Clause 1 Article 5 of the Circular No. 16/2010/TT-NHNN (as amended in Clause 4 Article 1 of the Circular No. 23/2016/TT-NHNN dated June 30, 2016 of the Governor of the State bank of Vietnam on amendments to the Circular No. 16/2010/TT-NHNN) is amended as follows:

“viii) The written commitment to provide credit information for enterprises made by the credit institution or branch of foreign bank using Form 04/TTTD enclosed herewith;”

2. The phrase “Ngân hàng thương mại” (“commercial bank”) in Form 04/TTTD enclosed with the Circular No. 16/2010/TT-NHNN is replaced by the phrase “Tổ chức tín dụng, chi nhánh ngân hàng nước ngoài” (“credit institution/ branch of foreign bank").

Article 2. Responsibility for implementation

The Chief of Office, Head of the Bank Supervision and Inspection Agency, heads of relevant units affiliated to the State Bank of Vietnam, Directors of branches of the State Bank of Vietnam in provinces and central-affiliated cities, General Director of National Credit Information Center of Vietnam, Chairpersons of the Boards of Directors, Chairpersons of the Boards of Members and General Directors (Directors) of credit information companies shall implement this Circular.

Article 3. Effect

This Circular comes into force from February 18, 2019./.
