Decree No. 05/2023/ND-CP dated February 15, 2023 on amendments to Decree No. 56/2011/ND-CP on job-based preferential allowance for officials and public employees in public health facilities

DECREE

ON AMENDMENTS TO DECREE NO. 56/2011/ND-CP DATED JULY 4, 2011 OF THE GOVERNMENT ON JOB-BASED PREFERENTIAL ALLOWANCE FOR OFFICIALS AND PUBLIC EMPLOYEES IN PUBLIC HEALTH FACILITIES

Pursuant to the Law on Government Organization dated June 19, 2015; the Law on amendments to the Law on Government Organization and the Law on Organization of Local Government dated November 22, 2019;

Pursuant to the Law on prevention and control of infectious diseases dated November 21, 2007;

Pursuant to Conclusion No. 25-KL/TW dated December 30, 2021 of the Politburo on the prevention and control of the Covid-19 epidemic (2022 - 2023);

At the proposal of the Minister of Health;

The Government promulgates a Decree on amendments to Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government on job-based preferential allowance for officials and public employees in public health facilities (hereinafter referred to as Decree No. 56/2011/ND-CP).

Article 1.Clause 7 is added to Article 3 of Decree No. 56/2011/ND-CP as follows:

“7. Job-based preferential allowances for preventive healthcare and grassroots health workers apply from January 1, 2022 to the end of December 31, 2023:

“a) The allowance rate of 100% applies to public employees who regularly and directly work in preventive medicine (including border medical quarantine); do medical professionals at health stations of communes, wards and townships, regional polyclinics, maternity wards, medical centers of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities and hospitals of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities.

b) During the period of application of job-based preferential allowance for preventive medicine and grassroots health workers specified in Clause 7 of this Article, Point c, Clause 2 and regulations for public employees who regularly and directly work in preventive medicine specified in Clause 4, Article 3.”

Article 2. Implementation

1. Public health facilities shall, based on the provisions of this Decree, determine their funding needs for implementation in 2022 and 2023; funding sources comply with the provisions of Article 4 of Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government. If seeking state budget support for implementation, the public health facility shall send the managing agency or level-I estimate budget unit a report on its funding needs and expected funding sources according to regulations, in which state budget support is available for review, appraisal, and also send the report to the financial authority of the same level no later than March 31, 2023 for submission to competent authorities for consideration and decision on additional budget estimates in 2023 according to regulations.

2. The Ministry of Finance and the People's Committees of the provinces and centrally-affiliated cities are responsible for allocating funds according to the budget management decentralization for implementation.

3. The management, use and settlement of funds shall comply with the law on state budget.  Relevant entities shall be held responsible for the accuracy of the data in the request for state budget support in accordance with the law.

Article 3. Entry into force and implementation

1. This Decree comes into force as of the date of signing.

2. From January 1, 2024, the job-based preferential allowance for preventive medicine and grassroots health workers comply with Clauses 1 to 6, Article 3 of Decree No. 56/ 2011/ND-CP, Decrees on amendments or replacement thereof (if any).

3. Ministers, heads of ministerial-level agencies and governmental agencies, chairpersons of provincial-level People's Committees and concerned organizations and individuals shall implement this Decree.
