DECREE
ON EDUCATIONAL UNIVERSALIZATION OR ILLITERACY ERADICATION
Pursuant to the Law on Organization of Government dated 25 December, 2001;
Pursuant to the Educational Law dated 14 June, 2005, the Law amending and supplementing some articles of the Education Law dated 25 November, 2009;
At the request of the Minister of Education and Training,
The Government issues the Decree on educational universalization or illiteracy eradication;
Chapter I
GENERAL PROVISIONS
Article 1. Scope of adjustment and subjects of application
1. This Decree provides for conditions to ensure responsibility of organs, standard, authority and dossier for recognized standard achievement of preschool educational universalization for 5-year children, primary and secondary educational universalization (hereafter referred to as educational universalization) and illiteracy eradication.
2. This Decree applies to Vietnamese citizens living in Vietnam and related organizations and individuals.
Article 2. Policy on educational eradication or illiteracy eradication
1. The State gives the priority to the investment and creates favorable conditions for educational establishments of the national educational system to implement the educational universalization or illiteracy eradication; encourages and creates favorable conditions for international organizations, foreigners and oversea Vietnamese to participate in educational universalization or illiteracy eradication in Vietnam under regulations of law.
2. The State implements the support policy to the people subject to reduction or exemption from school fees and support to learning costs when participating in the prescribed programs of educational universalization or illiteracy eradication.
3. Individuals participating in organization, management, teaching ...to carry out the educational universalization or illiteracy eradication shall receive the remuneration as prescribed by the State.
Article 3. Responsibility of citizens, families and educational establishments for the educational universalization or illiteracy eradication
1. All citizens in the prescribed age must learn to achieve the level of educational universalization or illiteracy eradication;
2. Families are responsible for creating favorable conditions for their members in the prescribed age to learn to achieve the level of educational universalization or illiteracy eradication;
3. The educational establishments are responsible for implementation of educational universalization or illiteracy eradication according to their functions and duties.
Chapter II
EDUCATIONAL UNIVERSALIZATION
Section 1: PRESCHOOL EDUCATIONAL UNIVERSALIZATION FOR 5-YEAR CHILDREN
Article 4. Subjects of preschool educational universalization for 5-year children
The subjects of preschool educational universalization for children are 5-year children who have not finished the preschool educational program.
Article 5. Educational program for preschool educational universalization for 5-year children
The educational program for preschool educational universalization for 5-year children is a preschool educational program for preschool children at the age of 5 to 6 years old.
Article 6. Criteria for recognized standard achievement of preschool educational universalization for 5-year children
1. For individuals: Finished the preschool educational program
2. For communes, wards and towns (referred to as communes)
a) The percentage of 5-year children attending school must reach at least 95% and 90% for communes with extremely difficult socio-economic conditions;
b) The percentage of 5-year children finishing the preschool educational program must reach at least 85% and 80% for communes with extremely difficult socio-economic conditions;
3. For districts, towns and provincial cities (hereafter referred to as district): At least 90% of communes must be recognized to have met the standard of preschool educational universalization for 5-year children.
4. For provinces and centrally-run cities (hereafter referred to as province): There must be 100% districts recognized to have met the standard of preschool educational universalization for 5-year children.
Section 2: PRIMARY EDUCATIONAL UNIVERSALIZATION
Article 7. Subjects of primary educational universalization
The subjects of primary educational universalization are children from 6 to 14 years old who have not finished the primary educational program.
Article 8. Educational program for primary educational universalization
The educational program for primary educational universalization is the general educational program at primary level.
Article 9. Criteria for recognized standard achievement of primary educational universalization at level 1
1. For individuals: Must finish the primary educational program.
2. For communes:
a) The percentage of 6-year old admitted to form 01 must reach at least 90%;
b) The percentage of 14-year children finishing the primary educational program must reach at least 80% and 70% for communes with extremely difficult socio-economic conditions;
3. For districts: At least 90% of communes must be recognized to have met the standard of primary educational universalization at level 1.
4. For provinces: There must be 100% districts recognized to have met the standard of primary educational universalization at level 1.
Article 10. Criteria for recognized standard achievement of primary educational universalization at level 2
1. For communes:
a) Ensuring criteria for recognized standard achievement of primary educational universalization at level 1;
b) The percentage of 6-year old admitted to form 01 must reach at least 95%;
c) The percentage of 11-year children finishing the must reach at least 80% and 70% for communes with extremely difficult socio-economic conditions; the remaining 11-year children are attending primary classes.
2. For districts: At least 90% of communes must be recognized to have met the standard of primary educational universalization at level 2.
