Resolution 694/NQ-UBTVQH14 in 2019 on adjustment of administrative boundaries and establishment of commune-level urban administrative units in Dong Nai province issued by the National Assembly Standing Committee

RESOLUTION

ON AMENDMENTS TO ADMINISTRATIVE DIVISIONS AND ESTABLISHMENT OF SOME COMMUNE-LEVEL URBAN ADMINISTRATIVE UNITS OF DONG NAI

STANDING COMMITTEE OF THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Local Government Organization No. 77/2015/QH13;

Pursuant to the Resolution No. 1211/2016/UBTVQH13 dated May 25, 2016 by the Standing Committee of the National Assembly on administrative unit standards and administrative unit classification;

At the request of the Government in Proposals No. 78/TTr-CP, 80/TTr-CP and 82/TTr-CP dated March 20, 2019 and Inspect Report No. 2287/BC-UBPL14 dated May 07, 2019 by the Committee on Laws,

HEREBY RESOLVES:

Article 1. Amendments to administrative divisions of Bau Ham 2, Hung Loc, Quang Trung and Xuan Thanh communes and establishment of Dau Giay town in Thong Nhat district, Dong Nai

1. Amendments to administrative divisions of Bau Ham 2, Hung Loc, Quang Trung and Xuan Thanh communes in Thong Nhat district:

a) 4,69 km2 of land area and 13.692 residents of Bau Ham 2 commune shall be allocated to Xuan Thanh commune;

b) 5,43 km2of land area and 2.300 residents of Bau Ham 2 commune shall be allocated to Hung Loc commune;

c) 14,07 km2of land area and 42 residents of Xuan Thanh commune shall be allocated to Bau Ham 2 commune;

d) 8,79 km2 of land area and 4.266 residents of Xuan Thanh commune shall be allocated to Hung Loc commune;

dd) 5,97 km2 of land area and 2.974 residents of Quang Trung commune shall be allocated to Bau Ham 2 commune.

2. After administrative divisions of Bau Ham 2, Hung Loc, Quang Trung and Xuan Thanh communes in Thong Nhat district are amended:

a) Bau Ham 2 commune shall have 30,11 km2 of land area and 10.739 residents.

Bau Ham 2 commune borders Long Khanh city to the East; Trang Bom district to the West; Dau Giay town and Hung Loc commune to the South; and Quang Trung commune and Xuan Thien commune to the North;

b) Hung Loc commune shall have 35,13 km2 of land area and 18.912 residents.

Hung Loc commune borders Long Khanh city to the East; Trang Bom district to the West; Lo 25 commune and Cam My district to the South; and Dau Giay town and Bau Ham 2 commune to the North;

c) Quang Trung commune shall have 30,48 km2 of land area and 23.283 residents.

Quang Trung commune borders Xuan Thien commune to the East; Trang Bom district to the West; Bau Ham 2 commune to the South; and Gia Kiem commune to the North;

d) Xuan Thanh commune shall have 14,14 km2 of land area and 23.309 residents.

3. Dau Giay town shall be established with all of the land area and residents of Xuan Thanh commune after administrative divisions are amended.

Dau Giay town borders Bau Ham 2 commune to the East and North and Hung Loc commune to the West and South.

4. After Dau Giay town is established, Thong Nhat district shall have 10 commune-level administrative units, including 09 communes and 01 town.

Article 2. Establishment of Hiep Phuoc town in Nhon Trach district, Dong Nai

1. Hiep Phuoc town shall be established in Nhon Trach district with all of 18,83 km2 of land area and 38.645 residents of Hiep Phuoc commune.

Hiep Phuoc town borders Long Thanh district to the East; Long Tan commune and Phu Hoi commune to the West; Long Tho commune and Phuoc An commune to the South; and Phuoc Thien commune to the North.

2. After Hiep Phuoc town is established, Nhon Trach district shall have 12 commune-level administrative units, including 11 communes and 01 town.

Article 3. Establishment of An Hoa, Hiep Hoa, Hoa An, Phuoc Tan, Tam Phuoc and Tan Hanh wards in Bien Hoa city, Dong Nai

1. An Hoa ward shall be established in Bien Hoa city with all of 9,21 km2 of land area and 22.925 residents of An Hoa commune.

An Hoa ward borders Phuoc Tan ward to the East; Long Binh Tan ward to the West and North; and Long Hung commune to the South.

2. Hiep Hoa ward shall be established in Bien Hoa city with all of 6,97 km2 of land area and 15.468 residents of Hiep Hoa commune.

Hiep Hoa ward borders An Binh ward and Binh Da ward to the East; Quyet Thang ward and Buu Hoa ward to the West; Tan Van ward to the South; and Thong Nhat, Tan Mai and Tam Hiep wards to the North.

3. Hoa An ward shall be established in Bien Hoa city with all of 6,85 km2 of land area and 33.099 residents of Hoa An commune.

Hoa An ward borders Buu Hoa ward to the East; Tan Hanh ward and Binh Duong province to the West; Binh Duong province to the South; and Buu Long, Hoa Binh and Thanh Binh wards to the North.

4. Phuoc Tan ward shall be established in Bien Hoa city with all of 42,77 km2 of land area and 52.602 residents of Phuoc Tan commune.

Phuoc Tan ward borders Tam Phuoc ward and Trang Bom district to the East; Long Hung commune, An Hoa ward and Long Binh ward to the West; Tam Phuoc ward and Long Hung commune to the South; and Trang Bom district to the North.

5. Tam Phuoc ward shall be established in Bien Hoa city with all of 45,10 km2 of land area and 53.731 residents of Tam Phuoc commune.

Tam Phuoc ward borders Trang Bom district and Long Thanh district to the East; Long Hung commune to the West; Long Thanh district to the South; and Phuoc Tan ward and Trang Bom district to the North.

6. Tan Hanh ward shall be established in Bien Hoa city with all of 6,06 km2 of land area and 9.407 residents of Tan Hanh commune.

Tan Hanh ward borders Dong Nai river to the East; Binh Duong province to the West and North; and Hoa An ward to the South.

7. After An Hoa, Hiep Hoa, Hoa An, Phuoc Tan, Tam Phuoc and Tan Hanh wards are established, Bien Hoa city shall have 30 commune-level administrative units, including 29 wards and 01 commune.

Article 4. Effect

1. This Resolution comes into force from July 01, 2019.

2. Starting from the entry into force of this Resolution, Dong Nai shall have 11 district-level administrative units, including 09 districts and 02 cities; and 170 commune-level administrative units, including 122 communes, 40 wards and 08 towns.

Article 5. Implementation

1. The Government, People's Council and People's Committee of Dong Nai and relevant regulatory bodies and organizations shall implement this Resolution; organize and stabilize apparatus of local regulatory bodies and organizations; and enable Dong Nai’s residents to return to normal daily life, ensuring socio-economic development and national defense and security in Dong Nai.

2. Regulatory bodies, organizations and units whose names are related to the names of An Hoa, Hiep Hoa, Hiep Phuoc, Hoa An, Phuoc Tan, Tam Phuoc, Tan Hanh and Xuan Thanh communes must change their names in accordance with the names provided for in this Resolution before this Resolution’s entry into force.
