DECISION

APPROVAL FOR DETAILED PLANNING FOR SEAPORTS IN THE NORTH (GROUP 1) BY 2020 AND THE ORIENTATION TOWARDS 2030

MINISTER OF TRANSPORT

Pursuant to the Law on Construction No. 50/2014/QH13 in 2014;

Pursuant to Maritime Code of Vietnam in 2015;

Pursuant to the Government's Decree No. 107/2012/ND-CP dated December 20, 2012, defining the functions, tasks, powers and organizational structure of the Ministry of Transport;

Pursuant to the Government's Decree No. 92/2006/ND-CP dated September 07, 2006 on formulation, assessment, ratification and management of socio-economic development master plans and the Government's Decree No. 04/2008/ND-CP dated January 11, 2008 on amendments to Decree No. 92/2006/ND-CP;

Pursuant to the Prime Minister’s Decision No. 1037/QD-TTg dated June 24, 2014 on amendments to the Master Plan for development of Vietnam’s seaport system by 2020 and the orientation towards 2030;

In consideration of the report No. 4851/TTr-CHHVN dated November 25, 2015; the letter No.2547/CHHVN-KHDT dated June 23, 2016 of Vietnam Maritime Administration on receipt and explanation about suggestions of members of the Plan Assessment Council, enclosed with the plan document; the written record made by the Assessment Council in June, 2016 on the amendments to the detailed planning for seaports in the North (Group 1) by 2020, and the orientation towards 2030;

In consideration of the request of the Standing Member of the Assessment Council and Director of Planning and Investment Department,

HEREBY DECIDES:

Article 1. Grant of approval for detailed planning for seaports in the North (Group 1) by 2020 and the orientation towards 2030 with the following contents:

I. Planning scope

Group 1 includes seaports of following coastal provinces and cities in the Northern area: Quang Ninh, Thai Binh, Nam Dinh, Ninh Binh and Hai Phong City. These seaports’ attraction zone embraces all northern provinces and certain provinces of neighboring countries bordering the northern frontier.     

II. Viewpoint and development targets

1. Viewpoint

Develop the infrastructure of seaports to meet the cargo shipping need of the northern region, especially the economic triangle - Hanoi – Hai Phong - Quang Ninh.

- Develop Hai Phong international gateway port in the direction towards the sea to be able to accommodate large-tonnage ships on long shipping routes, and create a motive force for the socio-economic development in the whole northern region.

- Mobilize resources for developing Hai Phong international gateway port (Lach Huyen). Other wharves/terminals are developed on the basis of taking the best and appropriate use of existing infrastructure and making in-deep investment to improve their operation capacity. New wharves/terminals should be invested on the basis of using modern loading/unloading technologies and applying science and high technologies to the management of their operations and of port operation enterprises.

- Make the best use of favorable natural conditions for suitable and stable development of buoy wharves and cargo transshipping areas on the way so as not to cause adverse impacts on other socio-economic development plans and to strictly comply with regulations on environmental protection, maritime safety and security for the purpose of reducing investment and maritime shipping costs, and the pressure of road transport and vehicular weight inspection.

- Planning-based sizes of ships (deadweight tonnage) are used as the basis for making investment in seaport public infrastructure but are not used as the basis for prohibiting ships with larger sizes from making ocean voyages on shipping lanes, and entering seaports. A ship which has a larger size but has technical specifications conformable with a wharf’s receiving capacity, and technical standards and regulations for the ship lane (the width, depth and clearance height, etc.), and satisfied all safety conditions may enter seaports.

The upgrade and/or investment in terminals must take into account the construction of auxiliary works (warehouse, etc.) and the investment in loading/ unloading equipment in a comprehensive manner in conformity with the received sizes of ships and seaport design capacity.

