CIRCULAR
PRESCRIBING UPDATE, USE AND MANAGEMENT OF NATIONAL CROP PRODUCTION DATABASE AND PROVISION OF INFORMATION THEREOF
Pursuant to the Prime Minister’s Decree No. 15/2017/ND-CP dated February 17, 2017 on functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Crop Production Law dated November 19, 2018;
At the request of the Director General of the Department of Crop Production;
The Minister of Agriculture and Rural Development promulgates a Circular prescribing update, use and management of the national crop production database and provision of information thereof.
Chapter I
GENERAL PROVISIONS
Article 1. Scope
This Circular provides for update, use and management of the national crop production database and provision of information thereof, including Databases of plant varieties; fertilizers; farming; farming land; crop product processing and markets; legislative documents on crop production; regulatory documents related to crop production; results of scientific researches and technological development; technical standards and regulations for crop production.
Article 2. Regulated entities
This Circular is applicable to organizations and individuals related to the contents prescribed in Article 1 herein.
Chapter II
CONTENTS OF NATIONAL CROP PRODUCTION DATABASE
Article 3. Database of legislative documents and regulatory documents related to crop production
Database of legislative documents and regulatory documents related to crop production includes:
1. Data on legislative documents and regulatory documents on plant varieties.
2. Data on legislative documents and regulatory documents on fertilizers.
3. Data on legislative documents and regulatory documents on farming.
4. Data on legislative documents and regulatory documents on preservation, preliminary treatment and processing.
Article 4. Database of plant varieties
1. Data on organizations and individuals eligible for production of plant varieties: Name, headquarters address; plant varieties and yield thereof, plant variety level; applicable technical standards and declaration of conformity.
2. Data on registered or designated plant variety certification bodies and testing bodies: Name, address, ID number (if any), decision issuing unit, decision number and designated or registered scope of service.
3. Data on first-generation plants and first-generation plant gardens: Name of organization or individual; address; detailed information on first-generation plants/first-generation plant gardens included in certificate of first-generation plant/first-generation plant garden.
4. Data on plant variety import and export: Names and addresses of importers and exporters; plant variety names, quantities of imported and exported plant varieties.
5. Data on technical standards and regulations for plant varieties.
6. List of main crops.
7. List of plant varieties permitted for sale in Vietnam.
8. List of crop genetic resources prohibited from export.
9. Data on results of scientific researches and technological development for plant varieties.
10. List of protected plant varieties.
Article 5. Database of fertilizers
1. Data on organizations and individuals eligible for fertilizer production: Name, headquarters address; production site’s address; list of produced fertilizers and output thereof; production forms; applicable technical standards and declaration of conformity; unit issuing certificate of eligibility and number thereof.
2. Data on organizations and individuals eligible for fertilizer wholesaling: Name, wholesale establishment’s address; unit issuing certificate of eligibility and number thereof.
3. Data on registered or designated fertilizer certification bodies and testing bodies: Name, address, ID number (if any), decision issuing unit, decision number and designated or registered scope of service.
4. Data on fertilizer import and export: Names and addresses of importers and exporters; fertilizer types, quantities of imported and exported fertilizers.
5. Data on technical standards and regulations for fertilizers.
6. List of fertilizers permitted for sale in Vietnam.
7. Data on results of scientific researches and technological development for fertilizers.
Article 6. Database of farming
1. Farming data: Farming area, area of newly planted crops, harvestable area, productivity and yield of perennial plants; farming area, productivity and yield of annual plants.
2. Data on farming cooperation: Cooperation forms, farming area and yield of each crop.
3. Data on production of genetically modified crops: Farm name and headquarters address; farm address; crops and farming area and yield thereof; applicable technical standards and declaration of conformity.
4. Data on high-tech farming: Names of regions, provinces and central-affiliated cities; crops, farming area and yield thereof, and applied technologies.
5. Data on registered or designated crop product certification bodies and testing bodies: Name, address, ID number (if any), designation issuing unit, unit issuing registration of scope of service, designation decision number and number of registration of scope of service.
6. Data on food safety certified farms, VietGAP certified farms and certified organic farms: Name, headquarters address; farm address; crops, farming area and yield thereof, farming form; number of certificate issuance decision or number of certificate.
