DECISION
APPROVING THE SCHEME ON PILOT INNOVATION OF OPERATIONAL MECHANISM OF HANOI UNIVERSITY DURING 2015 - 2017
PRIME MINISTER
Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Law on Education dated June 14, 2005;
Pursuant to the Law on Higher Education dated June 18, 2012;
Pursuant to the Government’s Decree No. 49/2010/ND-CP dated May 14, 2010; the Government’s Decree No. 74/2013/ND-CP dated July 15, 2013 amending certain articles of the Government’s Decree No. 49/2010/ND-CP dated May 14, 2010 on reduction and exemption of tuition fees, support for learning cost, collection and use of tuition fees applicable to educational institutions belonging to the national education system from the 2010 - 2011 academic year to the 2014 - 2015 academic year;
Pursuant to the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017;
Pursuant to the University Charter promulgated under the Decision No. 70/2014/QD-TTg dated December 10, 2015 by the Prime Minister;
Considering the request of the President of Hanoi University,
DECIDES:
Article 1. To approve the Scheme on pilot innovation of the operational mechanism of Hanoi University during 2015 - 2017 (referred to as the Scheme) with the following principal contents:
I. OBJECTIVES
1. General objectives
Hanoi University (referred to as “HANU”) shall actively, reasonably and effectively utilize its resources to innovate and improve its operational quality in a comprehensive manner, aim to become a multidisciplinary university towards the international integration; and provide opportunity to approach HANU’s training programs for poor students and social policy beneficiaries.
2. Specific objectives
a) Improve training quality and ensure learners are trained to meet standards of graduate quality as committed by HANU; are provided with the opportunity of approaching scientific and technological applications; and are provided with skill training and improvement of professional ethics.
b) Develop training programs by referring training programs of reputable tertiary education institutions in the world for meeting social needs.
c) Develop training scale in a reasonable way in conformity with HANU’s sources; attach special importance to high-quality training programs and ordered programs.
d) Step up the scientific research, including fundamental research and applied research. Increase revenues from the scientific research and technological transfer.
dd) Strengthen the international cooperation for integrating into higher education system in a wide and deep manner, supporting and stepping up HUNA's training activities and scientific research.
e) Evolve HUNA’s organizational structure and personnel under the model of a reputable tertiary education institution in the world; revise procedures and apply information technology to the quality management system for improving HUNA’s managerial capacity; create environment and conditions for developing HUNA’s potentials and strengths in the best way.
g) Fulfill the social responsibility of the public tertiary education institution with scholarship and study encouragement policies and student credit policies; facilitate poor students, social policy beneficiaries and student with difficult circumstance in getting opportunity to study at this university.
II. INNOVATION CONTENTS
1. Performance of scientific research and training duties
a) Make decisions on opening training disciplines and specialties in undergraduate level, master’s level and doctoral level to meet social needs in conformity with the HANU’s development orientations when having sufficiently satisfied all requirements as prescribed by law.
b) Determine enrollment quotas and organize the enrollment under HANU's enrollment plan in a transparent manner, and implement the enrollment priority policy as regulated.
c) Make decisions on training activities (training programs, teaching methods; languages; methods of examination and testing to assess learning results; textbooks, learning materials and management of training; printing, issuance and management of diplomas and certificates); ensure graduate quality as committed by HANU.
d) Carry out the educational quality accreditation as regulated; conduct international quality accreditation step by step.
dd) Make decisions on the training cooperation with reputable domestic and foreign educational facilities; organize the implementation of training cooperation programs.
e) Make decisions on scientific research activities; encourage the application and transfer of scientific research results while taking into account the market demands and social needs; make decisions on participation in scientific and technological tasks, scientific and technological services, and organization of seminars in coordination with domestic and foreign entities.
g) Provide public non-business services in the fields of education and training, and science and technology, including those under orders placed by the State.
2. Organizational apparatus
a) Decide and assume responsibility for the establishment, re-structuring, merger, division, separation and dissolution of its affiliated units; define functions, tasks and operational regulations of its affiliated units for ensuring the apparatus’s operational effectiveness.
b) Make decisions on the structure and number of its employees, job positions; recruit, manage, use and develop public employees and contract employees on the basis of regulations and policies approved by the university council in conformity with HANU’s development requirements; sign employment contracts and labor contracts, manage, use and terminate such contracts in accordance with law.
c) Sign labor contracts with domestic and foreign lecturers, scientists and managers to perform HANU’s teaching activities and scientific research, and satisfy requirements on training quality assurance.
