Decision No.2818/QD-BGTVT of November 02, 2012, announcing Tuan Chau passenger port at Tuan Chau Ward, Ha Long City, Quang Nam Province is permitted to receive foreign waterway means of transportation

DECISION

ANNOUNCING  TUAN CHAU PASSENGER PORT AT TUAN CHAU WARD, HA LONG CITY, QUANG NAM PROVINCE IS PERMITTED TO RECEIVE FOREIGN WATERWAY MEANS OF TRANSPORTATION

MINISTER OF TRANSPORT

Pursuant to the Law on Inland Waterway Transport published together with the Order of the State President No.12/2004/LCTN and Decree No. 21/2005/ND-CP of March 1, 2005 of the Government detailing the implementation of a number of articles of the Law on inland Waterway Transport;

Pursuant to Decree No. 51/2008/ND-CP dated April 22, 2008 of the Government defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

Pursuant to Circular No. 25/2010/TT-BGTVT dated August 31, 2010 of the Minister of Transport stipulating the management of ports and inland wharves;

Pursuant to Decision No. 759/QD-BGTVT dated March 27, 2009 of the Ministry of Transport on the announcement inland waterway flows from Tuan Chau - Ha Long City, Quang Ninh to Gia Luan - Cat Hai district, Hai Phong;

Considering report results of assessment No. 4264/GTVT-QLVT dated October 09, 2012 and Decision No.2789/QD-SGTVT dated October 05, 2009 of Quang Ninh Service of Transport, together with the dossier to request the announcement of inland wharves able to receive foreign means of waterway transportation southern Tuan Chau island, Ha Long City, Quang Ninh province of Au Lac Quang Ninh Co., Ltd.;

DECIDES

Article 1. Announcing Tuan Chau passenger port, southern Tuan Chau island, Ha Long City, Quang Ninh province shall receive foreign means of waterway transportation with the following contents:

1. Port name: Tuan Chau passenger port

2. Location: Southern Tuan Chau island, Tuan Chau Ward, Ha Long City, Quang Ninh Province.

3. Port owner: Au Lac Quang Ninh Co., Ltd.

a) Address: Ward Tuan Chau, Ha Long City, Quang Ninh Province.

b) Tel: 0333.842134;                Fax: 0333.842119

c) Business registration certificate No.5700239963 registered for the first time on August 02, 1997; registered for 20^th change on August 08, 2012 issued by the Business Registration Division – Service of Planning and Investment of Quang Ninh province

4.Type of port: Passenger port

6. Infrastructure of port works:

- Pier is designed with U shape (fixed lock), continuous reinforced concrete structures with steps up and down combined floating pontoon bridge system for customers to go up and down the boat.

- Pier length: 1,739.8 m

- There are steps up and down for safe and convenient use of passenger

7. Port flow: A flow specially used of grade III, flow width of 80m connected to the national inland waterway flows announced by the Ministry of Transport at the Decision No. 759/QD-BGTVT dated March 27, 2009.

8. Port waters: Under plan of port water and flow into the port measured and made by Northern maritime safety assurance survey Enterprise in August 2012.

- Area: 111,840 m2 (in the lock area), which is 1,700m from Ha Long-Hai Phong national inland waterway flow.

- The height of the bottom of the highest position:-5.50m ( nautical charts).

9. Port capable of receiving the inland waterwaymeans of transportation and foreign waterway means of transportation waterway with the length up to 70 m and draft up to 8.00 m.

11. Pilot reception area: Being a pilot reception of Hon Gai sea port under Decision No. 42/2007/QD-BGTVT dated August 28, 2007 of the Ministry of Transport on the announcement of the port waters of Quang Ninh province and management area of the port authorities of Quang Ninh.

Article 2. In the operation process, Au Lac Quang Ninh Co., Ltd. is responsible for:

1. Complying with the regulations on operation management of current ports and inland waterway wharves and this Decision.

2. Maintaining the signaling system and safety of inland waterway in the area of waters in charge.

Article 3. Inland waterway port authorities of Quang Ninh shall take responsible for specialized State management in ports and collect fees and charges as prescribed.

Article 4. The relevant specialized State management agencies shall base on this Decision and the relevant provisions of law for the implementation of their professional activities.

Article 5. This Decision takes effect from the date of its signing.

Article 6. The Chief of Secretariat, Chief Inspector, Heads of the Departments under the Ministry of Transport, Director of Vietnam's inland waterway Department, Director Quang Ninh inland waterway port authorities, Director of Quang Ninh Department of Transport, Director of Au Lac Quang Ninh Co., Ltd., Heads of agencies, units and individuals concerned are liable to execute this Decision.
