Căn cứ Nghị định số 15/2017/NĐ-CP ngày 17 tháng 02 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;
Căn cứ Nghị định số 69/2018/NĐ-CP ngày 15 tháng 5 năm 2018 của Chính phủ quy định chi tiết một số điều của Luật Quản lý ngoại thương;
Căn cứ Nghị định số 85/2019/NĐ-CP ngày 14 tháng 11 năm 2019 của Chính phủ quy định thực hiện thủ tục hành chính theo cơ chế một cửa quốc gia, cơ chế một cửa ASEAN và kiểm tra chuyên ngành đối với hàng hóa xuất khẩu, nhập khẩu;
Theo đề nghị của Vụ trưởng Vụ Pháp chế; Tổng cục trưởng Tổng cục Thủy sản; Tổng cục trưởng Tổng cục Lâm nghiệp; Cục trưởng các Cục: Bảo vệ thực vật, Thú y, Chăn nuôi, Trồng trọt, Kinh tế hợp tác và Phát triển nông thôn;
Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành Thông tư ban hành bảng mã số HS đối với danh mục hàng hóa thuộc thẩm quyền quản lý nhà nước của Bộ Nông nghiệp và Phát triển nông thôn và danh mục hàng hóa xuất, nhập khẩu phải kiểm tra chuyên ngành trong lĩnh vực nông nghiệp và phát triển nông thôn.
Điều 1. Ban hành kèm theo Thông tư này:
1. Phụ lục I. Bảng mã số HS đối với danh mục hàng hóa thuộc thẩm quyền quản lý nhà nước của Bộ Nông nghiệp và Phát triển nông thôn, cụ thể:
Mục 1. Bảng mã số HS đối với danh mục động vật, sản phẩm động vật trên cạn thuộc diện phải kiểm dịch.
Mục 2. Bảng mã số HS đối với danh mục động vật khác trong chăn nuôi.
Mục 3. Bảng mã số HS đối với danh mục giống vật nuôi cấm xuất khẩu.
Mục 4. Bảng mã số HS đối với danh mục giống vật nuôi cần bảo tồn.
Mục 5. Bảng mã số HS đối với danh mục động vật, sản phẩm động vật thủy sản thuộc diện phải kiểm dịch.
Mục 6. Bảng mã số HS đối với danh mục loài thủy sản được phép sản xuất, kinh doanh tại Việt Nam.
Mục 7. Bảng mã số HS đối với danh mục các loài thủy sản xuất khẩu có điều kiện.
Mục 8. Bảng mã số HS đối với danh mục các loài thủy sản cấm xuất khẩu.
Mục 9. Bảng mã số HS đối với danh mục vật thể thuộc diện kiểm dịch thực vật của Việt Nam.
Mục 10. Bảng mã số HS đối với danh mục thực phẩm có nguồn gốc thực vật nhập khẩu.
Mục 11. Bảng mã số HS đối với danh mục giống cây trồng.
Mục 12. Bảng mã số HS đối với danh mục nguồn gen cây trồng cấm xuất khẩu.
Mục 13. Bảng mã số HS đối với danh mục muối (kể cả muối ăn và muối bị làm biến tính).
Mục 14. Bảng mã số HS đối với sản phẩm thức ăn chăn nuôi thương mại được công bố trên Cổng thông tin điện tử của Bộ Nông nghiệp và Phát triển nông thôn.
Mục 15. Bảng mã số HS đối với danh mục hóa chất, sản phẩm sinh học, vi sinh vật cấm sử dụng trong thức ăn chăn nuôi.
Mục 16. Bảng mã số HS đối với danh mục hóa chất, chế phẩm sinh học, vi sinh vật, nguyên liệu sản xuất thức ăn được phép sử dụng trong nuôi trồng thủy sản tại Việt Nam và thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản thành phẩm.
Mục 17. Bảng mã số HS đối với danh mục hóa chất, chế phẩm sinh học, vi sinh vật cấm sử dụng trong thức ăn thủy sản, sản phẩm xử lý môi trường nuôi trồng thủy sản.
Mục 18. Bảng mã số HS đối với danh mục thuốc thú y, nguyên liệu thuốc thú y được phép nhập khẩu lưu hành tại Việt Nam.
Mục 19. Bảng mã số HS đối với danh mục phân bón.
Mục 20. Bảng mã số HS đối với danh mục hàng hóa cấm xuất khẩu là gỗ tròn, gỗ xẻ các loại từ gỗ rừng tự nhiên trong nước.
Mục 21. Bảng mã số HS đối với danh mục gỗ và sản phẩm chế biến từ gỗ khi xuất khẩu phải có hồ sơ lâm sản hợp pháp.
Mục 22. Bảng mã số HS đối với danh mục thuốc bảo vệ thực vật.
Mục 23. Bảng mã số HS đối với danh mục thuốc bảo vệ thực vật cấm sử dụng tại Việt Nam.
Mục 24. Bảng mã số HS đối với danh mục về lĩnh vực khai thác thủy sản.
Mục 25. Bảng mã số HS đối với danh mục sản phẩm xử lý chất thải chăn nuôi.
Mục 26. Bảng mã số HS đối với danh mục máy, thiết bị nông nghiệp.
2. Phụ lục II. Bảng mã số HS đối với danh mục hàng hóa nhập khẩu phải kiểm tra chuyên ngành trước thông quan thuộc thẩm quyền quản lý nhà nước của Bộ Nông nghiệp và Phát triển nông thôn: 1639 (một nghìn sáu trăm ba mươi chín) dòng hàng.
