CIRCULAR
ON AMENDMENTS TO CERTAIN PROVISIONS OF REGULATION ON MANAGEMENT OF OVERSEAS BUSINESS TRIPS OF OFFICIALS AND PUBLIC EMPLOYEES ISSUED TOGETHER WITH CIRCULAR NO. 17/2014/TT-BGDDT DATED MAY 26, 2014 OF THE MINISTER OF EDUCATION AND TRAINING
Pursuant to Decree No. 69/2017/ND-CP dated May 25, 2017 of the Government on functions, duties, powers and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 136/2007/ND-CP dated August 17, 2007 of the Government on exit and entry of Vietnamese citizens; Decree No. 94/2015/ND-CP dated October 16, 2015 of the Government on amendments to certain provisions of Decree No. 136/2007/ND-CP dated August 17, 2007 on exit and entry of Vietnamese citizens;
At the request of Director of Department of International Cooperation,
The Minister of Education and Training promulgates a Circular on amendments to certain provisions of Regulation on management of overseas business trips of officials and public employees issued together with Circular No. 17/2014/TT-BGDDT dated May 26, 2014 of the Minister of Education and Training.
Article 1. Certain provisions of Regulation on management of overseas business trips of officials and public employees issued together with Circular No. 17/2014/TT-BGDDT dated May 26, 2014 of the Minister of Education and Training are amended as follows:
1. Point c clause 1 of Article 2 shall be amended as follows:
“c) Officials or public employees who are the heads of wholly state-owned enterprises affiliated to the Ministry of Education and Training.”
2. Clause 5 of Article 3 shall be amended as follows:
Heads of units, directors of projects, schemes, programs affiliated to the Ministry of Education and Training; heads of affiliated entities of the Ministry of Education and Training; chairpersons of university council, chairpersons of school council of higher education institutions affiliated to the Ministry of Education and Training; heads of wholly state-owned enterprises affiliated to the Ministry of Education and Training may join outbound delegations up to twice a year in a plan in line with their expertise, except for joining entourages as required by the superior authorities, perform international cooperation or negotiation duties, and otherwise so permitted by the Minister of Education and Training; no more than 01 delegation shall be sent in the same time, to the same place, and in the same event upon the invitation of a single partner.
3. Clauses 2, 3, 4 of Article 4 shall be amended and clause 5 shall be added to Article 4 as follows:
a) Clauses 2, 3, 4 of Article 4 shall be amended as follows:
“2. Delegations which are led by Ministers or equivalent to visit and work officially with countries; attend international conferences, seminars, forums, negotiations, and inter-Government meetings within the framework of international agreements and international treaty to which Vietnam is a signatory.
3. Delegations which attend international conferences, seminars, forums, negotiations, and intergovernmental meetings within the framework of international agreements and international treaty to which Vietnam is a signatory; join short-term refresher courses or training; cultural exchange activities, summer camps, sports events, international competitions.
4. Delegations which survey and exchange experience; negotiate and work within the framework of signed cooperation projects and programs; attend international education fairs and exhibitions in the plans and of programs and projects or participate in other activities in the education sector."
b) Clause 5 shall be added to Article 4 as follows:
“5. Officials and public employees who attend international conferences, seminars, forums, and negotiations, attend intergovernmental meetings; short-term refresher courses and training; cultural exchange activities, summer camps, sports events, international competitions."
4. Article 4a shall be added to Article 4 as follows:
“Article 4a. Regulations on quantity of delegates, duration, composition of a delegation
1. For a delegation in the form specified in Clause 1, Article 4, the quantity of delegates, duration of work, purpose, contents and work program shall be based on the delegation's plan approved by competent authorities.
2. For a delegation in the form specified in Clause 1, Article 4, the quantity of delegates, duration of work, purpose, contents and work program shall be based on the delegation's plan approved by the heads of competent authorities to ensure the efficiency of the business trip.”
5. Clauses 4 and 5 shall be added to Article 8 as follows:
“4. For officials or public employees who do not hold the leadership position of a unit, on an overseas business trip not going with a delegation, they are required to send a report on the result of the trip to the head of the unit responsible for overseeing these officials or public employees in that overseas business trip.
5. Before December 20 of each year, relevant units shall send reports on management of outbound delegations, summarize the results of overseas business trips, the number of documents signed during the business trips (if any), and implementation of things to do in the business trips to the Ministry of Education and Training.”
6. Clause 1 of Article 9 shall be amended as follows:
“1. The delegation must comply with the information confidentiality regime in accordance with the provisions of the Law on the Protection of State Secrets and relevant regulations.”
7. Clause 9 of Article 10 shall be amended as follows:
“9. Consolidate and send to the Ministry leader annual report on outbound delegations of the Ministry of Education and Training before December 31. ”
8. Appendix 2a shall be added: Report on management of outbound delegations.
Article 2. The word “Vụ Hợp tác quốc tế” (Bureau of International Cooperation) shall be replaced with the word “Cục Hợp tác quốc tế” (Department of International Cooperation) in the entire Circular.
Article 3. This Circular comes into force as of February 10, 2020.
Article 4. The Chief Officer, Director of Department of International Cooperation, Heads of affiliated entities of the Ministry of Education and Training and relevant entities shall implement this Circular./.