3. Finance
a) Tuition
- HANU shall collect tuition on the stable basis in accordance with the following plan:

- HANU must calculate and publicly announce specific tuition rates for groups of training disciplines and specialties, and training programs before the enrollment, ensuring that the maximum tuition rate (of general programs) shall not exceed HANU’s maximum tuition rate as prescribed in this Decision.
- HANU shall make decision on the ceiling tuition rates of doctoral programs and master’s programs which shall be, respectively, 2.5 times and 1.5 times the maximum tuition rate stated above.
- The tuition rate of continuing education programs shall not exceed 1.5 times the tuition rate of full-time programs of the same level and group of training disciplines.
- As for students who enrolled before the effective date of this Decision, HANU shall increase the tuition rate as of the effective date of this Decision provided that the maximum increase rate of the following academic year shall not exceed 30% of the tuition rate of the previous academic year.
b) Non-business revenues
HANU shall perform training support activities and services to improve training quality and serve learners. Revenues from these activities are determined on the principle of covering expenses and making reasonable accumulations.
c) Salaries and incomes
Apart from rank and grade-based salaries as prescribed by the State, HANU shall decide additional incomes for its employees by using the positive difference between revenues and expenses in accordance with its internal spending regulations, ensuring the impartiality and transparency.
d) Use of revenues
- Exercise the autonomy in making plans and decisions on using HANU’s lawful revenues to improve material facilities, train its personnel and ensure the quality of training and scientific research.
- After covering recurrent expenses, HANU’s remaining positive difference between revenues and expenses may be used to set aside to the following funds: the fund for the development of non-business activities (at least 25% of such different amount), the award fund, the welfare fund, the fund for income stabilization and student assistance funds.
- Collected tuition and other non-business revenues shall be deposited at commercial banks, and entire amount of interests of such deposits shall be used to set aside student assistance funds.
4. Policies on scholarships and tuition
a) HANU shall support for the entire different amount between its tuition rate and the reduced or exempted amount as regulated by State for students who are policy beneficiaries and poor students as of the enrolment course following the effective date of this Decision.
b) Other than students who are eligible for tuition reduction and exemption under State’s policies, HANU establishes and implement policies on scholarship and study encouragement for students with excellent achievements and policy beneficiaries.
5. Investment and purchase
a) Actively balance revenues and mobilize other lawful sources for making investment in the overall development of material facilities in conformity with HANU’s development plan.
b) Make decisions on plans and estimates; give approval for the implementation of investment projects on fundamental development and procurement of equipment for improving material facilities in compliance with regulations on procurement of public assets and regulations on investment in fundamental development promulgated by State regulatory bodies.
c) Make decisions on the use of HANU’s assets, material facilities and brand value for entering into joint ventures or associations for carrying out training and educational activities, scientific and technological activities, organizing and providing services compatible with its professional fields.
6. Regulations on supervision
a) The university council shall make decision on operational strategies and orientations of HANU; supervise the implementation of resolutions made by the university council, the execution of democracy regulations on its activities and the implementation of this Decision.
b) HANU shall publicly announce its internal spending regulations. HANU’s internal spending regulations shall be annually amended and supplemented by means of taking opinions in the whole university, and approved at its meeting of delegates of officials, public employees.
c) HANU shall publicly announce regulations on supervision of lecturers, officials, public employees and learners on the operation of HANU’s leading apparatus.
7. HANU shall exercise other rights and obligations as regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017 and other relevant documents.
Article 2. Implementation
1. Relevant ministries, regulatory bodies and local governments shall, within the ambit of their functions and tasks regulated in the Government’s Resolution No. 77/NQ-CP dated October 24, 2014 on the pilot renovation of the operational mechanism of public tertiary education institutions during 2014-2017 and other relevant documents, perform the supervision and give assistance to HANU during the implementation of this Decision.
2. Relevant state authorities shall provide guidance and assistance to HANU during the implementation of its investment and construction projects.
Article 3. This decision takes effect from the day on which it is signed.
Article 4. Ministers, Heads of ministerial-level agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, President of HANU, heads of relevant agencies and relevant entities shall implement this Decision./.