3. For provinces: There must be 100% districts recognized to have met the standard of primary educational universalization at level 2.
Article 11. Criteria for recognized standard achievement of primary educational universalization at level 3
1. For communes:
a) Ensuring the criteria for recognized standard achievement of primary educational universalization at level 2;
b) The percentage of 6-year old admitted to form 01 must reach at least 98%;
c) The percentage of 11-year children finishing the must reach at least 90% and 80% for communes with extremely difficult socio-economic conditions; the remaining 11-year children are attending primary classes.
2. For districts: At least 90% of communes must be recognized to have met the standard of primary educational universalization at level 3.
3. For provinces: There must be 100% districts recognized to have met the standard of primary educational universalization at level 3.
Section 3: SECONDARY EDUCATIONAL UNIVERSALIZATION
Article 12. Subjects of secondary educational universalization
The subjects of secondary educational universalization are youths and teenagers from 11 to 18 years old who have finished the primary educational program but not yet finished the secondary educational program.
Article 13. Educational program for secondary educational universalization
The educational program for secondary educational universalization is the general educational program at secondary level.
Article 14. Criteria for recognized standard achievement of secondary educational universalization standard at level 1
1. For individuals: Granted with Certificate of secondary education.
2. For communes:
a) Ensuring the criteria for recognized standard achievement of secondary educational universalization standard at level 1 and criteria for recognized illiteracy eradication standard at level 1;
b) The percentage of youths and teenagers from 15 to 18 years old graduating from secondary educational level must reach at least 80% and 70% for extremely difficult social-economic conditions.
3. For districts: At least 90% of communes must be recognized to have met the standard of secondary educational universalization at level 1.
4. For provinces: There must be 100% districts recognized to have met the standard of secondary educational universalization at level 1.
Article 15. Criteria for recognized standard achievement of secondary educational universalization at level 2
1. For communes:
a) Ensuring the criteria for recognized standard achievement of secondary educational universalization at level 1;
b) The percentage of youths and teenagers from 15 to 18 years old graduating from secondary educational level must reach at least 90% and 80% for extremely difficult social-economic conditions.
2. For districts: At least 95% of communes must be recognized to have met the standard of secondary educational universalization at level 2.
3. For provinces: There must be 100% districts recognized to have met the standard of secondary educational universalization at level 2.
Article 16. Criteria for recognized standard achievement of secondary educational universalization at level 3
1. For communes:
a) Ensuring criteria for recognized standard achievement of secondary educational universalization at level 2;
b) The percentage of youths and teenagers from 15 to 18 years old graduating from secondary educational level must reach at least 95% and 90% for extremely difficult social-economic conditions.
c) The percentage of youths and teenagers from 15 to 18 years old attending the general educational program or continuing educational program at high school level or vocational education must reach at least 80% and 70% for extremely difficult social-economic conditions.
2. For districts: There must be 100% of communes recognized to have met the standard of secondary educational universalization at level 3.
3. For provinces: There must be 100% districts recognized to have met the standard of secondary educational universalization at level 3.
Chapter III
ILLITERACY ERADICATION
Article 17. Subjects of illiteracy eradication
The subjects of illiteracy eradication are people from 15 to 60 years old with illiteracy.
Article 18. Educational program for illiteracy eradication
The educational program for illiteracy eradication is the primary educational program or illiteracy eradication and continuing educational program after literacy.
Article 19. Criteria for individuals to be recognized as standardized literates
1. Standardized literates at level 1: Finished the stage 1 of illiteracy eradication and continuing educational program after literacy or finished the form 3 of primary educational program.
2. Standardized literates at level 2: Finished the stage 2 of illiteracy eradication and continuing educational program after literacy or finished the primary educational program.
Article 20. Criteria for individuals to be recognized as standardized illiteracy eradication at level 1
1. For communes: At least 90% of people from 15 to 35 years old are recognized as standardized literates at level 1 and at least 90% for communes with extremely difficult social-ecomic conditions with people from 15 to 25 years old to be recognized as standardized literates at level 1.
2. For districts: At least 90% of communes are recognized as standardized literacy eradication at level 1.
3. For provinces: At least 90% of districts are recognized as standardized literacy eradication at level 1.
Article 21. Criteria for individuals to be recognized as standardized illiteracy eradication at level 2
1. For communes: At least 90% of people from 15 to 60 years old are recognized as standardized literates at level 2 and at least 90% for communes with extremely difficult social-ecomic conditions with people from 15 to 35 years old to be recognized as standardized literates at level 2.
