CIRCULAR

INTERCONNECTION CHARGES FOR VOICE CALLS FROM LOCAL TERRESTRIAL STATIONARY TELECOMMUNICATIONS NETWORK TO NATIONAL TERRESTRIAL MOBILE NETWORK AND INTERCONNECTION CHARGES FOR VOICE CALLS BETWEEN TWO NATIONAL TERRESTRIAL MOBILE NETWORKS

Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Law on Prices dated June 20, 2012;

Pursuant to the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 on elaboration and guidelines for some articles of the Law on Telecommunications; Government’s Decree No. 81/2016/ND-CP dated July 01, 2016 on amendments to some articles of the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 on elaboration and guidelines for some articles of the Law on Telecommunications and Government’s Decree No. 49/2017/ND-CP dated April 24, 2017 on amendments to Article 15 of the Government’s Decree No. 25/2011/ND-CP dated April 06, 2011 on elaboration and guidelines for some articles of the Law on Telecommunications and Article 30 of the Government’s Decree No. 174/2013/ND-CP dated November 13, 2013 on penalties for administrative violations against regulations on post and telecommunications, information technology and radio frequency;

Pursuant to the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 on elaboration and guidelines for some articles of the Law on Prices and Government’s Decree No. 149/2016/ND-CP dated November 11, 2016 on amendments to some articles of the Government’s Decree No. 177/2013/ND-CP dated November 14, 2013 on elaboration and guidelines for some articles of the Law on Prices;

Pursuant to the Government’s Decree No. 17/2017/ND-CP dated February 17, 2017 defining functions, tasks, entitlements and organizational structure of the Ministry of Information and Communications;

At the request of the Director of Vietnam Telecommunications Authority,

The Minister of Information and Communications hereby promulgates a Circular on interconnection charges for voice calls from local terrestrial stationary telecommunications network to national terrestrial mobile network and interconnection charges for voice calls between two national terrestrial mobile networks.

Article 1. Scope

This Circular provides for interconnection charges paid to national terrestrial mobile network (hereinafter referred to as “mobile network) for voice calls from local terrestrial stationary telecommunications network (hereinafter referred to as “local network”) and voice calls from terminating mobile network to mobile network.   

Article 2. Regulated entities

This Circular applies to:

1. Telecommunications service providers providing mobile and local network interconnection voice call services.

2. Organizations and individuals related to management and provision of telecommunications services in Vietnam.

Article 3. Interconnection charges for voice calls from local network to mobile network

Interconnection charges for voice calls from local network to mobile network are applied as follows:

1. Interconnection charge for a voice call from a local network to a terminating mobile network is VND 320 per minute.

2. The interconnection charge specified in Clause 1 of this Article includes an amount paid to the telecommunications service provider upon indirect interconnection through long-distance network.

Article 4. Interconnection charges for voice calls between two mobile networks

1. Interconnection charges for voice calls between two mobile networks are applied as follows:

a) Interconnection charge for a voice call from a mobile network to Viettel’s mobile network is VND 400 per minute;

b) Interconnection charge for a voice call from a mobile network to VNPT’s mobile network is VND 440 per minute;

c) Interconnection charge for a voice call from a mobile network to MobiFone’s mobile network is VND 440 per minute;

d) Interconnection charge for a voice call from a mobile network to Vietnamobile’s mobile network is VND 440 per minute;

dd) Interconnection charge for a voice call from a mobile network to Gmobile’s mobile network is VND 440 per minute;

2. The interconnection charge specified in Clause 1 of this Article includes an amount paid to the telecommunications service provider upon indirect interconnection through long-distance network.

Article 5. Value added tax

The interconnection charges prescribed in this Circular are exclusive of value added tax.

Article 6. Publishing interconnection charges

The telecommunications service providers mentioned in Article 2 of this Circular shall publish and post interconnection charges as prescribed by the Law on Telecommunications, Law on Prices and relevant guiding documents.

Article 7. Effect and implementation

1. This Circular comes into force from May 01, 2018 and replaces the Circular No. 29/2009/TT-BTTTT dated November 19, 2009 and the Circular No. 33/2009/TT-BTTTT dated November 19, 2009 of the Minister of Information and Communications.

2. Chief of Office, Director of Vietnam Telecommunications Authority, heads of ministerial authorities, General Directors, Directors of telecommunications enterprises and relevant organizations and individuals are responsible for the implementation of this Circular.

3. Difficulties that arise during implementation should be promptly reported to the Ministry of Information and Communications (Vietnam Telecommunications Authority)./.
