CIRCULAR
PROMULGATING “NATIONAL TECHNICAL REGULATION ON GASOLINES, DIESEL FUEL OILS AND BIOFUELS”
Pursuant to the Law on Technical Regulations and Standards dated June 29, 2006;
Pursuant to the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating a number of Articles of the Law on Technical Regulations and Standards and Government’s Decree No. 78/2018/ND-CP dated May 16, 2018 on amendments to some Articles of the Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating a number of Articles of the Law on Technical Regulations and Standards;
Pursuant to the Government’s Decree No. 95/2017/ND-CP dated August 16, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;
At the request of Director General of Directorate for Standards, Metrology and Quality and Director General of Department of Legislation;
The Minister of Science and Technology hereby promulgates a Circular on promulgation of the “National technical regulation on gasolines, diesel fuel oils and biofuels”.
Article 1. Promulgated together with this Circular is the National technical regulation on gasolines, diesel fuel oils and biofuels (QCVN 01:2022/BKHCN).

1. This Circular comes into force from February 01, 2023.
2. The following legislative documents shall cease to have effect in accordance with regulations on roadmap for application specified in Article 3 and transitional clauses specified in Article 4 of this Circular.
a) The Circular No. 22/2015/TT-BKHCN dated November 11, 2015 of the Minister of Science and Technology on promulgation and implementation of QCVN 1:2015/BKHCN National technical regulation on gasolines, diesel fuel oils and biofuels;
b) The Circular No. 04/2017/TT-BKHCN dated May 22, 2017 of the Minister of Science and Technology on promulgation of Amendment 1:2017 QCVN 1:2015/BKHCN National technical regulation on gasolines, diesel fuel oils and biofuels.
Article 3. Roadmap for application
1. As of June 15, 2023, gasolines, diesel fuel oils and biofuels produced, prepared, imported and distributed shall satisfy the regulations enshrined in QCVN 01:2022/BKHCN prior to their circulation on the market.
2. Enterprises, organizations and individuals producing, preparing, importing and distributing gasolines, diesel fuel oils and biofuels are encouraged to apply the regulations enshrined in QCVN 01:2022/BKHCN from the effective date of this Circular.
Article 4. Transitional clauses
1. Enterprises, organizations and individuals are entitled to apply Amendment 1:2017 QCVN 1:2015/BKHCN and QCVN 1:2015/BKHCN or QCVN 01:2022/BKHCN with respect to level 2, level 3 and level 4 gasolines, diesel fuel oils and biofuels produced, prepared, imported and distributed from February 01, 2023 to June 15, 2023 inclusive.

Article 5. Implementation
1. Director General of Directorate for Standards, Metrology and Quality shall provide guidelines on, disseminate, communicate and organize the implementation of this Circular.
2. The Ministry, heads of ministerial agencies, heads of Governmental agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, organizations and individuals concerned are responsible for the implementation of this Circular.
3. Difficulties that arise during the implementation of this Circular should be promptly reported in writing to the Ministry of Science and Technology for instructions or appropriate amendments./.

Biofuels: Undenatured fuel ethanol, denatured fuel ethanol and B-100 biodiesel fuel blend stock.
The fuels specified under this Technical regulation are assigned HS codes specified in the Vietnam’s Nomenclature of exports and imports promulgated together with the Circular No. 31/2022/TT-BTC dated June 08, 2022 (see Appendix A).
1.1.2. This Technical regulations does not apply to fuels used for aviation and defense purposes.
1.2. Regulated entities
This Technical regulation applies to agencies, organizations and individuals related to import, production, preparation, distribution and retail of gasolines, diesel fuel oils and biofuels in Vietnam.
1.3. Definitions
For the purposes of this document, the terms below shall be construed as follows:
1.3.1. unleaded gasoline

A mixture of unleaded gasolines and fuel ethanol with ethanol content of from 4% to 5% by volume, designated E5.
1.3.3. E10 gasoline
A mixture of unleaded gasolines and fuel ethanol with an ethanol content of from 9% to 10% by volume, designated E10.
1.3.4. Diesel oil (DO)
A volatile mixture of petroleum-based liquid hydrocarbons having boiling points in the range suitable for use as internal combustion engine fuel.
1.3.5. B5 diesel fuel oil
A mixture of diesel oils and biodiesel fuel blend stock with a fatty acid methyl ester (FAME) content of from 4% to 5% by volume, designated B5.

