CIRCULAR
GUIDELINES FOR IMPLEMENTATION OF SOME ARTICLES OF THE GOVERNMENT’S NO. 61/2015/ND-CP DATED JULY 09, 2015 ON EMPLOYMENT CREATION POLICIES AND NATIONAL EMPLOYMENT FUND AND GOVERNMENT’S DECREE NO. 74/2019/ND-CP DATED SEPTEMBER 23, 2019 ON AMENDMENTS TO THE DECREE NO. 61/2015/ND-CP
Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to the Government’s Decree No. 61/2015/ND-CP dated July 09, 2015 on employment creation policies and National Employment Fund (hereinafter referred to as “the Decree No. 61/2015/ND-CP”);
Pursuant to the Government’s Decree No. 74/2019/ND-CP dated September 23, 2019 on amendments to the Government’s No. 61/2015/ND-CP dated July 09, 2015 on employment creation policies and National Employment Fund (hereinafter referred to as “the Decree No.74/2019/ND-CP”);
At the request of the Director of the Department of Employment;
The Minister of Labor, War Invalids and Social Affairs hereby promulgates a Circular on guidelines for implementation of some articles of the Government’s Decree No. 61/2015/ND-CP dated July 09, 2015 on employment creation policies and National Employment Fund and the Government’s Decree No. 74/2019/ND-CP dated September 23, 2019 on amendments to the Government’s No. 61/2015/ND-CP dated July 09, 2015 on employment creation policies and National Employment Fund.
Article 1. Scope
This Circular provides guidelines for reporting loans granted by the National Employment Fund; reporting loans granted for employment creation and loans granted by capital raised by the Vietnam Bank for Social Policies (VBSP) to Vietnamese guest workers (hereinafter referred to as “raised capital”) as specified in the Decree No. 61/2015/ND-CP and Decree No. 74/2019/ND-CP.
Article 2. Regulated entities
VBSP, provincial and district-level Departments of Labor, War Invalids and Social Affairs.
Article 3. Reporting of loans granted by the National Employment Fund
1. On a quarterly basis, by the 10th of the first month, the VBSP’s transaction office shall report to the district-level Department of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and concessional loans granted to Vietnamese guest workers by the National Employment Fund using the Forms No. 1 and No. 2 hereof.
2. On a quarterly basis, by the 15th of the first month, the VBSP’s branch shall report to the provincial Department of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and concessional loans granted to Vietnamese guest workers by the National Employment Fund using the Forms No. 3 and No. 4 hereof.
3. On a quarterly basis, by the 20th of the first month, the VBSP shall report to the Ministry of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and concessional loans granted to Vietnamese guest workers by the National Employment Fund using the Forms No. 5 and No. 6 hereof.
4. The period of collection of data specified in Clauses 1, 2 and 3 of this Article begins from January 01 of the reporting year to the last day of the preceding quarter.
Article 4. Reporting of loans granted for employment creation, maintenance and development and loans granted to Vietnamese guest workers by raised capital
1. On a quarterly basis, by the 10th of the first month, the VBSP’s transaction office shall report to the district-level Department of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and loans granted to Vietnamese guest workers by raised capital using the Forms No. 7 and No. 8 hereof.
2. On a quarterly basis, by the 15th of the first month, the VBSP’s branch shall report to the provincial Department of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and loans granted to Vietnamese guest workers by raised capital using the Forms No. 9 and No. 10 hereof.
3. On a quarterly basis, by the 20th of the first month, the VBSP shall report to the Ministry of Labor, War Invalids and Social Affairs on loans granted for employment creation, maintenance and development and loans granted to Vietnamese guest workers by raised capital using the Forms No. 11 and No. 12 hereof.
4. The period of collection of data specified in Clauses 1, 2 and 3 of this Article begins from January 01 of the reporting year to the last day of the preceding quarter.
Article 5. Effect and responsibility for implementation
1. This Circular comes into force from March 26, 2020.
2. The Circular No. 45/2015/TT-LDTBXH dated November 11, 2015 and Circular No. 24/2017/TT-BLDTBXH dated August 21, 2017 of the Minister of Labor, War Invalids and Social Affairs shall cease to have effect from the effective date of this Circular.
3. VBSP, provincial and district-level Departments of Labor, War Invalids and Social Affairs are responsible for the implementation of this Circular.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry for Labor, War Invalids and Social Affairs prompt instructions./.