2. Development targets and orientation

a) General targets: Develop seaports in the North (Group 1) in a synchronous and effective manner; concentrate resources on developing Hai Phong international gateway port; make sustainable, intensive and effective development and operation of seaports/ terminals in association with economic zones or industrial zones; relieve the congestion of goods; and form the grounds for generating a momentum for development of seaport urban centers and coastal industrial parks and economic zones, and contributing to vigorously promoting economic development of the whole region.

b) Specific targets:

- Ensure the following quantity of goods movement:

+ 177 - 192 million tonnes (in which general cargo and container cargo account for 114-129 million tonnes) by 2020.

+ 312 - 365 million tonnes (in which general cargo and container cargo account for 224-277 million tonnes) by 2030.

- Meet demand on the quantity of tourists by sea through the ports:

+ About 278300 arrivals by 2020.

+ 770100 – 870100 arrivals by 2030.

- Use resources to complete the investment in Hai Phong international gateway port at Lach Huyen terminal area in order to receive ships with a deadweight tonnage of up to 100,000 tonnes (container ships with a capacity of up to 8,000 TEU), thereby facilitate the transportation of Vietnam’s imports and exports on long shipping routes and attract international transshipment of goods through the region.

- Make upgrade and in-depth investment in terminals in Hai Phong seaport, Quang Ninh seaport, Thai Binh seaport, and Hai Thinh – Nam Dinh seaport to meet demand on ocean shipping of goods.

- Be able to receive the following types of ships: general ships, bulk cargo ships with a deadweight tonnage of up to 100,000 tonnes, container ships with a deadweight tonnage of up to 8,000 TEU, oil product ships with a deadweight tonnage of up to 40,000 tonnes, and passenger ships with a deadweight tonnage of up to 220,000 GT (and up to 250,000 GT in the future).

III. Planning contents

1. Detailed planning for Group 1 ports

Group 1 has 04 seaports: Hai Phong Seaport, Quang Ninh Seaport, Thai Binh Seaport, and Hai Thinh - Nam Dinh Seaport. Detailed planning for seaports and terminals:

a) Hai Phong Seaport: A national multipurpose port, international gateway (Class IA), comprising of the following primary terminals:  Cam river terminals; Dinh Vu terminals (including Nam Dinh Vu terminal); Lach Huyen terminals; Nam Do Son, Bach Long Vi terminals; buoy wharves and transport hubs.

Estimated capacity of goods movement: 109 – 114 million tonnes/year by 2020; 178.5 – 210 million tonnes/year by 2030. In which, estimated capacity of container movement:  5.84 – 6.2 million TEU/year by 2020; 11.2 – 12.5 million TEU/year by 2030.

Expected movement of international passengers by sea: 25800 arrivals/year by 2020; 46900 arrivals/year by 2030.

Detailed planning for primary terminals:

- Cam river terminals: multipurpose terminals which have dedicated terminals, capable of receiving ships with a deadweight tonnage of 5,000 – 10,000 tonnes; Hoang Dieu terminal shall not be expanded but be relocated and repurposed; relocation plan must be conformable with the plan for construction of Nguyen Trai bridge and the construction progress of Lach Huyen terminals. Estimated capacity of movement: 23 - 25 million tonnes/year by 2020; 18 – 20 million tonnes/year by 2030.

- Dinh Vu terminals (including Nam Dinh Vu terminal): terminals for general ships and ships carrying containers on short shipping routes with dedicated terminals, capable of receiving ships with a deadweight tonnage of up to 20,000 tonnes. Estimated capacity of movement: 40 - 45 million tonnes/year by 2020; 45 – 50 million tonnes/year by 2030.

- Lach Huyen terminals: primary terminals of the port which handle general containers and international cargo transshipment; terminals for receiving international passenger ships with a deadweight tonnage of 100,000 – 225,000 GT (5,000 – 6,000 people) shall be invested. Capacity of movement: 45 – 50 million tonnes/year by 2020 – 2025, receiving general ships with a deadweight tonnages of 50,000 tonnes (100,000 partially loaded), container ships with a deadweight tonnages of up to 6,000 TEU (8,000 TEU partially loaded); capacity: 115 - 125 million tonnes/year by and after 2030, receiving general ships with a deadweight tonnages of 100,000 tonnes and container ships with a deadweight tonnages of up to 8,000 TEU.

