Resolution 1111/NQ-UBTVQH14 in 2020 on the arrangement of administrative units at district and commune levels and the establishment of Thu Duc city in Ho Chi Minh City issued by the National Assembly Standing Committee

RESOLUTION

ON ARRANGEMENT OF COMMUNE-LEVEL AND DISTRICT-LEVEL ADMINISTRATIVE DIVISIONS AND ESTABLISHMENT OF THU DUC CITY AFFILIATED TO HO CHI MINH CITY

THE STANDING COMMITTEE OF NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Organization of Local Government No. 77/2015/QH13, amended under Law No. 21/2017/QH14 and Law No. 47/2019/QH14;

Pursuant to the Law on Organization of the People's Courts No. 62/2014/QH13;

Pursuant to the Law on Organization of the People's Procuracy No. 63/2014/QH13;

Pursuant to the Resolution No. 131/2020/QH14 dated November 16, 2020 of the National Assembly on the organization of urban government in Ho Chi Minh City;

Pursuant to the Resolution No. 1211/2016/UBTVQH13 dated May 25, 2016 of the Standing Committee of National Assembly on standards of administrative divisions and classification of administrative divisions;

Pursuant to Resolution No. 653/2019/UBTVQH14 dated March 12, 2019 of the Standing Committee of the National Assembly on the arrangement of commune-level and district-level administrative divisions in the period of 2019 - 2021;

Considering the Government's proposal in Report No. 589/TTr-CP dated November 11, 2020, the Supreme People's Court in Report No. 751/TTr-TANDTC dated December 3, 2020, the Supreme People's Procuracy in Report No. 48/TTr-VKSTC dated December 4, 2020, Judicial Committee in Document No. 2795/BC-UBTP14 dated November 18, 2020 and No. 2822/BC-UBTP14 dated December 3, 2020, Examination Report No. 3697/BC-UBPL14 dated December 1, 2020 of the Legal Committee,

HEREBY RESOLVES:

Article 1. Arrangement of district-level administrative divisions to establish Thu Duc City affiliated to Ho Chi Minh City

1. Establish Thu Duc City by merging a total 49.79 square kilometers (sq km) of natural area, 171,311 people of District 2; a total 113.97 sq km of natural area, 310,107 people of District 9 and a total of 47.80 sq km of natural area, 532,377 people of Thu Duc District.   Following the establishment, Thu Duc City has 211.56 sq km of natural area and population size of 1,013,795 people.

Thu Duc City borders District 1, District 4, District 7, District 12, Binh Thanh District; Binh Duong Province and Dong Nai Province.

2. Arrange commune-level administrative divisions in Thu Duc City as follows:

a) Merge a total of 1.74 sq km of natural area, 124 people of An Khanh Ward into Thu Thiem Ward.  Following the merger, Thu Thiem Ward has 3.25 sq km of natural area and population size of 428 people.

Thu Thiem Ward borders An Khanh Ward, An Loi Dong Ward; District 1, District 4 and Binh Thanh District;

b) Establish An Khanh Ward by merging a total of 2.03 sq km of natural area, 4,333 people of Binh Khanh Ward and a total of 1.89 sq km of natural area, 18,821 people of Binh An Ward.  Following the establishment, An Khanh Ward has 3.92 sq km of natural area and population size of 23,154 people.

An Khanh Ward borders the Wards of An Loi Dong, An Phu, Binh Trung Tay, Thao Dien, Thanh My Loi, and Thu Thiem; District 7 and Binh Thanh District.

3. After the establishment of Thu Duc City and the arrangement of commune-level administrative divisions, Thu Duc City has 34 wards below:  An Khanh, An Loi Dong, An Phu, Binh Chieu, Binh Tho, Binh Trung Dong, Binh. Trung Tay, Cat Lai, Hiep Binh Chanh, Hiep Binh Phuoc, Hiep Phu, Linh Chieu, Linh Dong, Linh Tay, Linh Trung, Linh Xuan, Long Binh, Long Phuoc, Long Thanh My, Long Truong, Phu Huu, Phuoc Binh, Phuoc Long A, Phuoc Long B, Tam Binh, Tam Phu, Tang Nhon Phu A, Tang Nhon Phu B, Tan Phu, Thao Dien, Thanh My Loi, Thu Thiem, Truong Thanh, Truong Tho.

Article 2. Arrangement of commune-level administrative divisions affiliated to Ho Chi Minh City

1. Arrange commune-level administrative divisions affiliated to District 3 as follows:

a) Establish Vo Thi Sau Ward by merging a total of 0.88 sq km of natural area and 7,263 people of Ward 6; a total of 0.92 sq km of natural area, 12,595 people of Ward 7 and the whole of 0.40 sq km of natural area, 16,877 people of Ward 8. Following the establishment, Vo Thi Sau Ward has 2.20 sq km of natural area and population size 36,735 people.

Vo Thi Sau Ward borders Ward 4, Ward 5, Ward 9, Ward 10, Ward 13, Ward 14; District 1 and Phu Nhuan district;

b) Following the arrangement, District 3 has 12 wards.

