PROMULGATING THE REGULATION ON MANAGEMENT OF FOREIGNERS STUDYING IN VIETNAM
Pursuant to the Government’s Decree No. 36/2012/ND-CP of April 18, 2012, defining the functions, tasks, powers and organizational structures of ministries and ministerial-level agencies;
Pursuant to the Government’s Decree No. 32/2008/ND-CP of March 19, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Education and Training;
At the proposal of the director of the Vietnam International Education Development Department;
The Minister of Education and Training promulgates the Circular promulgating the Regulation on management of foreigners studying in Vietnam.
Article 1.To promulgate together with this Circular the Regulation on management of foreigners studying inVietnam.
Article2.This Circular takes effect on April 11, 2014, and replaces DecisionNo. 33/1999/QD-BGDDT ofAugust25, 1999, promulgatingthe Regulation on the work of foreigners studying inVietnam.

Article 2.Subjects of application
This Regulationprescribesthemanagementofforeignersstudying at educationalinstitutionsofthenationaleducationsystem ofVietnam, includingprimaryschool,lowersecondaryschool,uppersecondaryschool, and professional secondary school students; college and university students;studentsofmaster degree trainingprograms;doctorate students; traineesofrefreshercourses;andapprentices(belowcollectively referredto asforeignstudents).
Article 3.Interpretation of terms
In this document, the terms below are construed as follows:
1.Foreignstudents under agreementsare foreign studentswhoare acceptedtostudyinVietnam andgrantedscholarshipsby theVietnamese Governmentunderaccordsoragreements between the SocialistRepublic of Vietnamand other countries,territories or international organizations;
2.Scholarship-receivingforeignstudentsareforeignstudentsother than thesubjectsdefinedinClause1ofthisArticlewhoaregrantedscholarships byorganizations or individuals to studyinVietnam;
3.Self-financingforeignstudentsareforeignstudentswhoare accepted tostudyinVietnam underagreementsortrainingcontractsbetween Vietnameseeducationalinstitutionsandforeignorganizationsorindividuals oroverseasVietnameseandwhosestudy andtrainingexpensesare not coveredby scholarshipslike the subjectsdefinedinClauses1and2of this Article.
4. Educational institutions accepting foreign students for training includegeneraleducationinstitutions, vocationaleducationinstitutionsand higher education institutions.
5.Foreign student-servicing establishments mean boarding institutions thatarepermittedtoadmitforeignstudentsduringtheirstudy coursesin Vietnam.

1. Vietnamese is the officiallanguage usedinVietnamese national educational institutions.
2.Foreignstudentsmay useotherlanguagespermittedtobe usedin trainingby educationalinstitutionsintheirstudy,researchandpractice activities.
CONDITIONS AND ORDER FOR RECEPTION OF FOREIGN STUDENTS
Article 5.Conditions on academic or professional knowledge
1.Foreignstudentstobeadmittedinuppersecondary education, professionalsecondaryeducation, collegial, university, master or doctorate programsmust possess graduation diplomasat leastequal to the Vietnamese graduationdiplomasprescribedintheEducationLaw foreacheducational grade and training level.
2.ForeignstudentswhocometostudyinVietnam mustsatisfy the Vietnameselanguagecommandrequirementforeachtraining level or program.
3. Foreignstudentswhoregister touse other languagespermittedtobe usedintrainingby educationalinstitutionsintheirstudy, researchand practiceactivitiesmustsatisfy therequirementof commandof those languagesunder eachprogram’sspecificregulations. Foreignstudentswho are native speakers(ofthelanguagesusedinstudy, researchandpractice activities) or have graduatedfromgeneraleducationschools, colleges, universitiesormaster or doctorateprogramsinthoselanguagesmay be exemptedfrom thelanguagerequirement.
4. Foreignstudentstobeadmittedinrefreshercoursesfor improvement oftheirprofessionalskillsmustsatisfyallconditionsandcriteria agreed upon byVietnamand the sending parties or under signed trainingcontracts.