2. For districts: At least 90% of communes are recognized as standardized literacy eradication at level 2;
3. For provinces: There must be 100% of districts recognized as standardized literacy eradication at level 2.
Chapter IV
CONDITIONS FOR ENSURING EDUCATIONAL UNIVERSALIZATION OR ILLITERACY ERADICATION
Article 22. Persons participating in teaching and monitoring educational universalization and illiteracy
1. Teachers at preschool educational establishments, general educational establishments, continuing educational establishments, vocational educational establishments and other educational establishments.
2. People meeting the conditions under the provisions of Education Law and the Law amending and supplementing somes articles of the Education Law.
3. In special cases, other individuals can be mobilized to participate in teaching for illiteracy eradication.
4. The preschool educational establishments, general educational establishments, continuing educational establishments should appoint their employees to monitor the educational universalization or illiteracy eradication in the assigned areas.
Article 23. Teaching facilities and equipment
1. The establishments participating in the educational universalization must have sufficient teaching facilities and equipment at a prescribed minimum to organize educational activities under the educational universalization program.
2. The educational establishments, community learning centers, organs and organizations can use their facilities for implementation of illiteracy eradication.
3. Encouraging social-political organizations, other organizations and individuals to create facility conditions for educational universalization or illiteracy eradication.
Article 24. Financial sources for educational universalization or illiteracy eradication
The funding for educational universalization or illiteracy eradication is balanced in the annual state budget estimate as per decentralization and mobilization from domestic and foreign organizations, enterprises, individuals and community.
Chapter V
AUTHORITY, DOSSIER, PROCEDURES AND TIME FOR INSPECTION AND RECOGNIZED STANDARD OF EDUCATIONAL UNIVERSALIZATION OR ILLITERACY ERADICATION
Article 25. Authority to inspect and recognize the standard of educational universalization or illiteracy eradication
1. District People’s Committee shall inspect and issue decision on recognized standard of educational universalization or illiteracy eradication towards communes.
2. Provincial People’s Committee shall inspect and issue decision on recognized standard of educational universalization or illiteracy eradication towards districts.
3. The Ministry of Education and Training shall inspect and issue decision on recognized standard of educational universalization or illiteracy eradication towards provinces.
Article 26. Dossier for recognized standard achievement of educational universalization or illiteracy eradication of communes
1. The dossier for educational universalization or illiteracy eradication includes:
a) Survey form of educational universalization or illiteracy eradication;
b) Monitoring book of educational universalization or illiteracy eradication;
c) List of children finishing the preschool educational program (for preschool educational universalization); list of pupils finishing the primary educational program (for primary educational universalization); list of pupils finishing the secondary education; list of pupils having vocational certificate (for secondary educational universalization); list of learners recognized as literates at different levels (for illiteracy eradication).
2. The dossier for recognized standard achievement of communes includes:
a) Report on implementation process and result of educational universalization or illiteracy eradication enclosed with statistical tables;
b) Record of self-inspection of educational universalization or illiteracy eradication.
Article 27. Dossier for recognized standard achievement of educational universalization or illiteracy eradication towards districts
1. Report on implementation process and result of educational universalization or illiteracy eradication enclosed with statistical tables;
2. Record of inspection of educational universalization or illiteracy eradication of districts toward communes.
3. Decision on recognized standard of educational universalization or illiteracy eradication towards communes.
Article 28. Dossier for recognized standard achievement of educational universalization or illiteracy eradication towards provinces
1. Report on implementation process and result of educational universalization or illiteracy eradication enclosed with statistical tables;
2. Record of inspection of educational universalization or illiteracy eradication of provinces towards districts.
3. Decision on recognized standard of educational universalization or illiteracy eradication towards districts.
Article 29. Contents of inspection and recognized standard achievement of educational universalization or illiteracy eradication
1. Inspecting dossiers of educational universalization or illiteracy eradication and inspecting the actual result of implementation of educational universalization or illiteracy eradication.
2. Issuing decision on recognition of standard achievement of educational universalization or illiteracy eradication towards communes, districts or provinces if meeting standard specified in this Decree.
Article 30. Procedures for inspection and recognition of standard achievement of educational universalization or illiteracy eradication
1. Communes shall make inspection by themselves and prepare dossiers to request the recognition of educational universalization or illiteracy eradication from districts.
2. Districts shall inspect and recognize communes and prepare dossiers to request provinces to inspect and recognize the standard achievement of educational universalization or illiteracy eradication towards districts.
3. Provinces shall inspect and recognize districts and prepare dossier to request the Ministry of Education and Training to inspect and recognize the standard achievement of educational universalization or illiteracy eradication towards provinces.
