DECISION
ON FUNCTIONS, DUTIES, RIGHTS AND ORGANIZATIONAL STRUCTURE OF VIETNAM INSTITUTE OF SCIENCE TECHNOLOGY AND INNOVATION AFFILIATED TO THE MINISTRY OF SCIENCE AND TECHNOLOGY
Pursuant to the Law on Government organization dated June 19, 2015;
Pursuant to the Law on Science and Technology dated June 18, 2013;
Pursuant to the Law on Education dated June 14, 2005 and the Law on amendments to the former Law dated November 25, 2009;
Pursuant to the Law on Tertiary Education dated June 18, 2012;
Pursuant to Decree No.123/2016/ND-CP dated September 01, 2016 of the Government on functions, duties, rights and organizational structure of ministries and ministerial agencies;
Pursuant to Decree No.95/2017/ND-CP dated August 16, 2017 of the Government on functions, duties, rights and organizational structure of the Ministry of Science and Technology;
At the request of the Minister of Science and Technology;
The Prime Minister promulgates a Decision on functions, duties, rights and organizational structure of Vietnam Institute of Science, Technology and Innovation.
Article 1. Positions and functions
1. Vietnam Institute of Science, Technology and Innovation (VISTI) is a public scientific research center affiliated to the Ministry of Science and Technology which carries out scientific and technological research and innovation; provides doctoral and master's training programs; advanced training in techniques for science and technology management and innovation; give assistance in innovation and startups; provide advisory service and science and technology services.
2. VISTI is recognized as a legal person and has its own stamp and account and head office located in Hanoi.
3. VISTI shall operate under regulations on organization and operation issued by the Ministry of Science and Technology and other relevant law provisions.
Article 2. Duties and rights
1. In terms of scientific research:
a) Conduct methodological and empirical research on science, technology and innovation strategies and policies;
b) Conduct research on strategies, planning schemes, plans and policies for management of science and technology and innovation serving state management performed by the Ministry of Science and Technology; give advice to the Minister of Science and Technology about formulation and implementation of policies on science, technology and innovation;
c) Study, develop and apply priority and advanced technology in some sectors;
d) Conduct research serving training and advanced training provided by VISTI;
dd) Cooperate with domestic and foreign universities, institutes, academies, research centers and organizations and individuals as assigned and authorized.
2. In terms of training and advanced training:
a) Provide training and grant doctoral degrees and master’s degrees as per law provisions;
b) Develop and implement programs and plans for training and advanced training in professional skills and techniques. Grant certificates and diplomas to student enrolling on training/advanced training courses held by VISTI as per law provisions;
c) Provide joint-doctoral and master's training programs, training/advanced training course in professional skills and techniques in cooperation with domestic and foreign training institutions, research institutes, organizations and individuals as assigned and authorized.
3. Participate in formulation of strategies, plans, planning schemes, policies and laws on science, technology and innovation; launch and assess science, technology and innovation strategies and policies.
4. Write and publish documents and magazines about research results, textbooks and teaching material of management of science and technology and innovation as well as relevant fields as per law provisions.
5. In terms of assistance in and innovation and startup activities:
a) Provide assistance in development of startup ideas;
b) Carry out, assist in technology incubation, incubation and development of scientific and technological enterprises, startups;
c) Establish, use and operate co-working spaces;
d) Associate and cooperate with domestic and foreign training institutions, research institutes, enterprises, organizations and individuals in innovation and startup as assigned and authorized.
6. Seek international cooperation as per law provisions.
7. Provide advisory services and training/advanced training, transfer technology, copyright, intellectual property rights, provide services, production and trading as authorized and assigned under cooperation, association or joint-venture agreements with domestic and foreign organizations and individuals under law provisions on financial-autonomy public service providers.
8. Propose special policies intended for VISTI to the competent authority; propose development orientation plan, annual or period-based plans/programs for VISTI’s operation to the Minister of Science and Technology for approval and implement the approved plans/programs.
9. Manage officials, public employees, workers, finance and assets as per law provisions and as authorized by the Ministry of Science and Technology.
10. Perform other duties and rights as assigned or authorized by the Minister of Science and Technology and competent authorities as per law provisions.

4. Institute for Science and Technology Policy and Strategy Studies
5. Institute for Advanced Technology Research and Development
6. Center for Training/advanced training in management of science and technology
7. Science and Technology Service Center
8. Department of International and Postgraduate Education
The Minister of Science and Technology shall decide to establish public science and technology organizations operating under financial autonomy mechanism affiliated to VISTI as per law provisions.
The Minister of Science and Technology shall regulate duties, rights and organizational structure and decide or authorize to decide appointment and dismissal of heads and deputies of organizations affiliated to VISTI.
Article 4. Leaders
1. VISTI has one Director and no more than 3 Deputy Directors.
2. The Director shall be appointed and dismissed by the Minister of Science and Technology after gaining opinions from the Prime Minister.
3. Deputy Directors shall be appointed and dismissed by the Minister of Science and Technology as per law provisions and Communist Party's regulations.
4. The Director shall be accountable to the Minister of Science and Technology and the law for all operations of VISTI. Deputy Directors shall be accountable to VISTI’s Director, Minister of Science and Technology and the law for the jobs assigned.
Article 5. Entry into force
This Decision comes into force from April 10, 2018.
Article 6. Implementation responsibility
Ministers, Directors of ministerial agencies and Governmental agencies, Chairperson of People’s Committees of provinces and centrally-affiliated cities, Director of VISTI and relevant agencies and organizations shall take responsibility to implement this Decision./.