6. Foreign students who wish to studymajors requiring talents and aptitude(culture,arts, finearts, architecture, sportsandphysicaltraining), in additiontotheconditionsprescribedinthisArticle,mustalsosatisfythe requirementsoftalentoraptitudeexaminationsorcontestsasprescribedby receiving institutions.
Article 6.Health and age conditions
1.Foreignstudentsmusthavegoodhealthtostudy inVietnam.After arrivinginVietnam,foreignstudentsshallhave healthcheck-upsat health establishmentsdesignatedby Vietnameseeducationalinstitutionsorforeign student-servicinginstitutions.Incaseaforeignstudentisaffectedby a social diseaseordangerouscontagiousdiseaseasprescribedby theHealthMinistry ofVietnamorfailstomeetthehealthconditionsforstudy, he/shemustreturn to his/her home country.
2.Conditionofageforforeignstudentsunderagreements complies with theagreementsoraccordsbetweenVietnam andothercountries, territoriesor internationalorganizations.Norestrictionontheageofother scholarship- receivingforeign students and self-financingforeign students.
Article 7.Condition of dossiers
A foreign student shall submit one set ofdossierin Vietnameseor English,comprising:
1.Aregistrationform(AppendixI).
2.Copiesandtranslations of diplomasandeducationresultscertifiedor notarizedby competentagenciesofthesendingcountry underregulationsfor eacheducation grade or training level.
3.Healthcertificategrantedby thecompetenthealthinstitutionofthe sending country or the Vietnamese provincial-level or central health institutionwithin sixmonths before the date of dossier submission.

5.Copiesofdocumentsprovingthefinancialcapability forstudy, researchand daily-life activities inVietnam.
6. A tentativeresearch plan (fordoctoratecandidates)orapractice program(for practice trainees).
7.Lettersofintroductionby twoscientistshavingaPh.D degree inthe same field of research(for doctorate candidates).
8.Validcopiesofdocumentsandcertificates ofaptitude, professional knowledge andresearchachievements (if any).
9.Acopyofthepassportwhichisvalidforthewholestudydurationin Vietnamor at least one year fromthe date expected to be inVietnam.
Article 8. Order for reception
1.For foreign students receiving scholarships under agreements:
a/BeforeJune15every year,thesendingcountriesshallsendthelistof foreign students and their registered study majors, enclosed with their dossiersasprescribedinArticle7ofthisRegulation,totheMinistry of EducationandTraining;
b/BeforeAugust1every year,theMinistry ofEducationandTraining shallcomplete the reception of foreign students, consider andapprove their dossiers and send its replies to the sendingcountries;

2. For other scholarship-receivingforeign students and self-financing foreignstudentswhocometoVietnam forstudy,researchorpracticeat differentlevelsinthenationaleducationalsystem,the reception shallcomply withtheagreementsortrainingcontractsbetweeneducationalinstitutions andforeignstudents or institutionsand individuals that grant scholarshipsto suchforeign students.
TRAINING AND MANAGEMENT OF FOREIGN STUDENTS
1. Foreign students who are not influentinVietnamese tofollow an official training program in Vietnamese shall take a pre-enrolment Vietnamesetrainingcourse.TheMinistry ofEducationandTrainingshall arrangeforeignstudentsunderagreementstostudyatinstitutionsoffering pre-enrolmentVietnamesetraining.Institutionsthatacceptother scholarship- receivingandself-financingforeignstudentsfortrainingmay organize pre- enrolmentVietnamesetrainingprogramsfor foreignstudents or sendforeign students to institutions offering pre-enrolmentVietnamese training.
Furtherstudiestogainspecializedknowledgerequiredforthe admission tomaster or doctorate level(if necessary) are organizedfor foreign students foroneacademicyearatmostbyeducationalinstitutionsacceptingthem for trainingafter theycomplete a pre-enrolmentVietnamese trainingcourse.
2. The duration of pre-enrolment Vietnamese training for foreign studentsunderagreementscomplieswiththeagreementsoraccordsbetween Vietnam andforeigncountries,territoriesorinternationalorganizations;for otherscholarship-receivingandself-financingforeign students,that duration complies with trainingcontracts.
3.Aftercompletingthe pre-enrolmentcourse, foreignstudentsshalltake atestofVietnameseskills.Ifpassingthetest,they may beshiftedtothe officialstudyprogram;iffailingthetest,they shallcontinuefurtherstudies andtakeanothertestuntilthey passandmay begrantedacertificatetobe shifted to the official training program.
Article 10.Immediate enrolment in official programs