- Nam Do Son terminal: a potential terminal serving the national defense and security.

- Bach Long Vi island district terminal: satellite and central terminal for exchanges with the land and serving the socio-economic development and the national defense & security.

- Buoy wharves, transport hubs: Bach Dang buoy wharf for ships with a deadweight tonnage of up to 7,000 tonnes, Ben Got buoy wharf for ships with a deadweight tonnage of up to 50,000 tonnes, Bach Dang anchoring area for ships with a deadweight tonnage of up to 7,000 tonnes, Ben Got anchoring area for ships with a deadweight tonnage of up to 50,000 tonnes. Estimated capacity of movement: 3 - 5 million tonnes/year by 2020. The said cargo transshipment area may be ceased until Lach Huyen terminals which are qualified to replace them are put into use.

b) Quang Ninh Seaport: A national central multipurpose port (Class I) which comprises the following primary terminals: Cai Lan terminals; Hon Gai passenger terminal; Cam Pha terminals; Yen Hung terminals (Chanh, Bach Dang rivers, Nha Mac lagoon); Hai Ha terminals; Van Gia terminal; Mui Chua terminal; Van Don multipurpose terminal (in the Northeast of Cai Bau island); Van Hoa terminal; Co To island terminal; buoy wharves and transport hubs.

Estimated capacity of goods movement: 65.5 – 75.5 million tonnes/year by 2020; 121 – 142.5 million tonnes/year by 2030. In which, estimated capacity of container movement:  0.32 – 0.72 million TEU/year by 2020; 0.8 – 1.04 million TEU/year by 2030.

Expected movement of international passengers by sea: 252500 arrivals/year by 2020; 723200 - 823200 arrivals/year by 2030.

Detailed planning for primary terminals:

- Cai Lan terminals: primary terminals of Quang Ninh Seaport, comprising of terminals for general and container ships; dedicated terminals for Thang Long cement plant, Ha Long cement plant, Thang Long power plant, B12 oil terminal. Estimated capacity of movement: 25 – 33 million tonnes/year by 2020; 35 – 40 million tonnes/year by 2030. Comprising of:

+ Cai Lan terminal for general ships and container ships: effectively use existing terminals for general ships with a deadweight tonnage of up to 50,000 tonnes and container ships with a deadweight tonnage of up to 4,000 TEU (handling general ships if necessary). Terminals for general ships shall be invested and constructed at the upstream of existing wharves, wharves No. 8 and 9 for ships with a deadweight tonnage of up to 50,000 tonnes; wharves for small-size watercrafts and domestic watercrafts in service of colleting cargos. Estimated capacity of movement: 15 - 22 million tonnes/year by 2020; 26 – 30 million tonnes/year by 2030.

+ Dedicated terminals: dedicated terminals for bulk cargo of Thang Long, Ha Long cement plants: maintain current scale and make in-depth investment to improve capacity (if necessary) and minimize adverse impact on the environment; for a long term, these terminals are not developed in Cua Luc, Ha Long bays. Estimated capacity of movement: about 8 million tonnes/year.

+ B12 oil terminal shall not be expanded but relocated and repurposed before 2020. There must be a suitable site for relocation at Yen Hung terminals (at the left riverside of Chanh river, near Dao Qua Muom or at the right riverside of Chanh river at the upstream of Nosco – Vinalines Ship Repair Company) or Nha Mac lagoon area (in the side of Bach Dang river); terminal in the side of Chanh river may receive ships with a deadweight tonnage of up to 40,000 tonnes, and terminal in the side of Bach Dang river may receive ships with a deadweight tonnage of up to 20,000 tonnes.

- Hon Gai passenger terminal: includes Hon Gai terminal and Bai Chay terminal – the upstream of Dai Duong park, receiving North – South passenger ships and international passenger ships with a deadweight of 100,000 – 225,000 GT (and up to 250,000 GT in the future), the quantity of terminals shall be developed in corresponding with the real demand.

