DECISION

PROMULGATING LIST OF STATE SECRETS IN THE FIELD OF NATURAL RESOURCES AND ENVIRONMENT

THE PRIME MINISTER

Pursuant to the Law on Organization of Government dated June 19, 2015;

Pursuant to the Law on Protection of State Secrets dated November 15, 2018;

At the request of the Minister of Natural Resources and Environment;

HEREBY DECIDES:

Article 1. State secrets classified as “secret”

a) Written requests for guidelines of the Communist Party or State about negotiations on establishment, maintenance and development of international river basin organizations related to Vietnam; negotiations on protection of national interests in extraction, use and protection of international river water resources;

b) Undisclosed documents about cross sections and runoffs of rivers and streams serving the planning and placing of boundary markers on rivers and streams;

c) Undisclosed results of baseline surveys on water resources on rivers, streams and transboundary water resources relating to national defense and security.

2. Regarding environment:

a) Undisclosed written requests for guidelines of the Communist Party or State about actions against consequences of toxic chemicals used during the Vietnam War and actions against marine environmental emergencies;

b) Plans for or contents of negotiations on actions against consequences of toxic chemicals used during the Vietnam War which have been approved by the Communist Party or State.

3. Regarding meteorology and hydrology:

a) Written requests for guidelines of the Communist Party or State about meteorological and hydrological structures serving the protection of national territorial and boundary sovereignty;

b) Topographical documents (river cross sections, longitudinal sections and topographical maps) and documents about the flow velocities actually measured at hydrological stations in the estuarine areas within a radius of 30 km, 50 km and 15 km from the sea in respect of tributaries of Red river and Thai Binh river, tributaries of Dong Nai river and Cuu Long river, and other rivers serving national defense and security purposes respectively.

a) Data of the national coordinate system of class II, or higher, covering the area of a province;

b) Undisclosed cartographic results of surveys on national boundaries serving negotiations on planning for national boundaries.

5. Regarding land:

Undisclosed resolutions and decisions on land use planning, maps and data about land use planning for implementation of important works relating to national defense and security in border, territorial waters or island areas and national energy.

6. Regarding sea and islands:

a) Undisclosed written requests for guidelines of the Communist Party or State about negotiations on protection of national interests in extraction and use of natural resources and environment of sea and islands;

b) Data, maps and diagrams of acoustic wave fields in territorial waters of Vietnam;

c) Undisclosed topographic, geographic, natural resource and environment maps of archipelagoes, islands, low-tide elevations and submerged atolls with a scale greater than 1:10.000, which serve national defense and security, and external affairs purposes;

d) Undisclosed co-ordinates, reserves and natural resources of class 333 or higher of mineral ores in the deep sea;

Article 2. State secrets classified as “confidential”

1. Regarding environment:

a) Undisclosed plans and results of treatment of environmental pollution, transboundary environmental pollution, marine environmental pollution due to spill of oil or toxic chemicals and maritime environmental emergencies that affect national defense and security or have social and economic impacts;

b) Undisclosed documents/samples collected from investigations, national consolidated data about impacts of chemical warfare on human and environment of Vietnam.

2. Regarding meteorology and hydrology:

a) Undisclosed results of state-funded baseline surveys on meteorology, hydrology and oceanography serving national defense and security purposes;

b) Sites and height values of main marks of hydrometeorological, oceanographic and water resource observing stations, data on the height and absolute zero of oceanographic marks serving national defense and security purposes.

3. Regarding topography and cartography:

a) National system of original topographic data, including original data of the national coordinate system, national height system, national gravitational system and national depth system;

c) Topographic data layer of the national geographic database and national topographic maps of scale 1:2.000, 1:5.000, 1:10.000, 1:25.000, 1:100.000 for an association area larger than 200 km² on field in suburban areas or 400 km² in urban areas; digital elevation model with the accuracy of 07 m for an association area larger than 200 km² on field in suburban areas or 400 km² in urban areas.

4. Regarding sea and islands:

a) Undisclosed written requests for guidelines of the Communist Party or State about extraction and use of natural resources, protection of environment of sea and islands in the deep sea, and new natural resources of great importance for socio-economic development, assurance of national defense and security;

b) Undisclosed co-ordinates, reserves and natural resources of class 333 or higher of precious metal and precious stone ores in shallow sea waters;

c) Undisclosed data and documents on national marine spatial planning and amendments thereof, and master plan for sustainable extraction and use of coastal resources relating to national defense and security;

d) Undisclosed documents on scientific grounds for naming of islands;

dd) Undisclosed plans/results of state-funded extraction, research and baseline surveys on natural resources and environment of sea and islands relating to national defense and security.

5. Regarding geology and minerals:

a) Original documents and maps, accompanied by gravity method, containing information about gravity values and measuring sites;

c) Undisclosed results of uranium and thorium radioactive exploration and assessment schemes.

Article 3. Effect

This Decision comes into force from the date on which it is signed.

Article 4. Responsibility for implementation

1. The Minister of Natural Resources and Environment shall play the leading role and cooperate with the Minister of Public Security to instruct and inspect the implementation of this Decision.

2. Ministers, heads of ministerial agencies, heads of Governmental agencies, and Chairpersons of People’s Committees of central-affiliated cities or provinces shall be responsible for the implementation of this Decision./.