2.Foreignstudentswhosatisfy therequiredskillsinthe language tobe usedby thetrainingprogram andsatisfyallconditionsonacademicor professionalknowledge, healthandage prescribedinArticles5and6of this Regulationmaybe enrolled in the official training program.
Article 11.Non-compulsory subjects for foreign students
1.Foreign studentswhoare admitted in professional secondary,college, university, master or doctorate programs may be exempted fromforeign language standards applicable to Vietnamese citizens following corresponding training programs inVietnamese.
Inthecourseoftraining,headsof educational institutions shallconsider teachingforeignstudentsinadvancedVietnamese instead of foreign languages.
2.Foreignstudents to be admitted in professional secondary, college or universityprogramsmay beexemptedfrom thesubjectofdefense-security education and select one of substitute subjects including advanced Vietnamese,Vietnameseculture,historyofVietnam oranotheroptional subject decided by heads of educational institutions based on their institutions’practicalconditions.
3.Clause2ofthisArticledoesnotapply toforeignstudentswhoare accepted to studydefense-securitymajors.
Article 12.Training duration and changes during training process
1.Studyduration to get degrees,diplomas,certificates
a/Thestudy durationatalleducationalgradesandtraininglevelsshall complywiththeEducationLaw,theLawonTertiary Educationandrelevant current legal documents;

2.Shortening or prolongation of studyduration
a/ Foreign students may shorten their training duration but shall complete contents of training programs under currentregulations;
b/Foreignstudentsunderagreementsmay notprolongtheir durationof studyorresearchattheirownwill.Ifitisnecessarytoprolongtheduration for completingtrainingprograms, includingthe pre-enrolmentduration, foreignstudentsshallreporttothe sendingparties, heads oftheeducational institutionswherethey are studyingfor proposalsandgetwrittenapprovalof the Ministryof EducationandTraining;
c/Forotherscholarship-receivingandself-financingforeignstudents, theprolongationofthestudy durationcomplieswithagreementswith educational institutions where foreign students are studying.
3. Temporarysuspension of study
a/Foreignstudentsunderagreementsmay temporarily suspendtheir study foratleastoneacademicyear if their plausiblereasonsareacceptedby thesendingpartiesandeducationalinstitutionsandapprovedinwritingby the Ministryof EducationandTraining.
b/Thedurationoftemporarysuspensionofstudy ofotherscholarship- receivingandself-financing students complies with agreementswith educational institutions.
4.Change of studymajor or educational institutions
a/Foreignstudentsunderagreementsmaynotchangetheirstudy majors oreducationalinstitutions.Foreignstudentsmaychangetheir studymajors or educationalinstitutionsonly whenthesendingpartiesoreducational institutions send theirwritten consents to theMinistryofEducation and Trainingwhichshalllaterissuedecisionstopermitthechange.Thechange ofstudymajorsoreducationalinstitutionsmay bedoneonly onceand applicable onlytoforeign students of college or higher level.

1.For foreign students under agreements
a/Trainingcriteria,regimesandexpensescomply withcurrent regulationsoftheMinistryofFinanceandtheagreements or accords between Vietnamand sending parties;
b/ Foreign students who have to prolong their study duration to completetraining programs forthereason ofchangeofstudymajors or educationalinstitutionsduetothefailuretomeettherequiredstudy progress may nolongerenjoy thecurrentscholarshipsduringthe prolongedduration. Allexpensesforthestudydurationprolongationshallbepaidby thesending parties andforeign students;
c/Foreignstudentswhotemporarily suspendtheirstudy may notenjoy thecurrentscholarshipsduringthetemporary suspensionduration. After the durationoftemporarysuspensionofstudy,foreignstudentswhoarequalified forbeingadmittedtoeducationalinstitutionsmay continueenjoyingsuch scholarships.Thetotal duration of reception of scholarshipscomplieswith Article 12 of this Regulation.
2.For other scholarship-receivingforeign students
Training expenses for scholarship-receiving foreign students comply with the agreements or training contracts signed between scholarship- grantingorganizationsorindividualsorforeignstudentsthemselves and educational institutions.
3.For self-financingforeign students
Tuition fee levels for self-financing foreign students comply with trainingcontracts betweeneducational institutions andforeign students. Foreignstudentsmustcoverby themselvesallotherexpensesarisingduring their studyinVietnam.