1.3.6.2. Denatured fuel ethanol
Ethanol denatured with gasolines or naphtha with the volume ranging from 1.96 % to 5.0 %.
1.3.6.3. Biodiesel fuel blend stock
A fuel comprised of methyl esters of long chain fatty acids derived from vegetable oils or animal fats, not blended with other fuels, uses as diesel engine fuel and designated B100.

2.4. Additives
2.4.1. Additives intended for blending with unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuels oils shall comply with regulations on safety, health and environment, and not cause any damage to the engine and fuel storage, transport and distribution system.
2.4.2. Uncommon additives used to produce and prepare unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils shall be registered and approved as prescribed in the Circular No. 15/2009/TT-BKHCN dated June 02, 2009 of the Minister of Science and Technology.

2.5. Apart from the requirements specified under clauses 2.1 through 2.4, gasolines, diesel fuel oils and biofuels must meet specifications and their characteristics pose no threats to persons, animals, plants, environment and property according to provisions of law.
3. TEST METHODS
3.1. Sampling
Fuel samples used to determine the specifications provided in this Technical regulation shall be taken using TCVN 6777:2007 (ASTM D 4057-06) Petroleum and petroleum products - Method for manual sampling or TCVN 6022:2008 (ISO 3171:1988) Petroleum liquids - Automatic pipeline sampling and Guidelines on petroleum product sampling methods issued by the Directorate for Standards, Metrology and Quality.
3.2. Test methods

3.3. Test data on gasolines, diesel fuel oils and biofuels shall be utilized according to TCVN 6702:2013 (ASTM D 3244-07a) Standard Practice for Utilization of Test Data to Determine Conformance with Specifications.
4.1. Imported or domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall have their conformity with related regulations set out in clauses 2.1, 2.2 and 2.3 Section 2 of this Technical regulation prior to their circulation on the market.
The conformity of imported or domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock with technical regulations set out in Section 2 of this Technical regulation shall be declared as prescribed in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology on declaration of standard conformity and technical-regulation conformity and methods for assessment of conformity with standards and technical regulations (hereinafter referred to as “the Circular No. 28/2012/TT-BKHCN”), Circular No. 02/2017/TT- BKHCN dated March 31, 2017 of the Minister of Science and Technology on amendments to some Articles of the Circular No. 28/2012/TT-BKHCN (hereinafter referred to as “the Circular No. 02/2017/TT-BKHCN”) and Circular No. 06/2020/TT-BKHCN dated December 10, 2020 of the Minister of Science and Technology elaborating to Decree No. 132/2008/ND-CP dated December 31, 2008, Decree No. 74/2018/ND-CP dated May 15, 2018, Decree No. 154/2018/ND-CP dated November 9, 2018 and Decree No. 119/2017/ND-CP dated November 1, 2017 of the Government (hereinafter referred to as “the Circular No. 06/2020/TT-BKHCN”).
Basis for conformity declaration is the certification result given by a certification body designated in an appropriate operating field as prescribed in the Government’s Decree No. 74/2018/ND-CP dated May 15, 2018 on amendments to some Articles of the Government's Decree No. 132/2008/ND-CP dated December 31, 2008 elaborating some Articles of the Law on Quality of Products and Goods (hereinafter referred to as “the Decree No. 74/2018/ND-CP”), Government’s Decree No. 154/2018/ND-CP dated November 09, 2018 amending, supplementing and repealing certain regulations on investment and business conditions in sectors under the management of the Ministry of Science and Technology and certain regulations on specialized inspections (hereinafter referred to as “the Decree No. 154/2018/ND-CP”.
4.2. Imported unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall undergo state inspection of their quality in accordance with Section 2 of this Technical regulation prior to their circulation on the market.
The state inspection of quality of imports shall comply with the regulations set forth in the Decree No. 74/2018/ND-CP, Decree No. 154/2018/ND-CP and Circular No. 06/2020/TT-BKHCN.
Basis for state inspection of quality of imports is the certification result given by a certification body designated in an appropriate operating field as prescribed in the Decree No. 74/2018/ND-CP and Decree No. 154/2018/ND-CP or recognized as prescribed in the Circular No. 27/2007/TT-BKHCN dated October 31, 2007 of the Ministry of Science and Technology on guidelines for signature and implementation of agreements for the mutual recognition of conformity assessment results.
4.3. The testing in support of conformity certification, audit and inspection of quality of unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock in accordance with this Technical regulation shall be carried out by a testing body designated as prescribed in the Decree No. 74/2018/ND-CP and Decree No. 154/2018/ND-CP.

