ON ONLINE REPORTING PROCEDURES AND MANAGEMENT OF INFORMATION SYSTEMS ON SUPERVISION AND EVALUATION OF INVESTMENT IN STATE-FUNDED PROGRAMS AND PROJECTS

Pursuant to Law on Public Investment dated June 18, 2014;

Pursuant to Law on Construction dated June 18, 2014;

Pursuant to Law on Bidding dated November 26, 2013;

Pursuant to Decree No. 116/2008/ND-CP dated November 14, 2008 on functions, tasks, powers and organizational structure of Ministry of Planning and Investment;

Pursuant to Decree No. 84/2015/ND-CP dated September 30, 2015 on supervision and evaluation of investment;

Article 1. Scope and regulated entities

1. Scope: This Circular provides for reporting procedures on supervision and evaluation of investment and overall investment on professional information system at https://dautucong.mpi.gov.vn in order to supervise and evaluate state-funded programs or projects and management of information systems on supervision and evaluation of investment in state-funded programs or projects.

2. Regulated entities: individuals/organizations relating to making report on supervision and evaluation of investment and overall investment.

Article 2. Definitions

1. "Information system on supervision and evaluation of investment in state-budget programs and projects" (hereinafter referred to as system) means a system for updating, storing information, supervising, evaluating, analyzing and publishing information in accordance with regulations on state-funded investment programs and projects nationwide. System shall include:

s) National information portal on investment supervision and evaluation at http://giamsatdautuquocgia.mpi.gov.vn means a website on investment supervision and evaluation in order to publicize state-funded investment information and follow Article 14 of Law on Public Investment;

b) Professional information system at https://dautucong.mpi.gov.vn means a system in which individuals/organizations relating to state-funded investments shall use their accounts granted by Ministry of Planning and Investment to perform tasks in accordance with regulations:

c) Technical infrastructure system shall include network system, server, security, system software, application software.

2. Specialized digital signature in professional information system means a digital signature signed by a digital certificate granted by an authority providing specialized digital signature certification services to the Party, State and political - social organizations.

Article 3. Regulations on information update, reports of investors and owners

1. When a program or a project is approved for investment: update information about the program and project in accordance with Decision on investment policy and Decision on investment in professional information system within 07 working days from the date of approval.

2. During the implementation:

a) The following information shall need to be updated at least 7 working days after any amendment:

- Approving project amendment;

- Approving and amending technical designs or shop drawing designs and cost estimate;

- Approving and amending contractor selection plan and result;

- Contract, amendments to contract;

- Appropriated capital plan;

- Information about evaluation and inspection.

b) Information shall be updated monthly (as the case may be):

- Implemented tasks on location;

- Images or videos about work execution on location for projects including construction.

3. When a program or a project is ended: update information about the program and project in accordance with the approval decision of final account within 07 working days from the date of approval.

4. Documents shall be enclosed with scanned copy or electronic documents with specialized digital signature on professional information system, including:

a) Decision on investment policy;

b) Decision on investment, Decision on regulated investment (as the case may be);

c) Decision on approval for technical designs or shop drawing designs, cost estimate; Decision on regulating technical designs or shop drawing designs, cost estimate (if any);

dd) Report on evaluation result;

e) Report on inspection result;

g) Report on supervision and evaluation in accordance with Clause 5 of this Article;

h) Decision on approval for final account.

Except for information and reports updated by investors and subproject owners according to the above-mentioned regulations, investors and subproject owners shall update all documents sorted by functions on professional information system.

5. Information shall be aggregated quarterly and updated on the professional information system from contracts of the project within the scope of management to make report on supervision and evaluation of investment implementation of investors and program owners in accordance with Appendices 07 and 03 of Circular No. 22/2015/TT-BKHDT, which is enclosed with the report bearing seal or specialized digital signature on the professional information system.

Time limit for reporting shall be specified in point d Clause 1 Article 69 of Decree No. 84/2015/ND-CP dated September 30, 2015 on investment supervision and evaluation (abbreviated to Decree No. 84/2015/ND-CP).

6. Data on supervision and evaluation of overall investment shall be updated every 6 months or every year on professional information system following the procedures as below:

a) Aggregating information from programs and projects within the scope of management updated on professional information system;

c) Submit the report.

Time limit for reporting shall be specified in Points dd and e Clause 1 Article 69 of Decree No. 84/2015/ND-CP.

7. Information update and report submission on professional information system specified in Clauses 1, 2, 3, 4, 5, 6 of this Article instead of periodical written report of investors shall be specified in Decree No. 84/2015/ND-CP and Circular No. 22/2015/TT-BKHDT.

8. Investors and subproject owners failing to follow the full reporting procedures specified in Article 3 of this Circular shall be sanctioned in accordance with Article 71 of Decree No. 84/2015/ND-CP.