Foreignstudentsshallregister and update adequate andaccurate informationtothee-databasesystemforthemanagementofforeignstudents at http://lhsnn.vied.vnnwithin 30 days after their arrival in Vietnamfor admission,and update informationannuallyor when there are changes.
Educational institutions shall sendreports on the admission of foreign studentsfortraining(accordingtotheform providedinAppendixII)tothe MinistryofEducationandTraining(theVietnam InternationalEducation DevelopmentDepartment)beforeJanuary15everyyear (bypostand datafile totheaddresslhsnn@vied.vn) for jointcoordination inmonitoringand management;andurgeforeignstudentsacceptedbyinstitutionstoregister andupdateinformationtothee-databasesystemformanagementofforeign students specifiedatArticle 14 of this Regulation.
RIGHTS AND RESPONSIBILITIES OF FOREIGN STUDENTS
Article 16.Rights of foreign students
1. To be treated equally like Vietnamese citizens.
2.Tobeprovidedwithadequateinformationto serve their study accordingtotheconditionsofeducationalinstitutionsandforeign student- servicingestablishments;
3. To have access to equipment and facilities to serve their study, cultural, sportand physical trainingactivities ineducational institutions and foreign student-servicingestablishments.

5. To participate in scientific research activities organized by educational institutions like Vietnamese citizens.
6. Tositexams, take tests, defendgraduationtheses, receive graduation certificates or diplomas.
7.Toreturntotheirhomecountriesforsummer vacationsand holidays; toinvitetheirrelativesto visitVietnamunder Vietnamese regulations; to take annualleaveorsickleaveorleaveformedical treatment when obtaining educational institutions’approval.
8. Foreign students under agreements may receive scholarships and otherentitlementsundertheagreementsoraccordsbetweenVietnamand their sendingcountries andcurrentregulations of Vietnam.
9. Foreign students of the same country, studying at the same educationalinstitutionorlivinginthesamedormitory may appointtheir representativestomanageallactivitiesofforeignstudentsoftheircountry and to act as liaisons with educational institutions or foreign student- receivingestablishmentsinordertosettlemattersrelating to their country’s foreign students.
Article 17.Responsibilities of foreign students
1. Toabide bylaws of the SocialistRepublic of Vietnam.
2. Torespect the Vietnamese customs and traditions.
3.ToobservetheRegulationonmanagement of foreigners studying in Vietnam, training regulations, school rules on each education grade or traininglevelpromulgatedbyVietnam’sMinistry ofEducationandTraining; regulationsandinternalrulesonstudy anddaily-lifeactivitiesprescribedby educational institutions or foreign students-servingestablishments.

5.ToobservetheregulationonforeignworkersinVietnam incase foreign students work or performpart-time jobs inVietnam.
6.TostrictlyobserveregulationsandpurposesofenteringVietnam for study.
7.TomaintainfriendlyrelationswithVietnamesecitizensaswellas with students fromother countries.
8.Topreserveandprotectthepropertyoftheeducationalinstitutions andforeign students-servicingestablishments.
ADMISSION OF FOREIGN STUDENTS FOR TRAINING AND SERVICE
Article18.Responsibilities of units of the Ministry of Education and Training
1.TheInternationalCooperationDepartmentshallassume the prime responsibilityfor,andcoordinatewiththeVietnam InternationalEducation DevelopmentDepartmentandrelatedagencies, inpreparingandcompleting proceduresfor the signing of cooperationagreements or accords on the admissionof foreign students inVietnam.
2. The VietnamInternationalEducationDevelopmentDepartment shall:

b/Assumetheprimeresponsibility for,andcoordinatewithrelevant agencies in,formulating policies andregimes supportingforeign students;
c/CoordinatewithVietnam-basedforeignrepresentative agenciesand Vietnamese representative agencies abroad in receiving and managing foreign students;
d/Examineandsupervisetheadmission of foreign studentsfor training andmanagementby educationalinstitutionsandforeignstudents-receiving establishments to summarize andreport onforeigners studying inVietnam.
3.Alldepartments,theInspectorate, theMinistry’sOffice shall coordinate with the VietnamInternational Education Development DepartmentandtheInternationalCooperation Department in settling matters relatedtoforeignersstudyinginVietnamaccordingtoassignedfunctionsand tasks.
Article19.Responsibilities of institutions which admit foreign students for training and service
1.Institutionswhichadmitforeignstudentsfor trainingand service shall manageforeignstudentsduringtheirstay inVietnam;coordinate with competentagenciesin settling matters related to foreign students during their stayinVietnam.
2. Responsibilitiesofeducationalinstitutionswhichadmit foreign students for pre-enrolment training inVietnamese:
a/Toelaborate programs, plans, conversationVietnamese teaching materials,Vietnameselanguagefordifferentgroupsoftrainingmajors, levels andforeign students;
b/Tocoordinate witheducational institutions designated bythe Ministry ofEducationandTraining in organizing tests of their Vietnamese skills upon the completionof the pre-enrolmenttrainingprogramsandgranting certificatesofVietnameseskills toforeign students who have passed such tests;