2. Arrange commune-level administrative divisions affiliated to District 4 as follows:

a) Merge a total of 0.16 sq km of the natural area and 5,114 people of Ward 5 into Ward 2. Following the merger, Ward 2 has 0.36 sq km of natural area and population size of 17,039 people.

Ward 2 borders Ward 1, Ward 3, Ward 6 and District 1;

b) Merge a total of 0.42 sq km of natural area, 7,328 people of Ward 12 into Ward 13. Following the merger, Ward 13 has 0.85 sq km of natural area and population size of 18,530 people.

Ward 13 borders Ward 9, Ward 10, Ward 14, Ward 16, Ward 18; District 1 and District 2;

c) Following the arrangement, District 4 has 13 wards.

3. Arrange commune-level administrative divisions affiliated to District 5 as follows:

a) Merge a total of 0.19 sq km of the natural area, 10,943 people of Ward 15 into Ward 12. Following merging, Ward 12 has 0.57 sq km of natural area and population size of 17,312 people.

Ward 12 borders Ward 9, Ward 11, Ward 14; District 10 and District 11;

b) Following the arrangement, District 5 has 14 wards.

4. Arrange commune-level administrative divisions affiliated to District 10 as follows:

a) Merge a total of 0.10 sq km of the natural area, 6,075 people of Ward 3 into Ward 2. Following merging, Ward 2 has 0.30 sq km of natural area and population size of 24,866 people.

Ward 2 borders Ward 1, Ward 4, Ward 9, Ward 10 and District 5;

b) Following the arrangement, District 10 has 14 wards.

5. Arrange commune-level administrative divisions affiliated to Phu Nhuan District as follows:

a) Merge a total of 0.16 sq km of the natural area and 6,859 people of Ward 12 into Ward 11. Following the merger, Ward 11 has 0.39 sq km of natural area and population size of 15,522 people.

Ward 11 borders Ward 8, Ward 10, Ward 13, Ward 15, Ward 17 and District 3;

b) Merge a total of 0.15 sq km of the natural area, 7,172 people of Ward 14 into Ward 13. Following the merger, Ward 13 has 0.29 sq km of natural area and population size of 16,609 people.

Ward 13 borders Ward 10, Ward 11; District 3 and Tan Binh district;

c) Following the arrangement, Phu Nhuan District has 13 wards.

Article 3. Establishment of the People's Court of Thu Duc City affiliated to Ho Chi Minh city

1. Dissolve the People's Courts of District 2, District 9 and Thu Duc District to establish the People's Court of Thu Duc City affiliated to Ho Chi Minh City.

2. The People's Court of Thu Duc City affiliated to Ho Chi Minh city consists of the following specialized courts:

a) Criminal Court;

b) Civil Court;

c) Family and Juvenile Court;

d) Administrative Court;

dd) Economic Court.

3. The People's Court of Thu Duc City affiliated to Ho Chi Minh city shall inherit the duties and powers of the People's Courts of District 2, District 9 and Thu Duc District as per the law.

Article 4. Establishment of the People's Procuracy of Thu Duc City affiliated to Ho Chi Minh city

1. Dissolve the People's Procuracies of District 2, District 9 and Thu Duc District to establish the People's Procuracy of Thu Duc City affiliated to Ho Chi Minh City.

2. The People's Procuracy of Thu Duc City affiliated to Ho Chi Minh city shall inherit the duties and powers of the People's Procuracies of District 2, District 9 and Thu Duc District as per the law.

Article 5. Entry into force

1. This Resolution comes into force as of January 1, 2021.

2. Since the date of entry into force of this Resolution, Ho Chi Minh City has 22 district-level administrative divisions, including 16 urban districts, 05 suburban districts and 1 city; 312 commune-level administrative divisions, including 58 communes, 249 wards and 05 towns.

Article 6. Implementation

1. The Government, the People's Council, the People's Committee of Ho Chi Minh City and the concerned agencies and organizations shall implement this Resolution; arrange and stabilize the organizational apparatus, arrange working offices of agencies and organizations in the divisions; stabilize the lives of the local people, ensure the socio-economic development, national defense and security requirements in the locality.

2. The Government, within the scope of its duties and powers, shall decide or submit to the National Assembly or the Standing Committee of the National Assembly for promulgation of mechanisms and policies specific to Thu Duc City affiliated to Ho Chi Minh City to perform from 2021.

3. The Chief Justice of the Supreme People's Court and the Chief Procurator of the Supreme People's Procuracy shall, within the scope of their respective duties and powers, have to guide activities; arrange organizational apparatus, decide staff, the number of judges, procurators, other public employees and employees of the People's Court, the People's Procuracy of Thu Duc City affiliated to Ho Chi Minh City as per the law.

4. The Nationality Council, Committees of the National Assembly and the Delegation of the National Assembly of Ho Chi Minh City, within their duties and powers, oversee the implementation of this Resolution.
