Decision No. 2606/QD-TLD dated May 19, 2021 on emergency financing for members and workers affected by the Covid-19 epidemic in the fourth outbreak from April 27, 2021

DECISION

EMERGENCY FINANCING FOR MEMBERS AND WORKERS AFFECTED BY THE COVID - 19 EPIDEMIC IN THE FOURTH OUTBREAK FROM APRIL 27, 2021

PRESIDENTS OF VIETNAM GENERAL CONFEDERATION OF LABOR

- Pursuant to Law on Union in 2012;

- Pursuant to Law on State Budget in 2015;

- Pursuant to Vietnam Union Regulations in 2018;

- Pursuant to Decree 191/ND-CP dated November 21, 2013 of the Government on elaborating to confederation finance;

- Pursuant to Decision No. 1355/QD-TLD dated October 1, 2020 of the Presidents of Vietnam General Confederation of Labor on Principles of developing and allocating confederation finance in  2021;

- Pursuant to complicated development of the fourth outbreak of Covid-19 epidemic upon confederation members and workers in enterprises and industrial parks with lots of workers;

- At request of Department of Labor Relation and Department of Finance of the Vietnam General Confederation of Labor,

HEREBY DECIDE

Article 1. Assisting the frontline against the pandemic, and confederation members, workers affected by the Covid-19

Assign Confederations of Labor of provinces and cities; confederations of central government and equivalent; confederations of corporations affiliated to General Confederations to motivate and finance forces serving at the frontline against the epidemic; confederation members and workers affected by the Covid-19 epidemic in the fourth outbreak from April 27, 2021 as follows:

1. Forces serving at the frontline against the epidemic including medical facilities, field hospitals, concentrated quarantine areas: from VND 10 million to VND 50 million/entity.

2. Confederation member and workers with working relation (including enterprises and entities that have not established confederations) which are F0, receiving medical treatment and not violating regulations and law on epidemic management: up to VND 3 million/person.

3. Confederation members and workers (in enterprises, agencies and entities that donate confederation fee) that are F1, must be quarantined for 21 days in concentrated manner according to decisions of competent authority (not applicable to cases of quarantine at home, residence, enterprises) and do not violate regulations and law on epidemic management: up to VND 1.5 million/person.

4. Confederation members, public employees and officials that are F1, have difficult circumstances, must be quarantined for 21 days in concentrated manner according to decisions of competent authority (not applicable to cases of quarantine at home, residence, enterprises) and do not violate regulations and law on epidemic management: up to VND 1.5 million/person.

6. For other special cases, assign standing boards of Confederations of Labor of provinces and cities of central government and equivalent, confederations of corporations affiliated to General Confederations and superior confederations to consider and decide within their competence depending on practical situations, epidemic management demands and ability to balance confederation finance of local governments without exceeding amounts under Clauses 2, 3, 4, and 5 of this Article; report to the General Confederation.

Article 2. Assisting confederation members who participate in Covid-19 epidemic

Financing confederation officials participating in epidemic management in infected areas in the fourth outbreak from April 27, 2021 including: persons publicizing, mobilizing, inspecting and supervising epidemic management in enterprises, industrial parks; persons assisting traceability, testing, enforcing medical quarantine, reviewing, listing workers in quarantine zones, isolation areas; distributing and handing gifts to confederation members and workers in quarantine zones, isolation areas as follows:

1. Superior confederation officials: from VND 100,000 to VND 150,000/person/day, including holiday, Tet depending on nature, level of work, and actual number of days working in epidemic management but no more than VND 2,000,000 VND/person.  Assign standing boards of confederations of all levels to distribute tasks, decide and assume responsibilities.

2. Superior confederation officials in enterprises, agencies and entities: from VND 80,000 to VND 120,000/person/day, including holiday, Tet depending on nature, level of work, and actual number of days working in epidemic management but no more than VND 1,500,000 VND/person.  Executive boards of confederations of bodies shall allocate within approved financial sources to decide, and assume responsibilities.

3. Confederation officials participating in epidemic management but infected with Covid-19 (F0) or must adopt concentrated medical quarantine shall receive treatment under Article 1 hereof.

Article 3. Financing principles

1. Confederation members and workers eligible for multiple financing benefits according to Article 1 hereof shall receive the highest one. If a beneficiary has received their benefit then receives the same benefit at a higher level, they shall receive the difference between the 2 levels.

2. Beneficiaries under Clauses 2, 3, ,4, and 5 Article 1 who are pregnant workers, workers raising children under 6 years of age shall receive the highest level of benefits.

4. Specific criteria for determining difficult circumstances or special circumstances of beneficiaries under Clauses 4, 5, and 6 Article 1 shall be decided and guided by standing boards of Confederations of Labor of provinces, cities, confederations of central governments and equivalent, confederations of corporations affiliated to General Confederations based on life of confederation members, workers, local epidemic development and ability to balance confederation finance.

Article 4. Funding sources for implementation

Funding sources for financing according to this Decision (excluding Clause 2 Article 2) are allocated within confederation expenditure and revenue estimates in 2021 in all Confederations of Labor of provinces, cities, confederations of central governments and equivalent; confederations of corporations affiliated to General Confederation, superior confederations (including backup funding sources in 2021) and sources generated from increased private sector involvement   In case entities fail to balance revenues and expenditures according estimates assigned in 2021 and must utilize accumulated confederation funding or request General Confederation to finance, report to General Confederation for consideration.

Article 5. Implementation

1. Standing boards of Confederations of Labor of provinces and cities, confederations of central governments and equivalent, confederations of corporations affiliated to General Confederation shall rely on practical conditions of confederation members, workers, epidemic development and ability to balance confederation finance to identify individuals facing difficult circumstances, expenditure and form of financing (converting into supplies for workers in quarantine areas). Settlement must ensure publicity, transparency and legitimacy according to regulations and law of the Government and General Confederation.

2. Department of Labor Relation shall cooperate with Department of Finance of General Confederation shall expedite, guide Confederations of Labor of provinces and cities, confederations of central governments and equivalent, confederations of corporations affiliated to General Confederation shall implement and guide their subordinates to implement this Decision.

3. Inspection Committee of General Confederation shall guide inspection committees of all levels to inspect and supervise organization and implementation hereof; supervise and inspect implementation in some local administrative divisions and entities.

4. Prohibit organizations and individuals exploit financing under this Decision for personal gain. Violations shall require compensation, be disciplined, met with penalties for administrative violations or criminal prosecution as per the law depending on level and nature of the violations.

5. This Decision comes into effect from the day of signing.