7. Data on codes of crop cultivation regions: Name, crop cultivation region’s address, crops and farming area and yield thereof; certificate of code of crop cultivation region.
8. Data on damage caused by natural disasters and epidemics: Damaged crops, loss of farming areas and yield.
9. Data on technical standards and regulations for crop cultivation.
10. Data on results of scientific researches and technological development for crop cultivation.
Article 7. Database of farming land
1. Data on farming land fertility.
2. Data on areas for cultivation of annual plants and perennial plants previously used for rice cultivation, and areas for rice cultivation in combination with aquaculture.
3. Data on technical standards and regulations for farming land.
Article 8. Database of crop product processing and markets
1. Data on facilities for preliminary treatment and processing of crop products: Name, address, enterprise ID number, plant approval number, applied quality control system, capacity, products, product types, input, ingredient imports, output, prime cost, export value (USD/year) and markets (domestic and export).
2. Data on export and import markets for crop products: Export markets, import markets, product quantity, types and specification, buying price, selling price, export value and import value.
3. Data on technical standards and regulations for preservation, preliminary treatment and processing.
Chapter III
ACCOUNT MANAGEMENT, UPDATE AND USE OF NATIONAL CROP PRODUCTION DATABASE
Article 9. Principles of management of accounts used for update of national crop production database
1. Decentralization in update of the national crop production database.
2. Granting and locking of accounts used for data update (“update accounts”) of individuals (officials and public employees), administrative authorities and certification bodies.
3. A body granted update accounts shall assign its members to control, update, use and manage the national crop production database.
4. An individual granted an update account has the power to control, update, use and manage the national crop production database, and shall keep such database secured and use the granted account for its intended purposes.
5. An update account will be locked if:
a) The body to which the account is granted dissolves, terminates its operation or undergoes a transfer process; or
b) The individual to whom the account is granted transfers to another workplace, resigns or retires.
Article 10. Frequency of update of national crop production database
1. The contents prescribed in Article 3; Clauses 1, 2, 3, 5, 6, 7, 8 and 10 Article 4; Clauses 1, 2, 3, 5 and 6 Article 5; Clauses 5 and 9 Article 6; Clause 3 Article 7 and Clause 3 Article 8 shall be updated on a monthly basis and before the 30th of the month.
2. The contents prescribed in Clause 4 Article 5; Clauses 6, 7 and 8 Article 6; Clause 2 Article 8 of this Circular shall be updated on a semiannual basis, before June 30 and December 31 of each year.
3. The contents prescribed in Clauses 4 and 9 Article 4; Clause 7 Article 5; Clauses 1, 2, 3, 4 and 10 Article 6; Clauses 1 and 3 Article 7 and Clause 1 Article 8 of this Circular shall be updated on an annual basis, before December 20 of each year.
Article 11. Use of national crop production database
1. The bodies acting as the contact points for development and update of the national crop production database at central and provincial levels have the right to use such database as authorized.
2. The bodies and individuals holding the right to use the national crop production database are specified in Articles 3, 4, 5, 6, 7 and 8 herein.
Chapter IV
MANAGEMENT OF NATIONAL CROP PRODUCTION DATABASE
Article 12. Management of national crop production database
1. Development and operation of infrastructure and software of the national crop production database to ensure system-wide accuracy and stability.
2. Update, processing and integration of information into the national crop production database.
3. Management of access to information in the database.
4. Monitoring use of the database.
5. Supporting operation and use of the database.
Article 13. Security and safety assurance for national crop production database
1. Use suitable and copyrighted software and apply technologies to prevent and detect unauthorized access.
2. Employ encoded channels and authentication for the following operations: Login to manage the system; login to applications; automatic data transmission between servers; data input and edit.
3. Encode connections of the national crop production database.
4. Implement measures to ensure data authenticity and protect data integrity.
5. Keep logs of data access, creation, modification and deletion to manage and monitor the system.
6. Formulate periodical data backup plans to ensure smooth and stable system performance during incidents.
7. Take other necessary measures to ensure safety of the national crop production database.
Chapter V
RESPONSIBILITIES OF BODIES AND INDIVIDUALS
Article 14. Responsibilities of Department of Crop Production
1. Take charge in providing guidelines on reporting of figures for development, update, use and management of the national crop production database nationwide for relevant bodies and individuals.