Article 4. Regulations on reports of ministries and branches, local authorities, State Economic Group and State Capital Investment Corporation (SCIC)

Data on supervision and evaluation of overall investment shall be updated every 6 months or every year on professional information system, including:

1. Data on supervision and evaluation of overall investment;

a) Aggregating information from data on supervision and evaluation of overall investment on professional information system of investors within the scope of management or from subordinate authorities;

b) Reviewing and adding information of the report;

2. Contents of program and project evaluation shall be based on Form 01 of Circular 22/2015/TT-BKHDT (except for annexes 01, 02, 03, 04, 05, 06 which have been updated on professional information system) and attach this report to professional information system. When the attached file bearing specialized digital signature, written report shall not need to be sent to the competent authority specified in Decree No. 84/2015/ND-CP and Circular No. 22/2015/TT-BKHDT.

3. Time limit for reporting specified in Clause 4 Article 69 of Decree No. 84/2015/ND-CP.

Article 5. Management of accounts

1. Account registration

a) If the specialized digital certificate is granted:

Registering at https://taikhoan.mpi.gov.vn

b) If the specialized digital certificate is not granted:

Access the website https://taikhoan.mpi.gov.vn and provide relevant information of program/project owners, one of two options shall be followed:

Option 1: Contact with agency in charge and this agency shall certify the registration by using its granted account.

2. Grant accounts

a) For accounts registered under point a Clause 1 of this Article: Ministry of Planning and Investment shall grant accounts within 01 working day from completion of registration.

b) For accounts registered under option 1 point b Clause 1 of this Article: Ministry of Planning and Investment shall grant accounts within 01 working day from managing unit’s confirmation of registration.

c) For accounts registered under option 2 point b Clause 1 of this Article: Ministry of Planning and Investment shall grant accounts within 01 working day from receipt of registration.

d) Newly granted accounts shall be sent via email or declared phone number.

dd) Ministry of Planning and Investment shall re-grant passwords at the request of users based on their declared information.

3. Revoke or block accounts

a) An account shall be revoked on written request or email with digital signature or electronic documents with digital signature of the managing unit.

b) An account shall be blocked right after being detected to use for the purpose of destroying data or attack the System.

a) Users shall change their passwords within 01 working day from receipt of accounts.

b) Passwords shall not be disclosed to another person who is not responsible for updating information on professional information system.  In case of changing to another user, the new user shall change password and other information of the previous user on professional information system.

Article 6. Responsibilities of investors and subproject owners

1. Update information and reports accurately in accordance with Article 3 of this Circular.

2. Send reports to confirm that information has been updated on professional information system before 10^th of the first month of the succeeding quarter (before February 10 next year for the 4^th quarter).

3. Ensure accuracy of the information updated on professional information system and be legally responsible for inaccurate reports of investment within scope of management.

4. Appoint an official to manage account users. Supervise users' conformity with regulations on account security specified in Clause 4 Article 5 of this Circular.

Article 7. Responsibilities of ministries and branches, local authorities, State Economic Group, SCIC

1. Confirmation of account registration information of subordinate authorities or investors within the scope of management specified in point b Clause 1 Article 5 of this Circular.

3. Send reports to confirm that information of programs and projects updated by investors and subproject owners within the scope of management has been updated on professional information system before 15^th of the first month of the succeeding quarter (before February 15 next year for the 4^th quarter).

4. Supervise users’ conformity with regulations on updating information and reports on professional information system of subordinate authorities or investors within the scope of management.

5. Appoint an official to manage account users. Supervise users’ conformity with regulations on account security specified in Clause 4 Article 5.

6. Depend on application capacity, demand for use, available functions on professional information system and within the scope of management, they shall:

a) Provide for more specific update on information and reports on use of professional information system.

b) Provide for specific responsibilities of authorities and entities in use of professional information system.

Article 8. Responsibilities of Ministry of Planning and Investment

1. Agency in charge of information technology of Ministry shall

a) Build, develop, manage and operate the System.

c) Supervise and inspect information and report update on professional information system.

d) Publish the real time of using professional information system; Publish report update on professional information system of authorities and other information in accordance with regulations.

dd) Train and provide guidance on use of the System nationwide.

2. Department of Investment Supervision and Appraisal

a) Reports on supervision and evaluation of overall investment shall be updated every 6 months or every year on professional information system, including:

- Aggregating information from data on supervision and evaluation of overall investment on professional information system of ministries and branches, local authorities, State Economic Group, SCIC.

- Contents of program and project evaluation: the report shall be attached and updated on professional information system.

Article 9. Organization and implementation

1. This Circular comes into force from November 20, 2016.
