DECISION

ON FUNCTIONS, DUTIES, RIGHTS AND ORGANIZATIONAL STRUTURE OF VIETNAM COMPUTER EMERGENCY RESPONSE TEAM

MINISTER OF INFORMATION AND COMMUNICATIONS

Pursuant to Decree No.123/2016/ND-CP dated September 01, 2016 of the Government on functions, duties, rights and organizational structure of ministries and ministerial agencies;  

Pursuant to Decree No.17/2017/ND-CP dated February 17, 2017 of the Government on functions, duties, rights and organizational structure of the Ministry of Information and Communications;

Pursuant to Decision No.339/2005/QD-TTg dated December 20, 2005 of the Prime Minister on establishment of the Vietnam Computer Emergency Response Team; 

At the request of the Director of Vietnam Computer Emergency Response Team and Director of Personnel Department,

HEREBY DECIDES

Vietnam Computer Emergency Response Team is a public service provider affiliated to the Ministry of Information and Communications that is responsible to coordinate response to computer emergencies and cyberinformation security incidents nationwide; provide warnings about cyber-security; promote establishment and development of computer emergency response teams (hereinafter referred to as “CERT”) in enterprises and organizations and play the role of a contact point in order to cooperate with overseas CERTs.

The Vietnam Computer Emergency Response Team has legal status, stamp and transaction account in accordance with law provisions and headquarter located in Hanoi city and branches in Ho Chi Minh City and Da Nang City.

Abbreviated name: VNCERT.

Article 2. Duties and rights

1. Prepare and send annual plans for medium and long-term operations to the Minister of Information and Communications then implement the approved plans.

2. Participate in research, proposal and preparation of legislative documents, planning and strategies; take charge of preparing and implementing plans, programs, schemes or projects on response to computer emergencies and cyberinformation security incidents as assigned by the Minister;

3. Take charge of coordinating response to computer emergencies and cyberinformation security incidents nationwide and act as a liaison of the Ministry of Information and Communications to other entities and organizations for the purpose of cooperating in response to computer emergencies and cyberinformation security incidents as assigned by the Minister.

4. Provide guidelines for and organize drill of emergency response and prevention and control of cyberattacks and provide training for the cyberinformation security incident response force.  Promote establishment and development of response teams and departments in charge of response to computer emergencies and cyberinformation security incidents; set up and operate the national emergency response network.

6. Provide guidelines for, coordinate and perform prevention and control of spams; set up and operate an engineering system to serve prevention and control of spams.

7. Grant, renew and revoke management codes of advertisement service providers via email or text message; information messaging service or internet-based text messaging service; grant, renew and revoke indentifiers of advertisement service providers via text message and information messaging service providers.

8. Participate in developing technical standards and regulations on cyberinformation security and information technology.

9. Provide services and public services related to cyberinformation security as per law provisions.

10. Cooperate in disseminating and raising people’s awareness of emergency response, prevention and control of cyberattacks and assurance of cyberinformation security; provide training in professional skills in response to computer emergencies and cyber security incidents; grant certificates of information or information technology security as per law provisions.

11. Cooperate with international computer emergency and cyberinformation incident response teams and enterprise operating in the field of cyberinformation security incident response and participate in international forums and seminars of relevant fields.

12. Study, develop and transfer technologies, techniques and solutions for cyberinformation security.

13. Collect, manage and use fees and charges, fund sources and other legal funding for activities performed under it functions, duties and rights and under law provisions.

14. Manage the organizational structure, personnel, finance, assets, documents and material of VNCERT; observe policies intended for VNCERT’s personnel as regulated by law soft and authorized by the Minister.

Article 3. Organizational structure and personnel number

1. Heads of VNCERT

The VNCERT has one Director and Deputy Directors.

The Director is responsible to the Minister and the law for results of performance of assigned functions, duties and rights.

Deputy Directors assist the Director in providing guidance on and controlling activities of the Team and are responsible to the Director and the law for the tasks assigned.

2. Organizational structure

a) Departments:

- Department of Administrative Affairs,

- Department of Planning and Finance,

- Department of Systems Engineering and Monitoring, 

- Department of Research and Development,

- Department of Consultancy and Professional Training.

b) Affiliated entities:

- Branch in Ho Chi Minh City,

- Branch in Da Nang City,

VNCERT’s branches have their own stamps and transaction accounts in accordance with law provisions. Functions, duties, rights and organizational structure of branches shall be set up by VNCERT’s Director and approved by the Minister.

Functions, duties and rights of Departments and business relationships among Departments and branches will be decided by the VNCERT's Director.

3. Number of personnel of VNCERT shall be proposed by the Director and approved by the Minister.

1. This Decision comes into force from the day on which it is signed.

2. Decision No.1778/QD-BTTTT dated October 26, 2015 of the Minister of Information and Communications on functions, duties, rights and organizational structure of the Vietnam Computer Emergency Response Team will be annulled.

Article 5. Implementation responsibilities

Chief Office, Director of Department of Personnel and Organization, Directors of VNCERT and relevant entities shall take responsibility to implement this Decision./.
