Decision 751/QD-TTg in 2015 approving the pilot project to renovate the operation mechanism of Foreign Trade University in the period 2015 - 2017 issued by the Prime Minister

DECISION

APPROVING THE SCHEME ON PILOT INNOVATION OF OPERATIONAL MECHANISM OF THE FOREIGN TRADE UNIVERSITY DURING 2015 - 2017

THE PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Education dated June 14, 2005 and the Law on amendments to the Law on Education dated November 25, 2009;

Pursuant to the Law on Higher Education dated June 18, 2012;

Pursuant to the Government’s Decree No. 49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP dated July 15, 2013 amending certain articles of the Government’s Decree No. 49/2010/ND-CP dated May 14, 2010 on reduction and exemption of tuition, support for learning cost, collection and use of tuition applicable to educational institutions belonging to the national education system from the 2010 – 2011 academic year to the 2014 – 2015 academic year;

Pursuant to the Government’s Decree No. 16/2015/ND-CP dated February 14, 2015 stipulating the mechanism for exercising the autonomy of public administrative units;

Pursuant to the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017;

Pursuant to the Decision No. 70/2014/QD-TTg dated December 10, 2015 promulgating the University Charter by the Prime Minister;

Considering the request of the President of the Foreign Trade University,

DECIDES

Article 1. To approve the Scheme on the pilot innovation of the operational mechanism of the Foreign Trade University during 2015 – 2017 (referred to as the Scheme) with the following principal contents:

I. OBJECTIVES

1. General objectives

The Foreign Trade University (referred to as “FTU”) shall actively, reasonably and effectively utilize its resources, innovate its managerial system towards modernity, and facilitate the improvement of its scientific research and training quality; aim to become a prestigious and high-quality research and training center in the region and on the world according to the FTU's development objectives and strategies by 2030; provide opportunity to study in FTU for social policy beneficiaries and poor students.

2. Specific objectives

a) Improve the scientific research and training quality according to regional and international standards.

b) Intensify material facilities and accumulation for investment and development.

c) Step up the international cooperation in training and scientific research fields, perform the internationalization of training programs and promote the cooperation in the field of scientific research on a large scale.

d) Implement social policies in higher education through the establishment of funds for social policy beneficiaries, talents, students with difficult circumstances, scholarship funds and credit funds for students;

dd) Improve the effectiveness and efficiency in the management of tertiary education institution.

e) Ensure the balance between revenues and expenditures, stabilize and improve income of its managers, lecturers, public employees and workers.

II. INNOVATION CONTENTS

The FTU is entitled to exercise the autonomy from the following aspects:

1. Performance of scientific research and training duties

a) Make decisions on opening training disciplines and specialties in college level, undergraduate level, master’s level and doctoral level to meet the needs of the society in conformity with the FTU’s development orientations when fully satisfying conditions prescribed by law. With regard to new training disciplines that are not in the List of training and educational disciplines promulgated by the Ministry of Education and Training, FTU is entitled to open such new training disciplines provided that FTU must report to the Ministry of Education and Training on pilot organization of new training disciplines.

b) Determine enrollment quotas and organize the enrollment under FTU's enrollment plan in a transparent manner, and implement the enrollment priority policy as regulated.

c) Decide on training programs and teaching methods; languages; methods of examination and testing to assess learning results; textbooks, learning materials and management of training; printing, issuance and management of diplomas and certificates; ensure graduate quality as committed by FTU.

d) Carry out the educational quality accreditation as regulated; conduct international quality accreditation step by step.

dd) Make decisions on the training cooperation with domestic and foreign educational facilities which are regional and international reputable tertiary education institutions and educational organizations. FTU is responsible for publicly announcing and sufficiently providing learners with the information about international cooperation programs, ensuring legitimate rights and benefits of learners.

e) Make decisions on scientific research activities; encourage the application and transfer of scientific research results while taking into account the market demands and social needs; make decisions on participation in scientific and technological tasks, scientific and technological services, and organization of seminars in coordination with domestic and foreign entities.

g) Provide public non-business services in the fields of education and training, and science and technology, including those under orders placed by the State.

2. Organizational apparatus

a) Decide and assume responsibility for the establishment, re-structuring, merger, division, separation and dissolution of its affiliated units; define functions, tasks and operational regulations of its affiliated units for ensuring the apparatus’s operational effectiveness.

b) Make decisions on the structure and number of its employees, job positions; recruit, manage, use and develop public employees and contract employees on the basis of regulations and policies approved by The university council in conformity with FTU’s development requirements; sign employment contracts and labor contracts, manage, use and terminate such contracts in accordance with law.

c) Sign labor contracts with domestic and foreign lecturers, scientists and managers to perform FTU’s teaching activities and scientific research, and satisfy requirements on training quality assurance.

