CIRCULAR

ON Amendments to Certain Articles of Circular No. 32/2011/TT-BKHCN and Circular No. 03/2014/TT-BKHCN

Pursuant to the Law on High Technologies dated November 13, 2008;

Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to Decree No. 28/2023/ND-CP dated June 02, 2023 of the Government of Vietnam on functions, tasks, powers and organizational structure of the Ministry of Science and Technology of Vietnam;

Pursuant to Decree No. 08/2014/ND-CP dated January 27, 2014 of the Government of Vietnam providing detailed regulations and implementation guidance of certain Articles of the Law on Science and Technology;

Pursuant to Decision No. 55/2010/QD-TTg  dated September 10, 2010 of the Prime Minister providing guidance on authority, procedures for certifying organizations and individuals of high-tech application or high-tech research and development and recognizing high-tech enterprises;

At the request of the Director of the Department of Legislation and Director of the Registration Office of Science and Technology Activities;

Article 1. Amendments to certain Articles and replacement of certain Forms of Circular No. 32/2011/TT-BKHCN dated November 15, 2011 of the Minister of Science and Technology providing criteria for determining hi-tech application projects and hi-tech product manufacture investment projects, and evaluation of applications for certificates for hi-tech application, new enterprises established under hi-tech product manufacture investment projects and hi-tech enterprises, which was amended by Circular No. 04/2020/TT-BKHCN

1. Amendments to Clause 2 of Article 7:

“2. Expenditure items shall comply with regulations in Circular No. 03/2023/TT-BTC dated January 10, 2023 of the Minister of Finance of Vietnam on cost estimation, management and settlement of funding from state budget for performance of scientific tasks and relative documents.”.

2. Addition of Clause 4 of Article 9:

“4. Individuals who are Vietnamese citizens may use level-2 eID accounts to replace duplicates of ID cards and passports when they apply for certificates of high-tech application.".

3. Replacement of Form No. B1-CNHDUD, Form No. B1-DNTLM, Form No. B1-DNCNC, Form No. B2-TMDNTLM, Form No. B4-HDUD, Form No. B4-DNTLM, Form No. B4-DNCNC by Form No. B1-CNHDUD, Form No. B1-DNTLM, Form No. B1-DNCNC, Form No. B2-TMDNTLM, Form No. B4-HDUD, Form No. B4-DNTLM, Form No. B4-DNCNC  of Annex I enclosed herewith.

Article 2. Amendments to certain Articles and replacement of certain Forms of Circular No. 03/2014/TT-BKHCN dated March 31, 2014 of the Minister of Science and Technology providing guidance on requirements for establishment and registration of operations of scientific and technological organizations and their representative offices and branches

1. Amendments to Point c Clause 4 Article 6:

“c) For non-public and foreign-invested scientific and technological organizations, in addition to the list of human resources regulated at Form 8 stated in the Annex herewith, the following documents are required:

+ Application form for regular employment using Form 9 stated in the Annex herewith;

+ Certified true copies of degrees.

Authorities issuing certificates may request the applicants to present the originals of their applications for comparison in case of need.

- Members holding multiple positions:

+ Application form for permission to hold multiple positions using Form 10 stated in the Annex herewith;

+ Certified true copies of degrees.

Authorities issuing certificates may request the applicants to present the originals of documents in the application for comparison where necessary.”.

2. Replacement of Form 1, Form 2, Form 3, Form 4, Form 5, Form 6, Form 9, Form 10, Form 11, Form 14, Form 15, Form 21, Form 22 stated in the Annex by Form 1, Form 2, Form 3, Form 4, Form 5, Form 6, Form 9, Form 10, Form 11, Form 14, Form 15, Form 21, Form 22 specified in the Annex II enclosed herewith.

2. Any difficulty arise during implementation should be reported in writing to the Ministry of Science and Technology for consideration and settlement./.