3. Phụ lục III. Bảng mã số HS đối với danh mục hàng hóa nhập khẩu phải kiểm tra chuyên ngành sau thông quan thuộc thẩm quyền quản lý nhà nước của Bộ Nông nghiệp và Phát triển nông thôn: 03 (ba) dòng hàng.
4. Việc kiểm tra chuyên ngành đối với hàng hóa xuất khẩu thuộc thẩm quyền quản lý nhà nước của Bộ Nông nghiệp và Phát triển nông thôn thực hiện theo đề nghị của doanh nghiệp, phục vụ việc thông quan hàng hóa tại nước nhập khẩu.
1. Thông tư này có hiệu lực thi hành kể từ ngày 06 tháng 11 năm 2021.
2. Thông tư này thay thế Thông tư số 15/2018/TT-BNNPTNT ngày 29/10/2018 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn ban hành bảng mã số HS đối với danh mục hàng hóa thuộc thẩm quyền quản lý của Bộ Nông nghiệp và Phát triển nông thôn.
1. Chánh Văn phòng Bộ, Vụ trưởng Vụ Pháp chế, Thủ trưởng các đơn vị thuộc Bộ Nông nghiệp và Phát triển nông thôn và các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.
2. Trong quá trình thực hiện Thông tư, nếu có vướng mắc, đề nghị phản ánh kịp thời về Bộ Nông nghiệp và Phát triển nông thôn để nghiên cứu, sửa đổi, bổ sung cho phù hợp./.

CIRCULAR
PROMULGATION OF HS CODES OF COMMODITIES UNDER MANAGEMENT OF MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT AND IMPORTS AND EXPORTS SUBJECT TO SPECIALIZED INSPECTION IN THE FIELD OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Government’s Decree No.15/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some articles of the Law on foreign trade management;
Pursuant to the Government’s Decree No. 85/2019/ND-CP dated November 14, 2019 on handling of administrative procedures via national single window and ASEAN single-window system and specialized inspection for imports and exports;
At the request of the Director of the Legal Department, Director General of Directorate of Fisheries, Director General of the Vietnam Administration of Forestry, Directors of Plant Protection Department, Department of Husbandry, Animal Health Department, Department of Cultivation, Cooperatives and Rural Development Department;
The Minister of Agriculture and Rural Development promulgates a Circular promulgating HS codes of commodities under management of Ministry of Agriculture and Rural Development and imports and exports subject to specialized inspection in the field of agriculture and rural development.
Article 1. The following Annexes are enclosed with this Circular:
1. Annex I. Lists of HS codes of commodities under management of Ministry of Agriculture and Rural Development, including:
Section 1. List of HS codes of terrestrial animals and products thereof subject to quarantine.
Section 2. List of HS codes of other animals in the field of animal husbandry.
Section 3. List of HS codes of livestock breeds banned from export.
Section 4. List of HS codes of livestock breeds requiring conservation.
Section 5. List of HS codes of aquatic animals and products thereof subject to quarantine.
Section 6. List of HS codes of aquatic species produced and traded in Vietnam.
Section 7. List of HS codes of aquatic species subject to conditional export.
Section 8. List of HS codes of aquatic species banned from export.
Section 9. List of HS codes of articles subject to Vietnam’s plant quarantine.
Section 10. List of HS codes of food products made of imported plants.
Section 11. List of HS codes of plant varieties.
Section 12. List of HS codes of plant genetic resources banned from export.
Section 13. List of HS codes of salt products (including table salt and denatured salt).
Section 14. List of HS codes of commercial animal feed products published on the web portal of the Ministry of Agriculture and Rural Development.
Section 15. List of HS codes of chemicals, biological products and microbial products banned from use in animal feeds.
Section 16. List of HS codes of chemicals, biological preparations, microbial products and ingredients in aquaculture feeds in Vietnam and aquaculture feeds and finished environmental treating products in aquaculture.
Section 17. List of HS codes of chemicals, biological preparations and microbial products banned from use in aquaculture feeds and environmental treating products in aquaculture.
Section 18. List of HS codes of veterinary drugs and ingredients thereof imported and sold in Vietnam.
Section 19. List of HS codes of fertilizers.
Section 20. List of HS codes of products banned from export which are round wood and saw logs from domestic natural forests.
Section 21. List of HS codes of wood and products thereof which must be supported by lawful forest product dossiers when being exported.
Section 22. List of HS codes of pesticides.
Section 23. List of HS codes of pesticides banned from use in Vietnam.
Section 24. List of HS codes of articles in fishing sector.
Section 25. List of HS codes of livestock waste treatment products.
Section 26. List of HS codes of agricultural machinery and equipment.
2. Annex II. List of HS codes of imports subject to specialized inspection before grant of customs clearance under the management of the Ministry of Agriculture and Rural Development: <0} 1639 commodity lines.
3. Annex III. List of HS codes of imports subject to specialized inspection after grant of customs clearance under the management of the Ministry of Agriculture and Rural Development: 03 commodity lines.
4. Specialized inspection of exports under the management of the Ministry of Agriculture and Rural Development shall be carried out at the request of enterprises to serve the clearance of their goods in countries of import.
Article 2. Effect
1. This Circular comes into force from November 06, 2021.
2. This Circular supersedes the Circular No. 15/2018/TT-BNNPTNT dated October 29, 2018 of the Minister of Agriculture and Rural Development promulgating list of HS codes of commodities under management of Ministry of Agriculture and Rural Development.
Article 3. Responsibility for implementation
1. Chief of the Ministry's Office, Director of the Legal Department, heads of units and agencies affiliated to the Ministry of Agriculture and Rural Development, and relevant authorities, organizations and individuals shall be responsible for the implementation of this Circular.
2. Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for consideration./.