4. The Ministry of Education and Training shall inspect and recognize the standard achievement of educational universalization or illiteracy eradication towards provinces.
Article 31. Time to inspect and recognize the standard achievement of educational universalization or illiteracy eradication
1. The time to make annual report on statistical data of educational universalization or illiteracy eradication is stipulated as follows:
a) For communes: On 30th of September
b) For districts: On 05th of October
c) For provinces: On the 10th of October
2. The provinces shall finish the inspection and recognition of standard achievement of educational universalization or illiteracy eradication by the 30th of December of each year.
Chapter VI
RESPONSIBILITY FOR STATE MANAGEMENT OF EDUCATIONAL UNIVERSALIZATION OR ILLITERACY ERADICATION
Article 32. Responsibility of the Ministry of Education and Training
1. Develops and requests the organs having their authority to issue or issue under its authority the policies and regulations of law on implementation of educational universalization or illiteracy eradication.
2. Provides instructions for localities on developing and planning school network for the need of educational universalization or illiteracy eradication.
3. Issues and provides instructions on implementing the teaching programs and materials for educational universalization or illiteracy eradication.
4. Provides instructions for localities to implement regulations on profession, training and benefits for persons participating in educational universalization or illiteracy eradication.
5. Takes charge and coordinate with the Ministry of Finance to develop the benefits and policies towards educational universalization or illiteracy eradication.
6. Organizes the examination and inspection of implementation of educational universalization or illiteracy eradication and inspects and recognize the standard achievement of educational universalization or illiteracy eradication towards provinces.
7. Make annual summary of result of educational universalization or illiteracy eradication for report to the Prime Minister.
Article 33. Responsibility of the Ministry of Home Affairs
Takes charge and coordinates with the Ministry of Education and Training to provide instructions on method of identifying work positions and a number of people working at public educational establishments to implement the educational universalization or illiteracy eradication.
Article 34. Responsibility of the Ministry of Finance
Takes charge and coordinates with the Ministry of Education and Training, the Ministry of Planning and Investment and provinces and centrally-run cities to aggregate the estimated funding for educational universalization or illiteracy eradication to make report to the competent authorities for review and decision on balance in the annual state budget estimate as per decentralization.
Article 35. Responsibility of the Ministry of Planning and Investment
Takes charge and coordinates with the Ministry of Finance, the Ministry of Education and Training to balance the Central assistance for educational universalization or illiteracy eradication.
Article 36. Responsibility of other Ministries, sectors, social-economic organizations and other organizations
1. The other Ministries and sectors shall participate in educational universalization or illiteracy eradication under their assigned functions and duties.
2. The social-economic organizations and other organizations shall participate in educational universalization or illiteracy eradication within their functions and duties.
Article 37. Responsibility of provincial People’s Committees
1. Direct the implementation of school network planning and school upgrading for educational universalization or illiteracy eradication.
2. Direct the implementation of provincial plan for educational universalization or illiteracy eradication.
3. Inspect and recognize the standard achievement of educational universalization or illiteracy eradication towards districts.
4. Inspect and recognize the implementation of educational universalization or illiteracy eradication.
5. Issue policies in accordance with the social-economic conditions of localities to accelerate the educational universalization or illiteracy eradication in the provincial areas.
Article 38. Responsibility of district People’s Committees
1. Direct the implementation of school network planning and school upgrading for educational universalization or illiteracy eradication.
2. Direct the implementation of district plan for educational universalization or illiteracy eradication.
3. Inspect and recognize the standard achievement of educational universalization or illiteracy eradication towards communes.
4. Propagate and mobilize organizations and individuals to participate in educational universalization or illiteracy eradication.
Article 39. Responsibility of communal People’s Committees
1. Develop and implement the communal plan for educational universalization or illiteracy eradication.
2. Implement educational universalization or illiteracy eradication in the communal areas.
3. Propagate and mobilize organizations and individuals to coordinate with educational establishments in the areas to implement the universalization or illiteracy eradication.
Chapter VII
IMPLEMENTATION PROVISION
Article 40. Effect
1. This Decree takes effect from 15 May 2014.
2. The Decree No. 88/2001/ND-CP dated 22 November 2001 on educational secondary universalization shall be invalidated from the effective date of this Decree.
Article 41. Implementation responsibility
1. The Minister of Education and Traning provides the instructions on implementing this Decree.
2. The Ministers, Heads of ministerial-level organs, Heads of government-attached organs and Chairmen of People’s Committees of provinces and centrally-run cities are liable to execute this Decree./.
