Resolution 02/2019/NQ-HDND stipulating mechanisms and policies to support the development of Science and Technology activities in Quang Nam province in the period of 2019-2025

RESOLUTION

ON SOME ASSISTANCE POLICIES AND MECHANISMS FOR SCIENTIFIC AND TECHNOLOGICAL DEVELOPMENT IN QUANG NAM PROVINCE FOR 2019-2025

10th SESSION OF 9TH PEOPLE’S COUNCIL OF QUANG NAM PROVINCE

Pursuant to the Law on Local Government Organization dated June 19, 2015;

Pursuant to the Law on Science and Technology dated June 18, 2013,

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Law on State Budget dated June 25, 2015;

Considering Proposal No. 2956/TTr-UBND dated May 28, 2019 by the People's Committee of Quang Nam province on some assistance policies and mechanisms for scientific and technological development in Quang Nam province for 2019-2025; Inspection Report No. 32/BC-HDND dated June 14, 2019 by the economic affairs - budget board of the People’s Council of Quang Nam province; and opinions from delegates in the session.

HEREBY RESOLVES:

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Resolution provides for some assistance policies and mechanisms for scientific and technological development of organizations and individuals in Quang Nam province, including transfer and application of scientific and technological advances; development of industrial property rights and standards, measurement and quality of products and services; technology transfer, technology renovation and research result application and commercialization for new product development; and development of domestic and international science and technology markets for 2019-2025.

Article 2. Regulated entities

1. Regulatory bodies, organizations and individuals (hereinafter collectively referred to as “facilities”) involved in the activities mentioned in Article 1 herein and management thereof.

2. This Resolution is not applicable to foreign-invested enterprises.

Chapter II

ASSISTANCE POLICIES AND MECHANISMS

Article 3. Assistance for transfer and application of scientific and technological advances for promotion of rural and mountainous socio - economic development and new rural development

1. Assistance recipients: organizations in charge of projects on transfer and application of scientific and technological advances for promotion of rural and mountainous socio - economic development and new rural development, which are established and operate under the law and selected to receive the assistance by district-level People’s Committees in writing, including:

a) Specialized bodies affiliated to district-level People’s Committees;

b) Service providers affiliated to district-level People’s Committees;

c) Enterprises and cooperatives which operate under the Enterprise Law and Cooperative Law and the head offices of which are located in the districts where the projects are taking place. Units and facilities sufficiently fulfilling their obligations according to existing regulations of the State (and their commitments), having not committed any violation against application law and engaging in registered business lines.

2. Conditions for assistance for projects on transfer and application of scientific and technological advances for promotion of rural and mountainous socio - economic development and new rural development:

a) The projects take place as provincial-level scientific and technological tasks with simplified administrative procedures and relevant regulations; are placed as an order by district-level People’s Committees in writing and are approved by the provincial science and technology council;

b) Organizations in charge of the projects possess the technical facilities necessary for their projects; and are capable of mobilizing non-budget funding and other resources for their projects as well as connecting production according to value chains or organizing goods production to create livelihoods for local people. These organizations directly carry out their projects and receive and benefit from their projects’ results;

c) Local people participate in model adoption and production connection for product development;

d) Requirements for technologies selected for transfer and application:

These technologies aim to resolve issues arising from socio - economic development in the districts where the projects take place, meet environmental protection requirements and are suitable for actual situation and development demand of these districts;

These technologies are novel and more effective and advanced than the technologies currently applied in the districts where the projects take place or are produced from results of provincial-level scientific and technological tasks of Quang Nam province but yet applied or transferred for wide-scale application;

These technologies have proper technical procedures that can be adopted by organizations and individuals in the districts where the projects take place;

These technologies are recognized as novel technical and technological advances according to regulations of the Ministry of Agriculture and Rural Development or created from results of scientific and technological tasks at grassroots level or higher; or permitted to be applied and transferred by the Chairperson of the People’s Committee of Quang Nam province.

3. Conditions for assistance for development of models based on results of constituent projects of the assistance program for transfer and application of scientific and technological advances for promotion of rural and mountainous socio - economic development for 2016-2025 according to the Prime Minister’s Decision No. 1747/QD-TTg dated 13/10/2015; and program for science and technology for new rural development for 2016-2020 according to the Prime Minister’s Decision No. 45/QD-TTg dated 12/01/2017 (hereinafter referred to as “central rural, mountainous and new rural development program”) shall satisfy the following requirements:

a) The technical procedures applicable to development of the models shall come from the results of constituent projects of the central rural, mountainous and new rural development program; be appropriate to actual situation and development demand and aim to resolve issues arising from local production;

b) The models shall concern application of technical advances and be subject to appraisal by the Department of Science and Technology.