- Cam Pha terminals: dedicated terminals which include terminals for general ships, container ships and dedicated terminals for liquid cargo. Estimated capacity of movement: 32 – 36.5 million tonnes/year by 2020; 54.5 – 67.5 million tonnes/year by 2030 (in which, estimated capacity of movement at terminals: 12 – 14.5 million tonnes/year by 2020; 29.5 – 37.5 million tonnes/year by 2030). Estimated capacity of movement at anchoring zone and transshipment sites:  20 – 22 million tonnes/year by 2020; 25 – 30 million tonnes/year by 2030. Comprising of:

+ Dedicated terminals for coal: Cua Ong coal terminals are maintained and operated for ships with a deadweight tonnage of 50,000 – 70,000 tonnes at the terminals, and of 100,000 tonnes and above at transshipment areas. Estimated capacity of movement: 6 - 8 million tonnes/year by 2020; 16 – 20 million tonnes/year by 2030.

+ Dedicated terminals for Cam Pha cement plant: existing terminals are maintained and operated for ships with a deadweight tonnage of up to 15,000 tonnes.  Estimated capacity of movement: 2 million tonnes/year by 2020; 4 million tonnes/year by 2030.

+ Dedicated terminals for liquid cargo: An oil terminal is constructed at Cam Pha area for ships with a deadweight tonnage of up to 20,000 tonnes. Estimated capacity of movement: 0.5 – 1.0 million tonnes/year by 2020; about 2.5 million tonnes/year by 2030.

+ Cam Pha terminal for general ships: Terminals are constructed at Con Ong islet area for general ships with a deadweight tonnage of 30,000 – 50,000 tonnes. Estimated capacity of movement: 3.5 million tonnes/year by 2020; 7 - 11 million tonnes/year by 2030.

- Yen Hung terminals (Chanh river, Bach Dang river, Nha Mac lagoon): includes terminals for general ships and dedicated ships for directly serving industrial parks behind the port. Comprising of:

+ Dedicated terminals for general ships: terminals are constructed in corresponding with the development of industrial parks behind the port; Chanh river terminals may receive ships with a deadweight tonnage of 10,000 – 50,000 tonnes; Bach Dang river terminals may receive ships with a deadweight tonnage of up to 20,000 tonnes (according to demand on development of Nha Mac lagoon industrial area). Estimated capacity of movement: 5 - 10 million tonnes/year by 2020; 10 – 15 million tonnes/year by 2030.

+ Dedicated terminals for liquid cargo are constructed at the left riverside of Chanh river (near Dao Qua Muom) or at the right riverside of Chanh river (at the upstream of Nosco – Vinalines Ship Repair Company) or Bach Dang river (at the area of Nha Mac lagoon industrial park). Terminals at Chanh river area may receive liquid cargo ships with a deadweight tonnage of up to 40,000 tonnes or above; terminals at Bach Dang river may receive ships with a deadweight tonnage of up to 20,000 tonnes. Estimated capacity of movement: 3 - 5 million tonnes/year by 2020; 6 – 10 million tonnes/year by 2030.

- Hai Ha terminals: terminals for general ships, dedicated terminals, terminals for container ships and liquid cargo ships. Hai Ha terminals include terminals attached to Hai Ha industrial are and Cai Chien terminal. Terminals are planned to be developed for ships with a deadweight tonnage of 30,000 - 80,000 tonnes in order to meet demand on cargo transport of Mong Cai border gate economic zone, Bac Phong Sinh border gate area, Hoanh Mo - Dong Van border gate area and industrial establishments at Hai Ha seaport and industrial zone. Terminals are developed in corresponding with the investment demand and capacity of investors in Hai Ha seaport and industrial zone.

- Van Gia terminal: Includes terminals for transshipment of cargo by using single-point moorings for ships with a deadweight tonnage of 5,000 - 10,000 tonnes and inland landing stages at Dan Tien for small-size ships and terminals on Ka Long river. Wharves attached to land shall be constructed at Van Gia area. Expected capacity of movement: 1.0 million tonnes/year.