d/ToreporttotheMinistry ofEducationandTrainingonthetransfer, study andpracticeresultsofforeignstudentsattheendof the pre-enrolment training programs.
3. Responsibilitiesofeducationalinstitutionswhichadmit foreign students under agreements for official training programs:
a/ Toensuretrainingprograms, plans, contentsandquality;toarrange classroomsandtutors;tomonitorandmanagethestudyandresearch;to grantgraduationdiplomas or certificatesaccording to their competence; to proposetheMinistryofEducationandTrainingtoadjustgeneralprovisions onforeign student training programs incase of necessity;
b/Tocoordinate witheducational institutionswhich undertake pre- enrolment training for foreign students and educational institutions designatedby theMinistry ofEducationandTraininginorganizingtestsof theirVietnameseskillsbeforeadmittingthem inofficialstudy courseswhen necessary;
c/Toreportonstudysituationandstudy andpracticeresultsofforeign studentsattheendofeachacademicyearandevery semestertotheMinistry of EducationandTraining.
4. Responsibilitiesofeducationalinstitutionswhichadmitself-financing foreign students for training
a/Toprovidetrainingonlytoself-financingforeignstudentsinmajors inwhich theyare permitted to provide training;
b/To sign trainingcontracts with self-financing students;
c/Tocompile recordsand lists of self-financingforeign students under signedtrainingcontractsforsubmissiontotheMinistry ofEducationand Training,tocoordinate withcompetentagencies in settlingmattersrelating to the admission of self-financingforeign students;

dd/Tomanagethecollectionandspendingoftuitionfeespaidby the foreign students according to the currentfinancialregimes;
e/Tosendself-financingforeignstudents(whennecessary) to educationalinstitutionswhere Vietnamese is taught under pre-enrolment trainingprogramsforforeignstudents according to direct negotiations and contracts with such institutions;
g/ To report on enrolment results and studyand practice results of foreignstudentstotheMinistry ofEducationandTrainingasprescribedin Article 15 of this Regulation.
5.Responsibilities of foreign student-servicingestablishments
a/Toberesponsiblefor material life and daily-file activities of foreign students;
b/ToobservetheVietnamese State’s policiesandregimes towards foreignstudentsaswellas the regime of periodicalreporting on the situation offoreignstudents tomanagingagenciesfor summarizationandreporting to the Ministryof EducationandTraining.
COMMENDATION, REWARD AND HANDLING OF VIOLATIONS
Article20.Commendation, reward and handling of violations of foreign students

2.Foreignstudentswhobreachdisciplines shall, dependingonthe seriousness of their violations,be subject to the following handlingforms:
a/Reprimand;
b/Caution;
c/Suspension of studyandforcible return to home countries;
d/Handlingin accordance withVietnamese lawsat the request of relevantagencies.
3.FormsofdisciplinespecifiedatPointsaandb,Clause2ofthis Article shall be decided by heads of education institutions and foreign student-servicingestablishments.FormsofdisciplinespecifiedatPointsc andd,Clause2ofthisArticleshall be decidedfor self-financing students by headsofeducationalinstitutions and foreign student-servicing establishments agreements with sending sides forscholarship-receiving foreign students; foreignstudentsunderagreementsshallbereportedtotheMinistry of EducationandTraining on decision.
1. Organizations and individualsrecordingoutstandingachievements in training,managingandservicingforeignstudentsmay becommendedand rewarded inaccordance with the LawonEmulationandCommendation.
2.Organizationsandindividualscommittingactsof violation of this Regulationandotherregulationsshall, dependingonthe seriousnessof their violations,be handled inaccordance with law.