Conformity assessment methods serving as bases for declaration of conformity and state inspection of quality of unleaded gasolines, E10 gasolines, B5 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock are specified in Article 5 and Appendix II of the Regulations on declaration of standard conformity and technical-regulation conformity and methods for assessment of conformity with standards and technical regulations promulgated together with the Circular No. 28/2012/TT-BKHCN.
4.4.1. Regarding imported or domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock:
- Adopt Method 5 (Testing representative sample and assessing the manufacturing process; carrying out supervision by testing the sample collected from the manufacturing location or on the market in association with assessment of the manufacturing process) in case the manufacturing process of the production, processing and preparation establishment remains stable;
Or
- Adopt Method 7 (Testing representative samples and assessing conformity of a batch/lot) in case the manufacturing process of the production, processing and preparation establishment is intermittent or the production and the control of the manufacturing process are carried out separately for each batch/lot or in case the production is in progress and is not completely stable in the initial stage of production.
4.4.2. Regarding imported unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock:
- Adopt Method 7 (Testing representative samples and assessing conformity of a batch/lot) for each imports shipment in case the imports shipment has yet to have its conformity with this Technical regulation assessed;
Or
- Adopt Method 5 (Testing representative sample and assessing the manufacturing process; carrying out supervision by testing the sample collected from the manufacturing location or on the market in association with assessment of the manufacturing process) in case the conformity certification is carried out at a foreign production establishment upon receiving a certification request from the importer.

4.5.1. The certification body may consider using the testing result given by a testing body in the exporting country to serve the certification if such testing body is sufficiently competent and satisfies the regulations set forth under TCVN ISO/IEC 17025:2017 General requirements for the competence of testing and calibration laboratories or ISO/IEC 17025:2017 General requirements for the competence of testing and calibration laboratories.
4.5.2. Before using the testing result given by a testing body in the exporting country, each certification body shall report to the Directorate for Standards, Metrology and Quality for supervision and management purposes. Where necessary, the Directorate for Standards, Metrology and Quality will inspect the use of testing results by certification bodies.
4.5.3. When using the testing result given by a testing body in the exporting country, the certification body shall take responsibility for its certification result.
5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
5.1. Organizations and individuals that produce, prepare and import unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall declare applied standards in accordance with this Technical regulation and ensure the quality in conformity with regulations specified in this Technical regulation and applied standards.
5.2. Organizations and individuals that produce and prepare unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall certify and declare conformity in accordance with this Technical regulation.
Organizations and individuals that import unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall certify conformity with this Technical regulation and apply for state inspection of imports as prescribed in this Technical regulation.
5.3. Organizations and individuals that distribute and retail unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, undenatured fuel ethanol, denatured fuel ethanol and biodiesel fuel blend stock shall ensure the quality in accordance with this Technical regulation.
5.4. Designated certification bodies and testing bodies shall fulfill their responsibility specified in Article 18 of the Decree No. 132/2008/ND-CP amended by clause 8 Article 1 of the Government's Decree No. 74/2018/ND-CP dated May 15, 2018.

- 05 years, for documents on testing of gasolines, diesel fuel oils and biofuels;
- 10 years, for documents on certification of gasolines, diesel fuel oils and biofuels.
5.5. Fuel trading stations or other distributors and retailers shall provide information about type of gasolines and/or diesel fuel oils. To be specific:
- Regarding unleaded gasolines: octane number and emission standards;
- Regarding biogasolines: research octane number, blending ratio of fuel ethanol, and emission standards;
- Regarding diesel fuel oils: sulfur content;
- Regarding B5 diesel fuel oils: ratio of biodiesel fuel blend stock and sulfur content.
6.1. The Directorate for Standards, Metrology and Quality shall provide guidelines on, inspect and cooperate with relevant authorities in organizing the implementation of this Technical regulation.

6.2. In the cases where any of the legislative documents specified in this Technical regulation is amended or replaced, the newest one shall apply.
In the cases where any of the legislative documents referred to or guidelines specified in this Technical regulation is amended or replaced, the guidelines provided by the Directorate for Standards, Metrology and Quality shall apply.
