CIRCULAR
AMENDMENTS TO CIRCULAR NO. 35/2020/TT-BGDDT DATED OCTOBER 1, 2022 OF THE MINISTER OF EDUCATION AND TRAINING OF VIETNAM ON CODES, STANDARDS OF PROFESSIONAL TITLES, APPOINTMENT, AND SALARY CLASSIFICATION FOR PUBLIC EMPLOYEES TEACHING IN PUBLIC PEDAGOGICAL COLLEGES; CIRCULAR NO. 40/2020/TT-BGDDT DATED OCTOBER 26, 2020 OF THE MINISTER OF EDUCATION AND TRAINING OF VIETNAM ON CODES, STANDARDS OF PROFESSIONAL TITLES, APPOINTMENT, AND SALARY CLASSIFICATION FOR PUBLIC EMPLOYEES TEACHING IN PUBLIC UNIVERSITIES
Pursuant to the Law on Public Employees dated November 15, 2010; Law on Amendments to the Law on Officials and the Law on Public Employees dated November 25, 2019;
Pursuant to the Law on Education of Vietnam dated June 14, 2019;
Pursuant to Decree No. 69/2017/ND-CP dated May 25, 2017 of the Government of Vietnam on functions, tasks, entitlements, and organizational structure of the Ministry of Education and Training of Vietnam;
Pursuant to Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government of Vietnam on training and advanced training for officials and public employees; Decree No. 89/2021/ND-CP dated October 18, 2021 of the Government of Vietnam on amendments to Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government of Vietnam on training and advanced training for officials and public employees;
Pursuant to Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government of Vietnam on recruitment, use, and management of public employees;
After obtaining the consent of the Ministry of Home Affairs in Official Dispatch No. 146/BNV-CCVC dated January 12, 2022;
At the request of the Director of the Teachers and Educational Managers Department;
The Minister of Education and Training of Vietnam hereby promulgates the Circular on amendments to Circular No. 35/2020/TT-BGDDT dated October 1, 2020 of the Minister of Education and Training on codes, standards of professional titles, appointment, and salary classification for public employees teaching in public pedagogical colleges; Circular No. 40/2020/TT-BGDDT dated October 26, 2020 of the Minister of Education and Training on codes, standards of professional titles, appointment, and salary classification for public employees teaching in public universities.
Article 1. Amendments to Circular No. 35/2020/TT-BGDDT dated October 1, 2020 of the Minister of Education and Training of Vietnam on codes, standards of professional titles, appointment, and salary classification for public employees teaching in public pedagogical colleges
1. Amendments to Point c Clause 2 Article 4, Point c Clause 2 Article 5, and Point c Clause 2 Article 6:
“c) Have certificates of advanced training according to the professional title of a pedagogical college lecturer."
2. Article 10a is added after Article 10 as follows:
“Article 10a. Transitional provisions
1. Public employees appointed to the professional title of public employees teaching in public pedagogical colleges according to regulations of the law before the effective date of this Circular are considered to satisfy regulations on the professional title of public employees teaching in public pedagogical colleges prescribed in this Circular corresponding to the appointed professional title.
2. Public employees who already have certificates of advanced training according to the professional title of the rank of public employees teaching in public pedagogical colleges or public universities according to regulations of the law before June 30, 2022 are considered to satisfy the requirement for certificates of advanced training according to the professional title of a pedagogical college lecturer; at the same time, such certificates may be used when the mentioned public employees participate in exams or the consideration for professional title promotion and are exempted from learning advance training programs according to the professional title of a pedagogical college lecturer prescribed in this Circular.”
Article 2. Amendments to Circular No. 40/2020/TT-BGDDT dated October 26, 2020 of the Minister of Education and Training of Vietnam on codes, standards of professional titles, appointment, and salary classification for public employees teaching in public universities
1. Amendments to Points b Clause 2 Article 5, Point b Clause 2 Article 6, and Point b Clause 2 Article 7:
“b) Have certificates of advanced training according to the professional title of a university lecturer."
2. Article 11a is added after Article 11 as follows:
“Article 11a. Transitional provisions
1. Public employees appointed to the professional title of public employees teaching in public universities according to regulations of the law before the effective date of this Circular are considered to satisfy regulations on the professional title of public employees teaching in public universities prescribed in this Circular corresponding to the appointed professional title.
2. Public employees who already have certificates of advanced training according to the professional title of the rank of public employees teaching in public universities according to regulations of the law before June 30, 2022 are considered to satisfy the requirement for certificates of advanced training according to the professional title of a university lecturer; at the same time, such certificates may be used when the mentioned public employees participate in exams or the consideration for professional title promotion and are exempted from learning advance training programs according to the professional title of a university lecturer prescribed in this Circular.”
Article 3. Implementation responsibilities
1. Ministers, Directors of ministerial agencies, Directors of affiliates of the Government of Vietnam, Chairmen of the People’s Committees of provinces and centrally affiliated cities, Principals of pedagogical colleges, Directors of universities, and relevant agencies, organizations, and individuals shall implement this Circular.
2. If documents cited in this Circular are amended, comply with their new edition.
Article 4. Entry into force
1. This Circular comes into force as of April 19, 2022.
2. Difficulties that arise during the implementation of this Circular shall be reported to the Ministry of Education and Training of Vietnam for guidance or consideration and settlement./.