3. Finance

a) Tuition

- FTU shall collect tuition in accordance with the following plan:

- FTU must calculate and publicly announce specific tuition rates for groups of training disciplines and specialties, and training programs before the enrollment, ensuring that the maximum tuition rate (of general programs) shall not exceed FTU’s maximum tuition rate as prescribed in this Decision.

- FTU shall make decision on the ceiling tuition rate of doctoral programs, master’s programs and college programs which shall be, respectively, 2.5 times, 1.5 times and 0.8 times the maximum tuition rate stated above; the tuition rate of continuing education programs shall not exceed 1.5 times the tuition rate of full-time programs of the same level and group of training disciplines.

- FTU shall make decision on the tuition rate of special programs under the project on opening special programs approved by state competent authorities.

- As for students who enrolled before the effective date of this Decision, FTU shall increase the tuition rate as of the effective date of this Decision provided that the maximum increase rate of the following academic year shall not exceed 30% of the tuition rate of the previous academic year.

b) Non-business revenues

FTU shall perform training support activities and services to improve training quality and serve learners. Revenues from these activities are determined on the principle of covering expenses and making reasonable accumulations. FTU shall publicly announce non-business revenues other than tuition as regulated.

c) Salaries and incomes

 Apart from rank and grade-based salaries as prescribed by the State, FTU shall decide on additional incomes for its employees by using the positive difference between revenues and expenses after setting up regulated funds in accordance with its internal spending regulations, ensuring the impartiality and transparency.

d) Use of revenues

- Exercise the autonomy in making plans and decisions on using FTU’s lawful revenues to improve material facilities, train its personnel and ensure the quality of training and scientific research.

- After covering recurrent expenses, FTU’s remaining positive difference between revenues and expenses may be used to set aside to the following funds: the fund for the development of non-business activities (at least 25% of such different amount), the award fund, the welfare fund, the fund for income stabilization and student assistance funds.

- Collected tuition and other non-business revenues shall be deposited at commercial banks, and entire amount of interests of such deposits shall be used to set aside student assistance funds.

4. Policies on scholarships and tuition

a) FTU shall support for the entire different amount between its tuition rate and the reduced or exempted amount as regulated by State for students who are eligible for tuition reduction and exemption policies as regulated as of the enrolment course following the effective date of this Decision.

b) Other than students who are eligible for tuition reduction and exemption under State’s policies, FTU establishes and implement policies on scholarship and study encouragement for students with excellent achievements and policy beneficiaries.

5. Investment and purchase

a) Actively balance revenues and mobilize other lawful sources; make decisions on investment, purchase and repair projects for the overall development of FTU’s material facilities in conformity with regional and international standards.

b) Make decisions on the use of its assets, material facilities and brand value for entering into joint ventures or associations for carrying out scientific and technological activities, organize business activities and provide services compatible with its professional fields; make decisions on letting out state-owned assets and using rental of such assets for carrying out educational and training activities, scientific research, providing consultancy and support to students in the following cases: capacity of such assets is not fully used; assets are used as investments for performing joint venture and cooperation activities under projects approved by competent authorities.

6. Regulations on supervision

a) FTU amends, supplements and perfects its regulations, ensuring the openness and transparency; strengthen the university council, ensure that the university council can work effectively and efficiently, and promote the democracy in conformity with the law. The university council shall make decision on operational strategies and orientations of FTU; supervise the implementation of resolutions made by the university council, the execution of democracy regulations on its activities and the implementation of this Decision.

b) FTU shall publicly announce its internal spending regulations. FTU's internal spending regulations are approved at its meeting of delegates of officials, public employees.

c) The board of people’s inspectors shall periodically supervise and assess the compliance with the State and FTU's regulations on tasks, financial management and policies for its officials and lecturers.

d) FTU shall establish and publicly announce regulations on supervision of officials, lecturers, workers and learners on its operation.

7. FTU shall exercise other rights and obligations as regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017 and other relevant documents.

Article 2. Implementation

1. Relevant ministries, regulatory bodies and local governments shall, within the ambit of their functions, tasks regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017 and other relevant documents, perform the supervision and give assistance to FTU during the implementation of this Decision.

2. Relevant state authorities shall provide guidance and assistance to FTU during the execution of its investment projects.

Article 3. This decision takes effect from the day on which it is signed.

Article 4. Ministers, Heads of ministerial-level agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, President of FTU, heads of relevant organizations and relevant individuals shall implement this Decision./.