2. Take charge in operating, maintaining, monitoring and upgrading infrastructure and software, and implementing measures to ensure security and safety of the national crop production database.
3. Grant and lock update accounts of individuals (officials and public employees), administrative authorities and certification bodies.
4. Manage administrator accounts, assign tasks in update and use of the national crop production database.
5. Provide guidelines for update, use and management of the national crop production database and provision of information thereof, and inspect such tasks on a periodical or ad hoc basis. Organize trainings and provide instructions on update, use and management of the national crop production database.
6. Evaluate and rank the capacity for update, use and management of the national crop production database of bodies, and announce such information annually.
7. Cooperate with relevant units in handling difficulties that arise during update, use and management of the national crop production database.
8. Invest in and develop infrastructure of service to update, use and management of the national crop production database.
9. Assign officials to control, update, use and manage the national crop production database.
10. Update the data prescribed in Clauses 1 and 3 Article 3; Clauses 2, 4, 5, 6, 7, 8, 9 and 10 Article 4 and Clause 5 Article 6 for the bodies designated or granted the operating registration by the Department of Crop Production; update the data prescribed in Clauses 9 and 10 Article 6 and Clauses 1 and 3 Article 7 herein.
Article 15. Responsibilities of Plant Protection Department
1. Provide guidelines on reporting of figures for development, update, use and management of the fertilizer database for relevant bodies and individuals.
2. Inspect and supervise implementation of regulations on update, use and management of the fertilizer database prescribed in this Circular.
3. Ensure timely update of adequate and accurate information to the fertilizer database and safety and security of such information.
4. Update the data prescribed in Clause 2 Article 3 and Article 5 of this Circular.
Article 16. Responsibilities of Agro Processing and Market Development Authority
1. Provide guidelines on reporting of figures for development, update, use and management of the database of product preservation and processing and export and import markets for crop products for relevant bodies and individuals.
2. Inspect and supervise implementation of regulations on update, use and management of the database of product preservation and processing and export and import markets for crop products prescribed in this Circular.
3. Ensure timely update of adequate and accurate information to the database of product preservation and processing and export and import markets for crop products and safety and security of such information.
4. Update the data prescribed in Clause 4 Article 3 and Article 8 of this Circular.
Article 17. Responsibilities of National Agro-Forestry-Fisheries Quality Assurance Department
1. Update the data prescribed in Clause 5 Article 6 of this Circular for the bodies designated or granted the operating registration by the National Agro-Forestry-Fisheries Quality Assurance Department.
2. Ensure timely update of adequate and accurate information to the database of crop product certification bodies and testing bodies according to its powers and assigned tasks.
Article 18. Responsibilities of Centre for Informatics and Statistics
Provide information on farming and export and import markets for plant varieties and crop products for specialized Departments upon request.
Article 19. Responsibilities of certification bodies
1. Update data on VietGAP certified farms and organic farms specified in Clause 6 Article 6 of this Circular.
2. Ensure timely update of adequate and accurate information to the database of VietGAP certified farms and organic farms specified in Clause 6 Article 6 of this Circular.
Article 20. Responsibilities of Departments of Agriculture and Rural Development
1. Provide guidelines on reporting of figures for development, update, use and management of the national crop production database within their provinces for relevant bodies and individuals.
2. Cooperate with the Department of Crop Production in update, use and management of the national crop production database according to their assigned tasks and powers.
3. Inspect and supervise implementation of regulations on update, use and management of the national crop production database and provision of information thereof prescribed in this Circular of relevant bodies and individuals within their provinces.
4. Ensure timely update of adequate and accurate information to the national crop production database within their provinces and safety and security of such information.
5. Invest in and develop infrastructure of service to update, use and management of the national crop production database within their provinces.
6. Update the data specified in Clauses 1 and 3 Article 4; Clauses 1, 2, 3, 4, 7 and 8 Article 6; Clause 2 Article 7 and information on the farms meeting food safety requirements mentioned in Clause 6 Article 6 herein.
Chapter VI
IMPLEMENTATION
Article 21. Implementation clause
1. This Circular takes effect from January 01, 2020.
2. During the implementation of this Circular, any problem arising should be promptly reported to the Department of Crop Production, which will submit a compiled report to the Ministry of Agriculture and Rural Development for consideration and/or amendment./.