4. Assistance content and rates

a) Projects on transfer and application of scientific and technological advances for promotion of rural and mountainous socio - economic development and new rural development comprises development of transfer and application models suitable for actual situation and development level of each locality in Quang Nam province; and development of models of synchronized transfer and application and market management and development according to value chains with the participation of scientists, enterprises and the people, in which, enterprises are the core. Assistance for performance of projects in districts is as follows:

Projects taking place in districts with exceptional socio - economic difficulties shall be provided with an amount equal to 90% of the total funding at the maximum and each project shall receive no more than VND 1,5 billion;

Projects taking place in districts unable to balance budget independently (excluding the districts mentioned in Point a.1, Clause 4 herein) shall be provided with an amount equal to 70% of the total funding at the maximum and each project shall receive no more than VND 1,2 billion;

Projects taking place in districts able to balance budget independently shall be provided with an amount equal to 50% of the total funding at the maximum and each project shall receive no more than VND 1 billion.

b) Assistance for development of models based on results of constituent projects of the central rural, mountainous and new rural development program (maximum 2 models for 1 procedure):

Model development in districts with exceptional socio - economic difficulties shall be provided with an amount equal to 90% of the total funding at the maximum and each model shall receive no more than VND 180 million;

Model development in districts unable to balance budget independently (excluding the districts mentioned in Point b.1, Clause 4 herein) shall be provided with an amount equal to 70% of the total funding at the maximum and each model shall receive no more than VND 140 million;

Model development in districts able to balance budget independently shall be provided with an amount equal to 50% of the total funding at the maximum and each model shall receive no more than VND 100 million.

5. Assistance scale

a) Assistance shall be provided for a maximum of 35 projects meeting the conditions in Clause 2 Article 3 herein;

b) Assistance shall be provided for a maximum of 70 models meeting the conditions in Clause 2 Article 3 herein;

c) Training and refresher courses in project management and performance and technology application and transfer shall be provided for 200 grassroots-level managers and technicians. Technology transfer training and instructions shall be provided for approximately 5.000 farmers.

Article 4. Assistance for establishment and development of industrial property rights over products and services in Quang Nam province

1. Assistance recipients: the entities mentioned in Clause 1 Article 2 herein.

2. Conditions for assistance:

a) For trademarks, collective trademarks, certification trademarks, inventions, industrial designs and useful solutions: the facility has formulated an application for registration and been granted a document on intellectual property rights protection by the competent authority;

b) For development of management models for intellectual assets of enterprises: the facility has developed and adopted an intellectual asset management model effectively, which has been appraised and commissioned by the Department of Science and Technology;

c) For development of control and tracing models for origin and quality of products bearing geographical indications and certification trademarks: the facility has developed and adopted a model and affixed origin-tracing stamps to products to ensure authentication, which has been appraised and commissioned by the Department of Science and Technology.

3. Assistance content and rates

a) Trademark registration: a maximum of VND 5 million for each trademark and no more than 5 trademarks for each facility;

b) Collective trademark registration: a maximum of VND 10 million for each trademark;

c) Certification trademark registration: a maximum of VND 20 million for each trademark;

d) Invention registration: a maximum of VND 20 million for each invention;

e) Industrial design registration: a maximum of VND 10 million for each design and no more than 5 designs for each facility in a year;

f) Useful solution registration: a maximum of VND 15 million for each solution;

g) Development of management models for intellectual assets of enterprises: a maximum of VND 30 million for each model;

h) Development of control and tracing models for origin and quality of products bearing geographical indications and certification trademarks: a maximum of 30 million for each model.

4. Assistance scale

Assistance shall be provided for a maximum of 200 trademarks, collective trademarks and certification trademarks; 50 industrial designs, useful solutions and inventions having registered for industrial property rights protection; and 50 management models for intellectual assets of enterprises and control and tracing models for origin and quality of products bearing geographical indications and certification trademarks.

Article 5. Assistance for standards, measurement and quality of products and services in Quang Nam province

1. Assistance recipients: the entities mentioned in Clause 1 Article 2 herein.

2. Conditions for assistance:

a) For development and application of advanced quality control systems: the facility has developed and applied a system and been granted the certificate of compliance of the system with the corresponding standard;

b) For assessment of standard/regulation conformity: the facility has been a certificate of conformity;

c) For internal standard formulation: the internal standard directly declared by the organization or individual is compliant with existing regulations of law (for products and services without corresponding technical regulations);

d) For employment of productivity and quality enhancement tools: the facility has employed a tool and been granted a certificate by a certifying body.

3. Assistance content and rates

a) Development and application of advanced quality control systems: a maximum of VND 50 million for each system and no more than 03 systems for each facility;

b) Assessment of standard/regulation conformity: a maximum of VND 15 million dong for each product and no more than 08 products for each facility;

c) Internal standard formulation: a maximum of VND 10 million for each standard and no more than 05 internal standards for each facility;

d) Employment of productivity and quality enhancement tools: a maximum of VND 40 million for each tool and no more than 03 tools for each facility;

e) For participants and winners of national and international quality awards

National quality gold award winners: VND 20 million;

National quality award winners: VND 15 million;

Winners of the International Asia Pacific Quality Award: VND 30 million.