- Mui Chua terminal: local terminal for ships with a deadweight tonnage of 1,000 – 3,000 tonnes. Estimated capacity of movement: 0.5 – 1.0 million tonnes/year.

- Van Don terminal for general ships (at the Northeast of Cai Bau island): a terminal for general ships, which shall be upgraded according to real demand of the economic zone. This terminal may receive ships with a deadweight tonnage of up to 10,000 tonnes (this terminal may receive international passenger ships after 2020 in case of need).

- Van Hoa terminal: a potential terminal serving the national defense and security.

- Co To island district terminal: a satellite and central terminal for exchanges with the land and serving the socio-economic development and the national defense & security.

- Buoy wharves and transport hubs:

+ Ha Long anchoring zone: shall not be upgraded. Remain capacity of movement as 5.0 million tonnes/year, comprising of: Hon Gai zone for ships with a deadweight tonnage of up to 30,000 tonnes, and Hon Phao zone for ships with a deadweight tonnage of 50,000 – 100,000 tonnes. Operations at transshipment sites shall be gradually cut down and stopped when Yen Hung terminals or Lach Huyen terminals are put into use and able to replace those transshipment sites.

+ Cam Pha anchoring zone: Estimated capacity of movement: 20.0 – 22.0 million tonnes by 2020, and 25.0 – 30.0 million tonnes by 2030, comprising of: Hon Ot anchoring zone for ships with a deadweight tonnages of up to 30,000 tonnes, Hon Con Ong anchoring zone for ships with a deadweight tonnages of up to 50,000 tonnes, Hon Net anchoring zone for ships with a deadweight tonnages of 70,000 – 120,000 tonnes or above.

+ Van Gia anchoring and transshipment site: Estimated capacity of movement: 1.0 million tonnes, receiving ships with a deadweight tonnages of up to 10,000 tonnes.

c) Thai Binh Seaport: Local multipurpose port (Class II), comprising Diem Dien terminals and Tra Ly terminals.

Estimated capacity of goods movement: 2.0 million tonnes/year by 2020; 6.25 million tonnes/year by 2030.

Detailed planning for primary terminals:

- Diem Dien terminals: includes Diem Dien terminal for general ships; Hai Ha oil terminal for ships with a deadweight tonnage of 1,000 – 3,000 tonnes; Hai Ha oil transport hub for ships with a deadweight tonnage of 30,000 – 50,000 tonnes. Estimated capacity of movement: 1.0 million tonnes/year by 2020; 2.25 million tonnes/year by 2030.

- Tra Ly terminals: terminals for general ships and dedicated terminals for shipbuilding and ship repair, and riverside industrial enterprises/ service providers for ships with a deadweight tonnage of 1,000 – 2,000 tonnes; estimated capacity of movement: 1.0 million tonnes/year by 2020; 4.0 million tonnes/year by 2030.

d) Hai Thinh – Nam Dinh Seaport: Local multipurpose port (Class II), comprising Hai Thinh terminals and dedicated terminal for Nam Dinh thermal power plant. Estimated capacity of good movement: 0.5 million tonnes/year by 2020; 6.25 million tonnes/year by 2030.

Detailed planning for primary terminals:

- Hai Thinh terminals: includes terminals on Ninh Co river (Hai Thinh, Hai Long terminals) for ships with a deadweight tonnage of 1,000 – 3,000 tonnes; dedicated terminals shall be constructed to serve industrial enterprises/ service providers. Estimated capacity of movement: 0.5 million tonnes/year by 2020; 1.25 million tonnes/year by 2030.

- Dedicated terminal for Nam Dinh thermal power plant: a dedicated terminal for the plant for ships with a deadweight tonnage of 1,000 – 2,000 tonnes. Estimated capacity of movemen (mainly, coal products): 5.0 million tonnes/year by 2030.

 (Estimated capacity of good movement at the port, and the scale, functions and capacity of each port in the Group are provided in the Annex enclosed to this Decision).

