Decision No. 956/QD-TTg dated July 6, 2020 on Establishment of National Medical Council

DECISION

ESTABLISHMENT OF NATIONAL MEDICAL COUNCIL

PRIME MINISTER

Pursuant to Law on Government Organization dated June 19, 2015;

Pursuant to Decree No. 75/2017/ND-CP dated June 20, 2017 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Resolution No. 139/NQ-CP dated December 31, 2017 of the Government on Action program of the Government in implementation of Resolution No. 20/NQ-TW dated October 25, 2017 of the 6^th meeting of the 12^th Central Executive Committee on enhancing people’s health protection, care and improvement in modern time;

At the request of Minister of Health;

HEREBY DECIDES:

Establish National Medical Council (hereinafter referred to as “Council”) to assist the Prime Minister in satisfying necessary requirements for assessing medical examination and treatment capacity according to Resolution No. 20/NQ-TW dated October 25, 2017 of the 6th meeting of the 12th Central Executive Committee on enhancing people’s health protection, care and improvement in modern time to meet the demand for developing medical personnel capacity.

The Council shall have separate stamps, account and head office based in Hanoi City.

The Council shall operate in accordance with Regulations on organization and operation prescribed by the Prime Minister.

Article 2. Organizational structure of the Council

1. The Council consists of a Chairperson, Vice Chairpersons and Councilors (hereinafter referred to as “Council members”) who are experts in the medical field accredited for credibility, experience and specialized knowledge satisfactory to functions, tasks and specialized fields of the Council. In which:

a) The Chairperson title shall be held by Minister of Health; 1 Standing Vice Chairperson of the Council must work full-time.  Assignment and dismissal of the Chairperson and Vice Chairpersons of the Council shall be performed by the Prime Minister.

b) Number of Councilors shall range from 27 to 29 members, which includes representatives of the Vietnam Medical Association and other medical associations; health training facilities; medical examination and treatment establishments; Agencies and Departments affiliated to the Ministry of Health specialized in training, medical examination, medical treatment and legal affairs; representatives of Ministry of Education and Training. Councilors of the Council shall follow part-time working principle. Assignment and dismissal of Councilors shall be performed by the Minister of Health.

Standards of Council members shall be elaborated under Regulations on organization and operation of the Council.

2. Specialized boards of the Council shall perform tasks in specific fields.  Members of the specialized boards are Council members and experts accredited for credibility, experience and professional knowledge satisfactory to specialized medical fields of each board and shall follow part-time working principle. The Chairperson of the National Medical Council shall decide on establishment of specialized boards, promulgate Regulations on operation of specialized boards and prescribe eligibility of members of the specialized boards.

Article 3. Tasks of the Council

1. Develop practice standards for medical examination and treatment titles to enable entities affiliated to the Ministry of Health to propose the Minister of Health; participate in monitoring and assessing compliance with practice standards of the medical examination and treatment practitioners who have been issued with medical license at request of medical regulatory agencies and as per the law.

2. Prepare necessary requirements to organize assessment of medical examination and treatment capacity as per the law: developing and testing question bank for assessing practice capacity; developing standards of medical practice accreditation institutions; developing national information systems and databases on medical practice capacity assessment.

3. Conduct other tasks assigned by the Prime Minister and as per the law.

Article 4. Entry into force

This Decision comes into effect from the date of signing.

Article 5. Responsibilities for implementation

1. Minister of Health:

a) Requesting the Prime Minister to decide on assignment and dismissal of the Chairperson and Vice Chairpersons of the Council.

2. Ministers, heads of ministerial agencies, heads of Governmental agencies, heads of Governmental agencies and heads of relevant agencies, organizations and individuals are responsible for implementation of this Decision./.
