DECISION
ON NUTRITIONAL MEAL SUPPORT FOR UNIONISTS AND EMPLOYEES WHO PRACTICE "ONE ROAD TWO DESTINATIONS" OF ENTERPRISES IN THE PROVINCES AND CITIES WHERE SOCIAL DISTANCING HAVE BEEN IMPOSED UNDER DIRECTIVE NO. 15/CT-TTG AND DIRECTIVE 16/CT-TTG
THE PRESIDIUM OF VIETNAM GENERAL CONFEDERATION OF LABOUR
- Pursuant to the Trade Union Law 2012;
- Pursuant to the Law on State Budget 2015;
- Pursuant to the Regulation of Vietnam Trade Union 2018;
- Pursuant to the Government’s Decree No. 191/ND-CP dated November 21, 2013 on elaboration of regulations on trade union finance;
- Pursuant to the Guidance No. 2242/LDTBXH-TLD-PTM dated July 4, 2021 between the Ministry of Labour, Invalids and Social Affairs, Vietnam General Confederation of Labour and Vietnam Chamber of Commerce and Industry on implementation of stay-at-work model in enterprises and business facilities;
- Pursuant to Resolution No. 05 NQ/DCT dated September 29, 2021 of the Presidium of the Vietnam General Confederation of Labour on supporting nutritious meals for unionist and employees who practice "one road two destinations” in localities and industries that practice social distancing measures under Directive No. 15/CT-TTg dated March 27, 2021 on drastic implementation of the peak period of Covid-19 prevention and control and Directive No. 16/CT-TTg dated March 31, 2021 of the Prime Minister on the implementation of urgent measures for the prevention and control of the Covid-19 epidemic (hereinafter referred to as Directive No. 15/CT-TTg and Directive No. 16/CT-TTg);
- At the request of the Board of Labour Relations, the Finance Department of the Vietnam General Confederation of Labour,
HEREBY DECIDES
Article 1. Nutritional meal support for unionists and employees who practice "one road two destinations" in the provinces and cities where social distancing have been imposed under Directive No. 15/CT-TTg and Directive 16/CT-TTg.
a) Beneficiaries include unionists and employees of enterprises (enterprises prescribed in the Enterprise Law 2020) paying union dues and practicing “one road two destinations” and approved by the competent authorities.
b) A lump-sum support of: up to VND 1,000,000/person (One million dong).
c) Support period: From October 1, 2021 to October 31, 2021.
d) Sources of funds:
- The superior trade unions will provide support for grassroots-level trade unions from their accumulated financial resources that are still in use at the time of funding as long as their residual balance, after funding, is at least VND 1,000,000 (One billion dong). In case the superior trade unions do not have enough sources of funds to provide support (the accumulated balance is less than VND 1 billion), the Confederations of Labour of provinces or cities; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the General Confederation of Labour shall provide additional funding for the superior trade unions to make up the deficit.
- The Confederations of Labour of provinces or cities; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the General Confederation of Labour shall provide additional funding for the superior trade unions from their accumulated financial resources that are still in use at the time of funding as long as their residual balance, after funding, is at least VND 5,000,000 (Five billion dong). In case Confederations of Labour of provinces or cities; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the General Confederation of Labour do not have enough sources of funds to provide funding (the accumulated balance is less than VND 5 billion), the General Confederation of Labour shall provide additional funding for the superior trade unions to make up the deficit.
- Time to determine accumulated balance of levels of trade unions: September 30, 2021.
dd) Method
- Grassroots-level trade unions shall submit reports on the number of unionists and employees whom enterprises call on to practice "one road two destinations" to the superior trade unions for their review and approval of budget.
- In case of an enterprise already paying trade union dues but having not had its own trade union, the superior trade union can work with that enterprise to check and determine the number of unionists and employees who practice “one road two destinations" before providing them support.
- The superior trade unions may request Confederations of Labour of provinces or cities; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the General Confederation of Labour to provide additional funding to make up the deficit.
- The Confederations of Labour of provinces or cities; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the General Confederation of Labour may request the General Confederation of Labour to provide additional funding to make up the deficit.
- Upon the request of unionists and employees, grassroots-level trade unions (or the superior trade unions if enterprises do not set up their own trade unions) can agree with owners of enterprises on the manner of provision of meals, meal rations, transfer of support funds to enterprises to provide meals according to the general policy of each enterprise; concurrently, grassroots trade unions (or the superior unions if enterprises that do not set up their own trade unions) shall supervise how the meals are served and announce meal allowances to unionists and employees.
Article 2. Implementation
1. This Decision comes into force as of the date of signing.
2. The Finance Department of the Vietnam General Confederation of Labour is assigned to, based on this Decision, current regulations of the State and Vietnam General Federation of Labour, guide trade unions at all levels to provide support for right beneficiaries, ensuring public disclosure and transparency.
3. Departments, the Office of the Inspection Committee, the Office of the Vietnam General Confederation of Labour; entities affiliated to the Vietnam General Confederation of Labor; Confederations of Labor of cities and provinces; Central trade unions of industries and equivalent; Corporations’ Trade Unions affiliated to the Vietnam General Confederation of Labour and superior trade unions shall implement this Decision./.