4. Assistance scale

Assistance shall be provided for facilities developing and applying advanced quality control systems for a maximum of 50 slots; facilities whose products are granted the certificate of conformity for a maximum of 60 slots; 30 internal standards; facilities employing productivity and quality enhancement tools for a maximum of 30 slots; and 14 winners of national and international quality awards.

Article 6. Assistance for technology research and transfer, technology renovation and research result application and commercialization for new product development

1. Assistance recipients: the entities mentioned in Clause 1 Article 2 herein.

2. Conditions for assistance:

a) For technology transfer agreements: the technology to be transferred is included in the list of technologies the transfer of which is encouraged in accordance with regulations of the Law on Technology Transfer; and appraised and commissioned by the Department of Science and Technology.

b) For technology and equipment renovation:

Projects on technology and/or equipment renovation for productivity and quality improvement, energy saving and mitigation of adverse environmental impacts.

Facilities having technology and/or equipment renovation projects appraised and commissioned by the Department of Science and Technology.

c) For projects on experimental production and commercialization of research results: the facility’s project dossier meets criteria for experimental production projects according to regulations.

3. Assistance content and rates

a) For technology transfer agreements:

A technology transfer agreement worth more than VND 1 billion shall be provided with an amount equal to 20% of its value but no more than VND 400 million;

A technology transfer agreement worth from at least VND 500 million to VND 1 billion shall be provided with an amount equal to 25% of its value but no more than VND 200 million;

A technology transfer agreement worth less than VND 500 million shall be provided with an amount equal to 30% of its value but no more than VND 100 million.

b) For technology and equipment renovation projects:

A project worth more than VND 2 billion shall be provided with an amount equal to 20% of its value but no more than VND 450 million;

A project worth from at least VND 1 billion to VND 2 billion shall be provided with an amount equal to 25% of its value but no more than VND 300 million;

A project worth from at least VND 500 million to VND 1 billion shall be provided with an amount equal to 30% of its value but no more than VND 200 million.

c) For projects on experimental production and commercialization of research results via experimental production projects according to regulations:

New projects taking place in districts with exceptional socio - economic difficulties shall be provided with an amount equal to 50% of the total investment at the maximum and each project shall receive no more than VND 1,5 billion;

New projects taking place in the remaining localities shall be provided with an amount equal to 30% of the total investment at the maximum and each project shall receive no more than VND 1 billion;

4. Assistance scale

a) Assistance shall be provided for a maximum of 14 technology transfer agreements;

b) Assistance shall be provided for a maximum of 20 technology and equipment renovation projects;

c) Assistance shall be provided for a maximum of 07 projects on experimental production and commercialization of research results for new product development and improvement of productivity and product quality and competitiveness.

Article 7. Assistance for development of domestic and international science and technology markets

1. Assistance recipients: the entities mentioned in Clause 1 Article 2 herein.

2. Conditions for assistance:

a) For domestic science and technology market development: organizations and individuals having a science and technology product according to regulations;

b) For ASEAN science and technology market development: organizations and individuals owning a product created based on results of scientific and technological tasks.

3. Assistance content and rates

a) A facility engaging in domestic science and technology market development may receive a maximum of VND 20 million for no more than twice a year;

b) A facility engaging in ASEAN science and technology market development may receive a maximum of VND 50 million once a year.

4. Assistance scale

Assistance shall be provided for organizations and individuals engaging in development of domestic and international science and technology markets for a maximum of 50 slots.

Chapter III

IMPLEMENTATION

Article 8. Funding

1. Total funding allocated from the provincial budget for 2019-2025: VND 83.680 million.

2. Annual funding allocation:

Calculation unit: million VND

Article 9. Implementation

1. The People’s Committee of Quang Nam province shall implement this Resolution; provide guidelines on assistance levels for transfer models, trademark registration, technology transfer agreements, and assistance forms; and report the implementation results to the People's Council of Quang Nam province in the year-end session of every year.

2. Standing Committee of the People's Council of Quang Nam province, committees of the People's Council, delegate teams and delegates of the People's Council of Quang Nam province shall supervise implementation of this Resolution.

3. Organizations and individuals having participated in the scheme for improvement of productivity and product quality of small and medium enterprises in Quang Nam province for 2012-2020 according to Decision No. 2195/QD-UBND dated 04/7/2012 by the People’s Committee of Quang Nam province and Plan No. 5308/KH-UBND dated 26/10/2016 by the People’s Committee of Quang Nam province on establishment, management and development of industrial property rights over specialties and handicraftproducts of Quang Nam province for 2016-2020, and received the approval of the competent authority before the entry into force of this Resolution are still entitled to the assistance provided for by the approved scheme and plan and are not regulated by this Resolution.

4. In case the legislative documents cited in this Resolution are amended or superseded, the newest documents shall apply.

5. This Resolution comes into force from August 01, 2019.

This Resolution was passed by the People's Council of Quang Nam province, 9th legislature, 10th session, on July 12, 2019./.