2. Port relocation

- B12 oil terminal, affiliated to Quang Ninh Seaport: shall be relocated to Yen Hung terminals before 2020 (under Decision No. 1037/QD-TTg dated June 24, 2014 by Prime Minister).

- Hoang Dieu terminal, affiliated to Hai Phong Seaport: The relocation plan must be conformable with the plan for construction of Nguyen Trai Bridge and the construction progress of Lach Huyen terminals.

3. Infrastructure development

- Port-connecting roads: Develop the infrastructure of roads connecting with seaports. Complete Tan Vu – Lach Huyen route, Ha Long – Hai Phong route; give priority to the construction of coastal roads; upgrade Highway 18, Highway 37 and Hoa River Bridge with the plan-based scale.

- Port-connecting railways: complete Cai Lan – Ha Long – Pha Lai – Yen Vien rail route with the length of 131 km, connecting with Cai Lan terminals. Ha Noi – Lao Cai, Ha Noi – Hai Phong rail routes shall be upgraded; Lao Cai - Ha Noi - Hai Phong rail route shall be constructed.

- Inland waterway: Effectively operate inland waterways connecting with Hai Phong and Quang Ninh seaports; Quang Ninh - Hai Phong - Thai Binh - Nam Dinh - Ninh Binh route (through Luoc river) shall be upgraded.

4. Plan for upgrade of shipping lanes

- Hai Phong lane:

+ Lach Huyen segment: serve ships with a deadweight tonnage of 100,000 tonnes partially loaded during 2020 – 2025; serve ships with a deadweight tonnage of up to 100,000 tonnes by and after 2030.

+ Ha Nam – Bach Dang segment: Maintain capacity for ships with a deadweight tonnage of 10,000 tonnes fully loaded, and more than 10,000 tonnes partially loaded.

+ Segment on Cam river: maintain the shipping lane to serve ships with a deadweight tonnage of 10,000 tonnes, utilize the water level to enter the port.

- Cai Lan lane:

+ Lach Mieu – Dau Trau – Hon Mot segment: Maintain operation at the natural depth.

+ Segment from Hon Mot to Cai Lan terminals: serve voyages of ships with a deadweight tonnage of up to 50,000 tonnes.

+ Dedicated segment at the upstream of terminal No. 1 of Cai Lan port: maintain its operation.

- Cam Pha lane: Maintain available conditions for operation. This lane shall be developed in the next period according to requirements by the port on the basis of available shipping lane.

- Chanh river lane entering Yen Hung terminals: this land shall be upgraded for general ships with a deadweight tonnage of up to 30,000 tonnes during 2020 – 2025, and for ships carrying liquid cargo with a deadweight tonnage of up to 40,000 tonnes and general ships with a deadweight tonnage of up to 50,000 tonnes by and after 2030.

- Diem Dien lane: maintain operation of this lane and guarantee conditions for operation of terminals in appropriate way. The stable accommodation of this shipping lane shall be considered as the basis for upgrading this lane to serve ships with a deadweight tonnage of 1,000 – 3,000 tonnes.

5. Projects given priority by 2020

- Navigable channel to Hai Phong seaport – Lach Huyen segment: complete the port works on planned progress, including shipping lanes, sand dykes, breakwater, etc. shall be put into use in Quarter II, 2018.

- Lac Huyen terminals: 02 terminals for container ships shall be constructed at Lach Huyen terminals; the commencement period must be in line with the construction progress of shipping lanes. Other terminals (terminals for container ships and general ships) shall be constructed in conformity with the planning.

- Cai Lan terminals: terminals for general ships shall be constructed in conformity with demand on movement of goods through the port.

IV. Policies and solutions1. Solution for management of planning implementation

- Apply model of port operation and management board to Lach Huyen terminals and other terminals if possible.

- Enhance private sector involvement in development of seaport infrastructure under PPP form (BOT, BTO, etc.). Enhance investment promotion, encourage and enable all domestic and foreign economic sectors to invest in seaport development under regulated investment forms; encourage investors of economic zones and industrial zones to invest in seaport infrastructure and port-connecting infrastructure.

