DECISION
GIVING APPROVAL FOR ADDITTION OF TRI VIET 1 SOLAR POWER PLANT PROJECT (CAPACITY OF 30 MWP) INTO THE POWER DEVELOPMENT PLAN OF TAY NINH PROVINCE FOR 2011 – 2015 PERIOD WITH A VISION BY 2020

Pursuant to the Law on electricity dated December 03, 2004; the Law dated November 20, 2012 on amendments to the Law on electricity;
Pursuant to the Government’s Decree No. 137/2013/ND-CP dated October 21, 2013 detailing the implementation of a number of articles of the Law on electricity and the Law on amendments to the Law on electricity;
Pursuant to the Government’s Decree No. 98/2017/ND-CP dated August 18, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;
Pursuant to the Circular No. 43/2013/TT-BCT dated December 31, 2013 by the Ministry of Industry and Trade providing for establishment, approval and adjustment of the power development plan;
Pursuant to the Circular No. 16/2017/TT-BCT dated September 12, 2017 by the Ministry of Industry and Trade providing for development of solar power projects and standard power purchase agreement applied to solar power projects;
In consideration of the request of the People’s Committee of Tay Ninh Province at the Official Dispatch No. 1966/UBND-KTTC dated July 27, 2017 of the People’s Committee of Tay Ninh Province requesting for addition of the following solar power plant projects, Bach Khoa A Chau 1 (with capacity of 30 MWp), Bach Khoa A Chau 2 (with capacity of 30 MWp), Minh Viet 1 (with capacity of 30 MWp), Minh Viet 2 (with capacity of 30 MWp), Tri Viet 1 (with capacity of 30 MWp) and Tri Viet 2 (with capacity of 30 MWp), into the power development plan of Tay Ninh Province for the 2011 - 2015 period with a vision by 2020; the Official Dispatch No. 2956/UBND-KTTC dated November 02, 2017 of the People’s Committee of Tay Ninh Province providing response to the Official Dispatch No. 239/DL-KH&QH on documents concerning the addition of Bach Khoa A Chau 1, Minh Viet 1, and Tri Viet 1 solar power plant projects into the power development plan of Tay Ninh Province; the Official Dispatch No. I/TV/H/069/PHM/17 dated November 15, 2017 by Tri Viet Power Company Limited on supplementing documents concerning the power development plan of Tay Ninh Province - Tri Viet 1 solar power plant project, which is jointly established and adjusted by the Power Engineering Consulting Joint Stock Company 1 (PECC1) and Vinteg Joint Stock Company (Vinteg) in November, 2017;
At the request of the Director of Electricity and Renewable Energy Authority;
HEREBY DECIDES:
Article 1. Amendments and supplements to the power development plan of Tay Ninh Province for the 2011 – 2015 period with a vision by 2020 are approved herein. To be specific:
1. Tri Viet 1 Solar Power Plant Project is added into the power development plan of Tay Ninh Province with particulars as follows:
- Capacity: 30 MWp, operating in 2019;
- Location: Suoi Day Town, Tan Chau District, Tay Ninh Province;
- Land area: about 60 ha, in which the land area for long-term use is 36 ha, and the land area for temporary use is 24 ha (which shall be exactly determined when preparing the Project's feasibility study report in accordance with the Circular No. 16/2017/TT-BCT dated September 12, 2017 by the Ministry of Industry and Trade providing for development of solar power projects and model power purchase agreement applied to solar power projects).
2. Connection plan:
- Build a new 22/110 kV step-up substation (Tri Viet 1 solar power) with a capacity of 40 MVA, operating in 2019 in harmony with the progress of Tri Viet 1 solar power plant.
- Build a new 110 kV Recloser (Tay Ninh 1 solar power) on the 110 kV power line from Bourbon to Tay Ninh 220 kV substation, operating in 2019 in harmony with the progress of Tri Viet 1 solar power plant (which is used for connection with Bach Khoa A Chau 1 solar power plant project).
- Build a new 110 kV power line using ACSR120 conducting-wire, with the length of 6 km from the 22/110 kV step-up substation (Tri Viet 1 solar power) to the 110 kV Recloser (Tay Ninh 1 solar power) (suspended by the same powers used for the 110 kV power line of Bach Khoa A Chau 1 solar power plant project).
3. The list of other power structures is stipulated in the Decision No. 5905/QD-BCT dated November 11, 2011 by the Minister of Industry and Trade giving approval for the power development plan of Tay Ninh Province for the 2011 – 2015 period with a vision by 2020 and relevant decisions on amendments and supplements to this power development plan of Tay Ninh Province.
Article 2. Implementation organization
1. The People’s Committee of Tay Ninh Province shall carry out procedures for changes in land-use purposes in accordance with applicable law regulations; allocate land area for executing solar power projects and building substations and power lines synchronously in conformity with the provincial land-use plan for the 2016 – 2020 period.
2. Investors of solar power plant projects shall cooperate with the People’s Committee of Tay Ninh Province, the Vietnam Electricity, and the Southern Power Corporation in mobilizing funding and making investments in work items supplemented to the solar power development plan in accordance with applicable regulations so as to ensure the plan's progress and power supply safety.
3. The investor shall assume responsibility for the investment efficiency of the in-charge project and strictly comply with the Prime Minister’s mechanism for electricity price in terms of solar power.
4. Department of Industry and Trade of Tay Ninh Province shall monitor, inspect and submit reports on the execution of power work items approved.
Article 3. Entry into force and implementation
1. This decision comes into force from the date on which it is signed.
2. Head of the Ministry’s Office, Director of Electricity and Renewable Energy Authority, Chairperson of the People’s Committee of Tay Ninh Province, Director of Department of Industry and Trade of Tay Ninh Province, General Director of Vietnam Electricity, General Director of Southern Power Corporation, and relevant agencies/ units shall implement this Decision.