- State budget shall focus on investment in public infrastructure works (shipping lanes, breakwaters, etc.) attached to important seaports/ terminals. The investment in terminals under this planning shall be carried out under the form of private sector involvement. Investors shall be responsible for sources of capital of their proposed terminals and efficiency of their investment in seaports and port-connecting infrastructure.

- If an investor applies for being invested in a wharf/terminal with a scale (in term of deadweight tonnage of received ships) larger than the planned scale, Ministry of Transport shall considers approving the investor’s application on the basis of specific types of goods, types of ships receiving goods at the port but such invested wharf/terminal shall not cause change in the port’s purposes; at the same time, that investor must assume responsibility for investment efficiency of his/her project.

- Keep boosting administrative procedure reform in management of investment and port operation towards simplification and international integration. Improve state management during the planning implementation.

- Provide land area behind the ports to build goods distribution centers which plan the role as logistics centers.

- Detailed planning for construction of terminals should take into account the planning for office of port authorities and regulatory bodies at new terminals to ensure conveniently and effectively state management of them.

2. Solution for buoy wharves and transport hubs

- Buoy wharves and transport hubs under the planning shall be planned and stably invested and operated for a long term in conformity with the general planning of the port as wharves/terminals. 

- Temporary buoy wharves and transport hubs shall not be planned but licensed to operate for a fixed term of not exceeding 5 years when buoy wharves and transport hubs under the planning are unable to meet actual demand on goods movement. Investors in buoy wharves must stop their operation and dismantle them when licensed operation duration expires.

Article 2. Management and organization of planning implementation

1. Vietnam Maritime Administration

- Preside over and cooperate with departments/ boards/ regulatory bodies of provinces or cities and relevant agencies in publishing and managing implementation of approved planning.

- Preside over and cooperate with departments/ boards/ regulatory bodies of provinces or cities and relevant agencies in counseling Ministry of Transport to consider approving new investment or upgrade of wharves/terminals. 

- Take charge of the appraisal and request Ministry of Transport to consider and decide the updates or adjustments to the scale, functions or construction progress of wharves/ terminals.

- With regard to potential ports/ terminals, based on actual demand and at the request of investors and people’s committees of provinces/ cities, Vietnam Maritime Administration shall submit an aggregated report to Ministry of Transport for consideration.

- Do research and propose specific policies for management and operation of permanent/temporary buoy wharves and transport hubs.

- Regularly coordinate with local government and relevant agencies in carrying out the inspection of the implementation of planning for seaports; propose actions against projects that fail to comply with the planning; annually report to Ministry of Transport on the planning implementation.

2. People’s committees of central-affiliated cities or provinces

- Give instructions in formulation of local planning in conformity with the approved detailed planning for the Group of seaports; pursuant to the approved planning, strictly manage land area dedicated to port construction; provide land area according to the planning for harmonious development of ports and infrastructure connected thereto, logistics centers and maritime service centers in order to ensure smooth operation of seaports.

- Before allocating land/ waters within the planning area for construction of seaports/terminals or issuing a certificate of investment to a seaport construction project, people’s committees of provinces/ cities must reach an agreement with the Ministry of Transport in contents related to the port planning (the purpose, scale and progress of investment) as regulated. Based on that agreement, Ministry of Transport shall instruct Vietnam Maritime Administration and provincial port authorities to strictly coordinate with local government in supervising and managing the planning implementation.

- Instruct provincial competent authorities to strictly coordinate with Vietnam Maritime Administration in preparing, appraisal and applying for approval for detailed planning for terminals; propose updates, supplements or adjustments to detailed planning for seaports/ terminals to Ministry of Transport in accordance with regulations.

Article 3. This Decision comes into force from the day on which it is signed and replaces Decision No. 1741/QD-BGTVT dated August 03, 2011 of the Minister of Transport.

Article 4. Chief of Office, Chief Inspector of the Ministry of Transport, Directors of Departments, Director of Vietnam Maritime Administration, heads of relevant organizations and individuals are responsible for the implementation of this Decision./.
